故意在德、日刑法的犯罪论体系中的地位经历了一个变化的过程,即由从以往的有责性中分离到构成要件该当性中,这种变化一方面是由于司法实践中实务操作的需要,另一方面也说明了犯罪的主观方面在犯罪论体系中所起到的重要作用,同时说明了刑法对行为人罪过的重视。这在某一方面也说明了人类社会是某一观念的共同体。     

How Filipina Maids Are Treated in Hong Kong—A Comparison Between Chinese and Western Employers

This study compares Chinese and Western employers in Hong Kong in terms of their treatment of Filipina domestic helpers in four major areas: atmosphere of work environment, consideration, social psychological distance, and personal space. The data were based on in-depth and structured interviews, mainly with Filipina helpers who have served both types of employers. A few Chinese and Western employers were also interviewed. The findings indicate that the Filipina maids, in general, are more satisfied with their Western employers, who tend to provide them with an easier and more comfortable work environment; are more considerate; are more likely to treat them on equal terms; and to allow them more personal space. Within group variations in the treatment of maids are greater among Chinese employers than Western employers. This means that, in terms of the treatment of Filipina maids, Western employers in Hong Kong are more homogeneous and tend to concentrate on the positive side, whereas Chinese employers are more diversified.     

Weakened State and Social Movement: the paradox of Taiwanese environmental politics after the power transfer

Of all the Chinese societies, Taiwan witnessed the first peaceful and democratic power transfer in 2000. With the coming to power of the Democratic Progressive Party (DPP), new political opportunity was opened up for environmentalists, who had been aligned with the DPP for more than a decade. Did the regime change provide a better milieu for synergy between environmental activists and state officials? Was a better style of environmental governance possible under the DPP government? These are the main questions this paper tries to raise and answer. A puzzle has been found here. While environmentalists have gained important access to policy decision-making, pro-development counter-mobilizations were also on the rise, and government policy shifted to a more pro-business stand consequently. This paper argues that this paradox resulted from the weakened state capacity, which simultaneously empowered environmentalists and could not resist business's lobbying.

Raising Seoul's global competitiveness: developing key performance indicators

This paper develops a set of key performance indicators (KPIs) for Seoul city administration, inaugurated in 2006. Proper establishment and application of the KPIs into its administration would not only help in accomplishing municipal leadership's strategic initiations but also enhance Seoul's global competitiveness. At the same time, the KPIs can be a good communication tool through which the leadership and city customers can communicate with each other.     

The influence of suspect gender in domestic violence arrests

This study examines heterosexual domestic violence incidents involving male and female suspects. The sample includes 428 incident reports filed at the Columbia (South Carolina) Police Department between 1993 and 1997. Police officers appear to use different arrest determinants for women than for men. The implications of these differential law enforcement practices are discussed.
