刑事拘传的立法完善

要规范执法,保障人权,应改变我国目前拘传规定得过于简略的现状,完善拘传立法。为此,需扩大拘传的对象范围,明确拘传的情形,延长拘传的时限,规定拘传的时间间隔,统一拘传的令状,充实拘传的程序,并将侦查中有关拘传的内容集中到强制措施中。

我国交通运输业的迅猛发展使传统水上航运的地位日渐突出,同时,水上交通肇事犯罪事故也不断增多,而现行法律对水上交通肇事逃逸犯罪的处罚力度显然不够。因此,有必要对水上交通肇事逃逸犯罪进行法理上的分析,并在此基础上进一步完善其在立法和执法方面的法律法规。
