论集资诈骗罪的认定与司法适用

集资诈骗罪认定的关键要素在于:主观上的非法占有目的和客观上的非法集资行为。主观上的非法占有目的判断不能从主观到主观,要有客观事实予以支撑。客观上非法集资行为的评价,监管部门的许可并非必要的因素,关键在于这种集资行为是否会对集资对象的财产以及财产利益带来具体的危害。     

Overestimating the Shift from Government to Governance: Evidence from Swiss Metropolitan Areas

There is an oft‐stated claim in political science research that public sector reforms in Western democracies are consistent with a shift from government to governance. This article challenges that claim. Based on a comparative analysis of governance reforms in Swiss metropolitan areas, the article reveals that what seems to be a shift to governance may turn out to be a path to government, however, including a change either from the local to the metropolitan level or from general‐purpose authorities to task‐specific jurisdictions. Further, the article analyzes the political dynamics behind governance reforms. It shows that exogenous pressures put existing governance schemes under strain. Its impact, however, is mediated by the initial institutional setting and the narratives responding to case‐specific political dilemmas.     

中国政府防范生物恐怖袭击对策研究

文章借鉴国外防范生物恐怖袭击对策的经验和教训,结合我国的实际情况,提出了中国政府防范生物恐怖危机的组织管理体系、法律保障机制、公共管理对策以及危机后管理等政策建议。文章系统地就中国政府建立危机管理体制进行了探索性的研究。     

21世纪中美双边关系中的台湾问题

中美双方既有共同利益,又有一些分歧,既有积极协调合作的需要,又会发生摩擦对抗。中美之间的关系基本上可以定为非零和博弈。台湾问题是影响中美关系发展的主要因素。美国对台政策具有一贯的现实主义本质。围绕台湾问题中美应从近期、中期、长期目标集中探讨两国合作议题。     

论朝鲜半岛多边安全合作机制

冷战时期 ,朝鲜半岛形成了美苏之间军事和意识形态上两极体制上的对立。但随着冷战的结束 ,韩俄、韩中、美俄、美中等国家间实现了政治上的和解。东北亚地区的安全环境发生了巨大的变化 ,出现了多样的国际行为体 ,形成了多元化的结构 ,致使这一地区内国家间各种合作的重要性也在不断加强。在变化了的安全状况下 ,会产生建立多边安全合作机制的要求。面向 2 1世纪 ,多边安全合作机制对于保障国家安全、地区稳定以及东北亚和平与繁荣有着重大的影响 ,也是非常必要的。     

University-industry consortium agreements Center for Process Analytical Chemistry: A case study

There is a surfeit of articles, books, and conferences on the subject of university-industry collaboration, but few of them address specific, pragmatic issues related to the development of an operable sponsorship agreement. This article focuses on the terms of the agreement negotiated with industry sponsors of the National Science Foundation (NSF) Industry-University Collaborative Research Center (IUCRC), established at the University of Washington in 1984 as the Center for Process Analytical Chemistry (CPAC). Over the past 11 years, CPAC has grown dramatically and achieved important successes, but some of the terms in the initial agreement have proven to be problematic, particularly those dealing with intellectual property rights. This article reviews the nature of the problems and explains the solutions negotiated by participants as part of a revised agreement implemented in 1992.     

Expression of adhesion molecules in skin wounds: diagnostic value in legal medicine

The adhesion molecules identified in recent years can help improve the diagnosis of the wound age, especially of injuries with a short survival time. This is also indicative of the vitality of the wounds. The material investigated in the study originated from 465 skin wounds. The samples were taken from human autopsy material, during the surgical treatment of wounds (excision) of patients and from experimental incised wounds of mice. To judge the age of skin wounds the endothelial adhesion molecules were detected in paraffin sections after autoclaving and using the ABC technique. Human skin wounds: strong positive staining was observed of ICAM-1 1.5 h at the earliest and 3.5 days at the latest, for the P-selectin 3 min at the earliest and 7 h at the latest, for the E-selectin 1 h at the earliest and 17 days at the latest and for VCAM-1 3 h at the earliest and 3.5 days at the latest after the time of injury. The L-selectin was expressed constitutively. Mice skin wounds: strong positive immunohistochemical reactions were found as a rule earlier than in human skin wounds. The detection of an increased expression of ICAM-1, VCAM-1 and P- and E-selectins can improve the wound age assessment in injuries with short survival times.
