China-U. S. Economic and Trade Relations

Sino-U. S. economic and trade relations as the most important and dynamic component of bilateral ties have evolved into the stabilizer, pillar and driving force for cementing the linkage between the two capitals. Their furtherance along the designated line of treating a "stake holder" and handling a "constructive partnership" will carry an ever-ballooning strategic significance even in diplomatic and security terms. Nevertheless the general trend looks set to be incessant progress amidst reciprocal accommodation in disregard of occasional twists and turns.     

第二性,民主——关于民主地位的反思

民主在中国备受关注,对民主地位的理解常有对立。本文基于对中国现当代历史事实的反思,循唯物史观原理,论证了"第二性,民主"。提出:民族高于民主,民生高于民主,发展高于民主。民主进步的合理性不能仅由民主自身定,而应置于社会整体发展的参照系中观察。中国共产党提出"坚持党的领导、人民当家作主和依法治国有机统一",是中国现代化进程中民主政治建设的绩优框架,它是中国经验的总结,也是对西方民主理念进行"颠覆"性"落实"的后现代思维。     

Expand Friendly Cooperation and Build a Harmonious World

As early as in the beginning of the 1980's,the Chinese Association for International Understanding (CAFIU) started exchanges with the Friendrich Ebert Stiftung (FES). Since FES set up its Beijing office in 1987,fruitful cooperation has been conducted between FES and CAFIU,and other relevant parties of the Chinese side. Over the years,FES has made positive efforts and great contributions for deepening and developing understanding and friendship between the Chinese people and the German people,and for promoting the relations between the two countries and two parties,which we highly appreciate.     

SUPRANATIONAL GOVERNANCE OR NATIONAL BUSINESS‐AS‐USUAL? THE NATIONAL ADMINISTRATION OF EU STRUCTURAL FUNDS IN THE NETHERLANDS AND DENMARK

The partnership principle in EU cohesion policy was introduced in order to involve subnational authorities and interest organizations in policy formulation and implementation. In this article we examine how the member states have reacted to this call for a new way of making public policy. We argue that the multi‐level governance literature and the critics of the multi‐level governance framework have not examined implementation structures properly, but have focused on regional influence. We conduct a comparative analysis of the Dutch and Danish implementations of the European Social Fund and the European Regional Development Fund. Our findings show that when examining implementation structures it becomes clear that member states are in full control of the re‐allocation of EU funds. They show that Denmark and The Netherlands have been able to absorb EU cohesion policy within already existing national implementation structures of labour market policies and regional development. One central theoretical implication of our study is that the focus of studies of any fundamental re‐allocation of power resources in cohesion studies should comprise the entire network of implementation rather than the strategies of its individual component actors.

犯罪过失构成要素比较研究

科学地抽象和概括犯罪过失共同的构成要素并进行比较研究,对于正确认定犯罪过失和过失犯罪,具有积极的意义。中外学者都比较重视对过失构成要素的研究,但侧重点各不相同:国外学者特别是大陆法系的学者注重对构成要素内容的研究,国内学者则侧重于对其结构的剖析。违法性认识不是犯罪过失的构成要素。
