试论执法公正

“执法公正”是指行政执法行为的过程和结果遵循和体现了公平与正义的原则,包括实体公正和程序公正。现阶段,我国更应强调程序公正。实现“执法公正”需要从完善立法、提高执法人员“法治”观念与执法水平入手。     

“Clean up and go straight”: Effects of drug treatment on recidivism among felony probationers

The central question we address in this article is whether participation in court-ordered drug treatment programs reduces future criminal involvement among convicted property offenders who have a history of drug abuse. Using a national sample of male property offenders sentenced to felony probation, we analyze drug treatment experience on probationers’ recidivism rates by employing proportional hazards techniques. Results indicate that how successful white men are in completing courtordered drug treatment programs has no significant effect on their recidivism rates. However, AfricanAmerican and Hispanic men who satisfy the expectations of their drug treatment programs are significantly less likely to be rearrested. Overall, our findings support the contention that drug treatment reduces further criminal behavior among men on probation for felony property offenses. Thus, we recommend that court service personnel strive to provide drug treatment programs for property offenders with a history of drug abuse and that supervisors closely monitor probationers’ activities while in treatment to assure lower rates of recidivism. Dynamism in Adversity: a Comparative Study of Trends in the Performance of Listed Family- and Non-Family-Controlled Companies in Hong Kong, 1997–2014

This paper addresses the long debate over the superiority of the performance of family- vs non-family-controlled companies from the contesting perspectives of entrepreneurial familism and managerial capitalism. Publicly listed family- and non-family-controlled companies in Hong Kong have been selected for a comparison of their overall performance. The focus is on Hang Seng Index constituent companies in general, and on two cases in particular: one non-family-controlled bank (HSBC), and one family-controlled bank (BEA). We found that family-controlled companies were not necessarily less competitive than non-family-controlled companies. Specifically, when HSBC and BEA were compared, the latter showed no clear inferiority in operating profit margin and return on assets, even though the former enjoys unparalleled advantages, such as an overwhelming superiority in size, the privilege of issuing notes, and status as Hong Kong’s quasi-central bank. Therefore, we argue that entrepreneurial familism seems to be a resilient source of business dynamism, particularly when family-controlled companies have been repeatedly tested by adverse socioeconomic crises. Based on the finding, it is suggested that governments across the world should provide a favorable institutional set-up to facilitate the development of family businesses.

<正> 第七届联合国预防犯罪和罪犯待遇大会亚洲和太平洋区域筹备会议,于一九八三年七月四日至八日在泰国曼谷的联合国亚洲及太平洋经济社会委员会总部举行。出席这次会议的主要有亚洲、大洋洲国家的代表,还有几个欧洲国家的代表,此外还有一些国际组织的代表和专家。这次会议有五个议题,其中"从发展角度来看犯罪行为和预防犯罪的新领域:未来的挑战"。这个问题是中心议题。代表们就这一中心议题进行了热烈的讨论,对犯罪的原因,犯罪的领域和趋势、预防和控制犯罪的措施发表了各种看法。现根据大会讨论准则和代表们的发言,对这一中心议题的看法综合叙述如下。     

辅导员角色定位新思考

我国高校辅导员角色定位在历史上一直存在两种倾向:即"只重一头"的偏差定位和"包打天下"的全部包揽定位,给辅导员目前的工作和其自身发展都造成了很大困扰。辅导员应定位于学生思想政治教育教师的角色,根据这个定位来考虑辅导员队伍的建设,才能使高校思想政治教育收到实效。     

The Modern Meaning of Ancient Heroes：On the Emotion and Teaching in William Butler Yeats‘ On Baile’s Strand

Yeats’On Baile’s Strand is an important work in the Irish Literary Revival. On Baile’s Strand is a thought-provoking ethical tragedy, and also a play that reflects the ideology of cultural nationalism of Yeats. In this play there is staged development from natural emotion, free emotion to ethical emotion and moral emotion. Cuchulain is motivated by his natural emotion and free emotion in most cases. He fails to take the ethical responsibility as a husband, father and little king, which aroused the jealousy, revenge and incrimination from Aoife and Conchubar. After killing his own son who he has never seen, Cuchulain regains his ration. His ethical emotion and moral emotion makes it impossible for him to withstand his guilt, even though he fights bravely in hundreds of wars and has killed numerous people. Finally, he goes to madness, and throws himself into the sea to fight against the waves. With Cuchulain’s tragedy of filicide and madness in On Baile’s Strand, Yeats warns Irish people of improving their morality and education, so as to promote the Irish national independence and national liberation.     

公务员满意度影响因素特性分析

从理论上系统地分析和解释公务员满意度问题,有助于改善政府公共管理实践,并促进我国公务员管理制度的发展完善.通过国外公共部门雇员薪酬满意度和工作满意度影响因素的有关研究,公务员薪酬满意度影响因素并不局限于货币薪酬,而是涵盖了薪酬制度与管理等非经济性薪酬因素范畴.同时,公务员工作满意度影响因素表现出鲜明的行政层级差异性.最后,公共部门与私营部门比较分析表明,公务员满意度影响因素与私营部门员工具有显著差异.应以这种差异性与特殊性作为公务员报酬机制设计的理论基础,以私营部门作为参照系,以提高公务员满意度为目标,兼顾外在报酬因素和内在报酬因素,区分不同行政层级设计公务员报酬激励机制.     

治理理论视角下的行政服务中心管理体制改革——以辽宁省行政服务中心建设为例

行政服务中心是我国在政府治理模式上的创新,在推进政务公开和政务服务中发挥了重要作用。但是,行政服务中心作为一个新生事物,在管理体制上还存在许多问题,需要进一步建设和完善。本文结合在辽宁省行政服务中心进行调研的情况,对我国行政服务中心未来发展的职能定位、机构名称、性质、行政归属及编制等方面发展趋势进行探讨。     

论民事诉讼鉴定机构遴选机制的完善

民事诉讼鉴定机构的遴选机制,包括当事人协议确定、人民法院指定以及法院＂摇号＂确定鉴定机构三种。程序本身天然具有有限的目的和价值选择,无论是在诉讼实务还是诉讼价值上,上述三种遴选程序其立法所预期的结果都被复杂的现实所淹没。整合各遴选机制使其在诉讼中发挥作用,是解决当前民事诉讼中鉴定遴选问题最便捷的方法。
