Between the time that the first modern Italian mediation statutes were issued in 1993 and March 2011, when mandatory mediation procedures under Italian Legislative Decree 28/2010 went into effect, an interesting paradox emerged in Italian mediation: mediation usage was virtually nonexistent despite the high success rates of mediated cases. Clearly, the mere availability of mediation was not sufficient to attract disputants away from the courts, even though the Italian court backlog skyrocketed to 5.4 million cases during this period. Decree 28/2010 was issued by the Italian government to address this paradox through a mandatory mediation requirement, but the law has faced significant opposition from some members of the Italian bar in the form of public strikes and legal challenges. Legislators have responded to this dissent with reactionary amendments to “cure” problems in the regulatory structure, even though there has also been significant positive attention paid to the Italian mediation model at the European level. As the opposition to Decree 28/2010 now appears to be diminishing and recent data indicate that mandatory mediation is achieving its objectives (to the tune of tens of thousands of mediated cases since March 2011), two lessons in realpolitik emerge for mediation proponents. First, nothing less than compulsion can rapidly increase mediation use. Second, the legislator who compels mediation without openly engaging the opposition is not mediation savvy, for even in compelling a policy choice, one should be respectful and mindful of the opponent's position, if for no other reason than to minimize his or her opposition to the final result.  相似文献

Constructivist perspectives contend that individuals actively extract and make meaning from the world around them. In the classroom this means that students are not passive recipients or repositories for our theories and empirical findings; instead, they actively redefine and relate to (or not) the concepts presented. To simultaneously stimulate and build on this process, I adopted Photovoice as a pedagogical tool to situate students as observers of their own community and create space for them to engage in participatory, community-focused meaning making activities. By employing strategically crafted framing questions, students generated Photovoice data that served as a powerful jumping off point for discussing key community psychology concepts. In addition, the Photovoice process provided students the opportunity to directly experience a participatory research process as well as engage in basic qualitative data analysis. This article presents the general process my class undertook as well as qualitative feedback from students.  相似文献

Within intimate partner violence (IPV), sexual assault is often subsumed under the heading of physical abuse, but evidence suggests qualitative differences in outcomes when both types of abuse occur. This study explores the cumulative effect of sexual assault and physical abuse by a current or former intimate partner on helpseeking. Using a dataset of 1,072 IPV victims from 8 states, we found that women who had experienced sexual assault in addition to physical abuse (44%) used more help, but were also more likely to say that they did not seek help when they needed it. Among those who were aware of services, fear was the greatest obstacle to reaching out for help. Implications include the need for information on best practices in addressing the sequelae of both physical and sexual assault in victim service agencies.  相似文献

Students may be predisposed to benefit from mandatory service-learning programs based on their gender and upon whether their parents serve as models of helping. The role of each of these variables was examined in a survey of seventh grade students (n = 86) who were required to complete service during the school year. Results demonstrated that girls felt more positively about the specific program and were more likely to intend to help in the future than boys. Students with parental helping models were also more likely to intend to help in the future. Girls with parental models were more likely to have altruistic self-images than girls without parental models whereas the presence of parental helping models had no effect on boys' altruistic self-image. These results are discussed with regard to socialization of prosocial behavior in both boys and girls.  相似文献

This research examines a state crime of omission by members of the Office of the Architect of the Capitol. These crimes were perpetrated against a group of employees charged with maintaining the underground utility tunnels beneath the United States Capitol. Through a secondary analysis of congressional testimony; citations and documents issued by the Office of Compliance; medical records; and various media accounts of the events, this research seeks to examine the perpetrators’ actions as a state crime of omission and offer a theoretical explanation. Our findings suggest the actions and inactions of the Office of the Architect of the Capitol, over a period of years, embody the definition of a state crime. Our theoretical explanation examines the conditions that combined to foster an environment in which occupational exposure to asbestos continued for years, placing the life and health of the tunnel crew in serious jeopardy.  相似文献

Food security is political. The identification of food insecurity and the development and implementation of responses to it are enveloped in layers of politics and power. This politics might not be as readily apparent in emergency situations where broad agreement on the need for a response is evident. But in the everyday governance of food it must not be forgotten that food security is a contested concept. This article offers a preliminary elucidation of this politics in the Central African context. To do so it presents findings from an analysis of publicly available information and media reports. This analysis hones in on the perspectives of differently situated stakeholders on food security imperatives in the Central African Economic and Monetary Community. To identify similarities and differences in the levels of emphasis different stakeholders place on different aspects of food security, the authors employ Olivier De Schutter's understanding of the relevant dimensions. Specific terms used in the presentation of food security information are associated with one of the three dimensions of food security advanced by De Schutter: availability, accessibility and adequacy. In light of this analytic approach, the article finds that stakeholders – including businesses, civil society groups, governments and multilateral and bilateral partners – do not necessarily articulate similar viewpoints on food security. There is simply no unified view on what should be done to advance food security in Cameroon, Central African Republic, Chad, Congo-Brazzaville, Equatorial Guinea or Gabon. The measures of democracy commonly used in empirical research suffer notable limitations, primarily the exclusion of participation. As a result, quantitative studies may undervalue the effect of democracy on important social outcomes or misinterpret the aspect of democracy responsible for that effect. We respond by introducing and validating two variants of a new indicator, the Participation Enhanced Polity Score (PEPS), which augments institutional factors with the breadth of citizen participation. We demonstrate, using statistical evidence on democratic persistence, basic needs fulfillment, and gender equality, that no measure of democracy can be considered an accurate representation of its basic character without directly including participation as a core component.
