Race, Income, and College in 25 Years: Evaluating Justice O'Connor's Conjecture

In Grutter v. Bollinger, Justice O’Connor conjecturedthat in 25 years affirmative action in college admissions willbe unnecessary. We project the test score distribution of blackand white college applicants 25 years from now, focusing onthe role of black–white family income gaps. Economic progressalone is unlikely to narrow the achievement gap enough in 25years to produce today’s racial diversity levels withrace-blind admissions. A return to the rapid black–whitetest score convergence of the 1980s could plausibly cause blackrepresentation to approach current levels at moderately selectiveschools, but not at the most selective schools.     

Coffee House: Habitus and Performance Among Law Students

Drawing on the work of Pierre Bourdieu and Judith Butler, we develop a detailed ethnography of a social space in a major law school and explore its socialization of the students there. "Coffee House" is a weekly social event sponsored by Canadian law firms and offering free drink and food to the students present. We argue that this event and the actors involved profoundly change student identities and alter educational aspirations. Although the students themselves insist that "nothing is going on," our ethnography suggests that in "Coffee House" identity is developed through performances, and in the accumulation of symbolic capital, until ultimately students come to feel their future career path is not a matter of choice, but destiny. We explore the important work of Bourdieu through this setting, but ultimately we resist his determinism, and suggest instead that, following the work of Butler, identity is a more complicated and fluid dynamic between space, repetition, and performance. It appears that a personal unconscious transformation among law students attending Coffee House is underway; yet opportunities to change the meaning of this space and these performances remain.     

EC Merger Control: From Separate Jurisdictional Zones to a Cooperation Based Architecture?

The EC Merger Control Regulation(MCR) established an architecture ofconcentration control based on separate,non-overlapping jurisdictional spheres forMember states and the European Commission, withthe Commission alone having jurisdiction overconcentrations with a competition concern thatpotentially have a Community interest. Therationale is that this will help guarantee thelevel playing field for business and safeguardthe Single Market. This, of course, is verymuch dependant on the architecture working inpractice. The Community Dimension (CD) testsare at the centre of the architecture ofseparate jurisdictional zones, determiningwhich concentrations have a CD and hence aCommunity interest. The paper reveals that thecurrent form-based CD tests are flawed,undermining the effective operation of thearchitecture. It explores three competingproposals put forward to remedy the above flaw:an enhanced role for Article 22 MCR, a singlefine-tuned threshold test and, thirdly, theCommission's multiple notification approach.The paper contends that these proposals aloneare not sufficient to make the architectureeffective. It argues that what is required isan improved CD test applied in conjunction witha harmonised Articles 2 and 9 MCR approach. Inline with the Commission's desire to considerthe long term shape of EC merger control, thepaper concludes by looking at a radicalalternative to the efforts to fine-tune thearchitecture of separate jurisdictionalspheres. By way of stimulating debate, itconsiders an EC merger control based on anetwork of cooperation involving Member states'regulators and the Commission, and with allapplying EC merger law.

Assessing the Impact of Harassment by Peers: Incident Characteristics and Outcomes in a National Sample of Youth

Although there are widely held assumptions about the characteristics of peer bullying that are of greatest concern, very few studies have empirically assessed which characteristics most affect its impact. The current research addresses this gap by using a nationally representative U.S. sample of youth ages 10–20 to examine the relative effects of a variety of potentially aggravating incident characteristics on emotional, physical health, and school-related outcomes. Findings show support for power imbalance and duration (a stronger predictor than repetition) as incident characteristics that exacerbate the negative impact of peer harassment. However, several other incident characteristics have substantial effects with or without the presence of these qualities. Injury, sexual content, involvement of multiple perpetrators, and hate/bias components of peer harassment incidents each increased at least one negative outcome. Findings point to several features of peer harassment that can provide a basis for prioritizing victimization experiences in greatest need of intervention efforts.
