间接正犯成立范围的扩张——以犯罪事实支配理论为视角

间接正犯概念的缘起致使间接正犯最初以直接行为人为非故意犯罪为限。犯罪事实支配理论对间接正犯本质和类型的阐释,印证了间接正犯由替补者到独立地位的变迁,使得间接正犯的成立范围扩张至直接行为人为故意犯罪的情况。     

从俄罗斯民族个性看其音乐优良传统的继承

俄罗斯民族有着显著的民族个性特征，通过民族个性透视其音乐优良传统继承的原因内蕴，不失为一个富有创意的角度。本文试图分析俄罗斯民族个性，探讨其音乐艺术传统继承的民族个性作用，并认为俄罗斯民族的一个优秀传统，就是整个民族对于音乐艺术热烈的审美崇尚，而这种音乐艺术的传统继承和审美崇尚，都是基于俄罗斯民族的个性特征。     

环境瑕疵担保责任论纲——作为EPR政策落实手段的视角

瑕疵担保责任适用范围的渐趋拓展为其适用于环境领域提供了可能。我国的环境问题日益凸显,而相应的一些环境政策却无法得以具体落实,其中的EPR政策即为明证。基于此,文章重点对作为EPR政策私法落实手段的环境瑕疵担保责任进行了理论上的建构,明确了环境瑕疵担保责任与侵权法的关系,并依次从环境瑕疵担保责任的权利义务主体、客体、性质、内容、实现等方面加以详细分析。

Decomposition of embodied exergy flows in manufactured products and implications for carbon tariff policies

This article uses the concept of embodied exergy as metrics in designing incentive policy instruments to tackle the inefficiency of energy operations. Based on the second law of thermodynamics and energy’s economic properties as both a private commodity and a public good, it maintains that energy can be measured by separating the useful exergy embodied in a manufactured product from its waste exergy (anergy) as emissions and sunk wastes in a production process. It is rational to benchmark the content of useful exergy embodied in products for any incentive policy design to encourage green production. This article uses trade data between China, Japan and the EU countries to compare the embodied exergy and waste exergy embodied in traded manufactured products. It proposes using a negative value-added tax as an incentive instrument instead of full-scale carbon tariffs to encourage green production and to fence against carbon evasion behaviour.     

The Closeness Problem and the Doctrine of Double Effect: A Way Forward

A major challenge to the Doctrine of Double Effect (DDE) is the concern that an agent’s intention can be identified in such a fine-grained way as to eliminate an intention to harm from a putative example of an intended harm, and yet, the resulting case appears to be a case of impermissibility. This is the so-called “closeness problem.” Many people believe that one can address the closeness problem by adopting Warren Quinn’s version of the DDE, call it DDE*, which distinguishes between harmful direct agency and harmful indirect agency. In this paper, I first argue that Quinn’s DDE* is just as vulnerable to the closeness problem as the DDE is. Second, some might think that what we should therefore do is give up on intentions altogether and move towards some kind of non-state-of-mind, victim-based deontology. I shall argue against this move and explain why intentions are indispensable to an adequate nonconsequentialist theory. Finally, I shall propose a new way of answering the closeness problem.     

民主党派历史转变的历史考察

解放战争时期是各民主党派空前活跃并且发生历史转变的时期。当面对国民党残酷地发动内战时,各民主党派积极地加入到反对国民党的队伍中,但是还没有完全放弃走中间路线的想法。当民主党派和民主人士被国民党的白色恐怖包围时,各民主党派的立场发生了历史转变。他们接受中国共产党的领导,同中国共产党一起面对内战独裁、争取民主和平。并且帮助中国共产党一起建立新中国。
