论中国援外不附加政治条件原则的理论基础及现实意义

不附加政治条件原则的雏形是中国援外八项原则中的不附加任何条件原则。伴随中国改革开放和援外体制改革,期间曾表述为不附加任何政治条件。只字之差,反映了中国援外政策的变与不变之道。国家主权平等原则、不干涉原则以及经济发展的内在性要求,是不附加政治条件原则的理论基础。西方国家之所以歪曲和批评这一原则,归根结底还是出于对中国影响力上升的猜忌和遏制。着眼长远,中国援外的国际化道路是一个必然趋势,但是在变与不变之间,不附加政治条件原则仍将具有长久的生命力。

候保期间事故之赔付探讨

候保期间发生保险事故是否应当赔付的问题,是困扰我国司法界的一个难题。如果投保人在投保前已经交付保险费,基于对价平衡、合理期待等理论,保险人应当承担候保期间事故的赔付责任。学术界对此种赔付的性质有三种不同认识:缔约过失责任、侵权责任以及未成立之保险合同的契约责任,但这三种认识都存在问题,保险人承担的责任应当为临时保险的契约责任。我国未来建立临时保险制度的方向应当确定为:在投保人已经交付保险费的情况下,保险人必须提供不附条件的临时保险;在投保人未交付保险费的情况下,保险人可以自愿为被保险人提供临时保险。     

新中国外交60年:实践特点和理念演变

60年的新中国外交实践在捍卫和扩展国家利益、顺应时代潮流和伸张国际正义、积聚和善用国家软实力、转变外交模式等方面形成了鲜明的中国特色,新中国的外交理念也在历史进程中形成了与时俱进的世界观、时代观、利益观、和平观、统筹观等。中国外交的丰富实践和先进理念相辅相成,正在为中国继续发展为世界强国奠定基础。在今后40年(即共和国百年庆典时)的历史进程中,中国外交将在构建和巩固新的国际多极格局和国际体系、推动亚洲共同体建设、引领战略思维、承担大国责任、预见世界变化和提升实践艺术等方面发挥更加重要和富有成效的作用。     

Does One Size Fit All? Ethnic Differences in Parenting Behaviors and Motivations for Adolescent Engagement in Cyberbullying

Cyberbullying has become a growing concern for adolescents. This study examined differences in cyber-aggression for 518 Canadian adolescents of either East Asian or European descent (61 % female; M age = 15.24; SD = 1.68). Associations between parenting behaviors (parental control, parental solicitation, and child disclosure) and engagement in cyber-aggression, as well as motivations for engaging in cyber-aggression were explored. Adolescents completed self-report questionnaires about their engagement in cyberbullying, perceptions of their parents’ behaviors about their online activities, their motivations for cyberbullying (reactive vs. proactive), as well as several other relevant psychosocial and demographic variables (e.g., sex, age, Canadian born, mother’s education level, using a computer in a private place, and average amount of time spent online). Regression analyses showed that East Asian adolescents were less likely to engage in cyberbullying. In addition, higher levels of parental control and lower levels of parental solicitation were linked more closely with lowered reported levels of cyber-aggression for East Asian adolescents relative to their peers of European descent. In addition, East Asian adolescents were more likely to be motivated to engage in cyber-aggression for proactive reasons than reactive reasons, with the opposite found for adolescents of European descent. A significant 3-way interaction suggested that this pattern was more pronounced for East Asian males relative to East Asian females. Findings are discussed in terms of cultural differences based on the doctrines of Confucianism and Taoism.     

Preventing suicide in prisons, part II. International comparisons of suicide prevention services in correctional facilities

The International Association for Suicide Prevention created a Task Force on Suicide in Prisons to better disseminate the information in this domain. One of its objectives was to summarize suicide-prevention activities in the prison systems. This study of the Task Force uncovered many differences between countries, although mental health professionals remain central in all suicide prevention activities. Inmate peer-support and correctional officers also play critical roles in suicide prevention but there is great variation in the involvement of outside community workers. These differences could be explained by the availability of resources, by the structure of the correctional and community services, but mainly by the different paradigms about suicide prevention. While there is a common and traditional paradigm that suicide prevention services are mainly offered to individuals by mental health services, correctional systems differ in the way they include (or not) other partners of suicide prevention: correctional officers, other employees, peer inmates, chaplains/priests, and community workers. Circumstances, history, and national cultures may explain such diversity but they might also depend on the basic way we think about suicide prevention at both individual and environmental levels.     

从“省直管县财政改革”迈向“省直管县行政改革”——安徽省直管县财政改革的调查与思考

安徽等地实行的省直管县财政改革和扩权强县改革,在创新财政体制、推动县域经济发展、提高行政管理效率等方面取得了明显成效,但省直管县财政体制与市管县行政体制并存也产生了亟待解决的问题。要从根本上解决这些问题,继续放大财政改革和扩权改革的体制能量与制度功效,必须适时启动和稳步推进省直管县行政改革,构建扁平化的省直管县公共行政体制。     

A Novel Solvent-based Method to Separate Duct Tape from Porous Surface for Fingerprint Development

In this study, we have proposed a novel solvent-based method using a specific concentration of 3M™ Novec™ HFE-72DE and 7200 solvents to untangle duct tape from porous article with minimal impact to the quality of latent fingerprint deposited on the sticky-side surface of duct tape. A series of experiments determined that a mixture of 30% HFE-72DE:7200 (v/v) was found to be the most effective to separate various brands of duct tape from different types of porous surface, including office copy paper, newspaper, cardboard, and tissue wipe, which had been stored for up to 30 days before untangling. Further studies also revealed that 30% HFE-72DE:7200 was compatible with three common fingerprint development methods for porous articles, namely ninhydrin, indanedione-zinc, and physical developer. The nonflammability and low toxicity nature of this novel solvent mixture also make it ideal for separating duct tape from porous surface in laboratory or at crime scene.     

法律实训课程的创建与实践(二)--以刑事法综合实训课程的创建与实践为例

高等法律职业教育的人才培养目标是按照法律职业的需要,培养具有综合职业能力的高级专门人才.目前,高等政法院校也开展了一些法律实训教学,但是,其法律实训教学一般仅是某门法律理论课中的一个教学环节,很多高校并未独立设置有法律实训课程.为此,高等政法院校应深入开展法律实训课程的创建和实践活动,创建出适合我国国情的法律实训课程体系.
