This article addresses some of the legal implications of the popular consumer-to-consumer electronic commerce model, in particular the implications of the successful and popular auctions site eBay.     

Some Remarks on the Concept of Toleration

The paper contains a conceptual analysis of "act of toleration" and the property of "being tolerant". Being tolerant is understood as a dispositional property of persons manifested in what the author calls the "circumstances of toleration". The main circumstances distinguished are: a tendency to prohibit a certain behaviour and the competence to determine the deontic status of the behaviour in question. An act of toleration, then, consists in not prohibiting (or cancelling the prohibition of) that behaviour. It is argued that this requires the existence of two different normative systems, the "basic system", and the "justifying system". Acts of toleration must be based on reasons coming from the latter. This insight enables one to establish a difference between reasonable and unreasonable toleration, as well as between toleration and related concepts like indifference, acquiescence, etc. The analysis also introduces the distinction between "vertical" and "horizontal" toleration. Acceptance of this last category implies that toleration does not necessarily require hierarchical relationships between those who tolerate and those whose actions are tolerated.     

Contests Among Bureaucrats

This paper deals with double lobbying: several bureaucratsparticipate in joint lobbying to get a high total departmental budget, butthey also engage in antagonistic lobbying to reap as high a share of thetotal budget as possible. The antagonistic lobbyingconstitutes a contest among the bureaucrats. This papercharacterizes the Nash equilibria in lobbying and shows inwhich way exogenously fixed bureaucratic incomes induce thesame or different lobbying behavior as incentive incomes.     

Can Business Development Services practitioners learn from theories of innovation and services marketing?

Business Development Services (BDS) programmes have become big business for international donors and NGOs. Focusing on small enterprises in developing countries, the current BDS approach assumes that the development of commercial markets is the key to success. Yet many of these programmes continue to have a limited impact. A review of modern theories of innovation and services marketing management suggests that this may be because current BDS support practice reflects a rather limited understanding of how new markets actually develop. Drawing on the insights that these theories offer, the authors suggest that BDS practice should develop a more evolutionary approach, recognising that service innovations develop through active, on-going interaction between suppliers and customers. The article concludes with practical policy guidelines and a discussion about tools that could help BDS to adopt this more successful approach.     

The zinc test as an alternative for acid phosphatase spot tests in the primary identification of seminal traces

The value of the acid phosphatase spot test in the primary visualization and identification of seminal traces is hampered by the sensitiveness of the enzyme to biodegradation. An alternative spot test is proposed, based on the high concentration of the more stable zinc metal in seminal plasma. The proposed zinc spot test is simple and suitable for on site investigation. Although the sensitivity in fresh stains is lower than that of the acid phosphatase spot test, this is largely compensated by the lower sensitiveness to biodegradation. The specificity for semen is higher than that of the acid phosphatase spot test. In vaginal swabs it was nevertheless seen, that samples should be taken within 24 h after alleged sexual assault to give reliable results.     

Evaluation of microbial soil identity in forensic science

Microbiologic analysis of different soil samples was undertaken to assess the value of this method for forensic purposes. Three groups of micro-organisms were isolated on selective media: bacteria, fungi, and actinomycetes. Comparison of the morphology of the colonies led to the conclusion of non identity of the soil samples under examination. The method was applied to soil traces on articles of clothing, trousers, shoes, and stockings. It was found that the soil did not originate from the suspected scene of a crime. Examination of the microbiologic soil composition does not provide an absolute certainty of identity, but it is highly reliable.
