社会主义市场经济与法制建设

1993年1月4日,本刊编辑部在北京大学勺园召集北大法律学系、中国人民大学法学院的一些教授、副教授和讲师,就"社会主义市场经济与法制建设"问题进行了专题讨论.现将会上的有关发言刊载如下,希望能引起读者对这一问题的关注.各界人士对此有何见解,请赐稿本刊,进行讨论.     

大国战争之后:权力生产方式的历史演变

文章遵循历史脉络,从国际政治经济学的视角定义权力及其生产方式,将战争理解为权力博弈的一种手段,并考察随着权力及其生产方式的变化,大国获取权力和财富的渠道更为多元,战争的“投入—产出”比下降。文章认为,当政治权力意味着引领构建传统和非传统安全共同体,经济权力意味着领导全球经济治理和解决发展问题,多边制度体系及其信誉与融资成为新的权力生产方式,战争就不再作为大国博弈的必要选项,多边制度框架下的博弈成为大国战争之外的新主题。遵循制度逻辑、维护制度信誉是大国获得发展融资和治理融资,进而保持权力可持续生产的理性更优选项。     

Reluctant policy innovation through profit concession and informality tolerance: A strategic relational view of policy entrepreneurship in China's urban redevelopment

This paper engages with the theoretical perspective of policy entrepreneurship to examine the pattern and process of policy change in the context of China's urban redevelopment. Drawing upon a strategic-relational reinterpretation of policy entrepreneurship, this paper identifies a distinctive form of reluctant policy innovation in the “three old renewals” scheme initiated in Guangzhou where profit concession and informality tolerance were practiced to create a small window of opportunity for the project of urban redevelopment to break ground. The motivation of policy entrepreneurship in the successful urban renewal projects in Guangzhou was heavily contingent upon the geographically important location of the project site and the historically incidence of hosting the 2010 Asian Games, which forced municipal government to become entrepreneurial and innovative in decision making and income redistribution in order to get things done as quickly as possible. The distinct fashion of policy innovation identified in the case of Guangzhou points to the polymorphous and dynamic nature of policy entrepreneurship and advocates a relational treatment of the strategies and motives of policy entrepreneurs embedded in concrete geographical and historical context.     

Senior Executives' Political Connections and Corporate Environmental Behavior—Empirical Research From the Chinese A‐Share Market

This thesis analyzed the cross‐section data of 630 non‐financial listed enterprises and adopts a logit model to estimate the relationships between political relations and corporate environmental behavior. The paper also adopts an ordered logit method to estimate the marginal impact of political connections to enterprises’ disclosure of information on environment and sustainable development. Through analysis, this thesis found that political connections lower the probability for enterprises to disclose information on environment and sustainable development. With the Level III scoring method, this article classified the performances of disclosing corporate environmental information into three levels. It is found that corporate political connections increase the probability for enterprises not to disclose any environmental information and lower the probability for enterprises to refer to GRI Sustainability Reporting Guidelines.     

论行政机关协助执行行为的可诉性

行政机关协助执行行为认定为"司法协助行为+行政行为",可以在确保司法权威与提高执行效率的同时促进法治政府的建设,为当事人合法权益救济提供可能。《关于适用〈中华人民共和国行政诉讼法〉的解释》第一条第二款第七项但书前的规定,因为受司法权作用,是不具有可诉性的司法协助义务;但书后的规定,因为有行政机关独立自主的意思表示,是具有可诉性的行政行为。其中,但书中"扩大执行范围"包括执行范围内容、种类、期限的扩大,"采取违法方式"包括滥用职权、超越职权以及程序违法。"缩小执行范围""不作为""擅自撤销或变更"等协助执行违法行为需要通过类推适用的方式对条款的法律漏洞予以填补。     

检察办案风险点重点监控与处理机制的探讨

随着司法体制改革的深入推进,“谁办案谁负责、谁决定谁负责”的司法责任制落实完善,检察机关如何立足主责主业,有效防范检察办案风险,规范检察权的运行,化解社会矛盾,切实提高司法公信力,满足人民群众对民主、法治、公平、正义、安全、环境等方面的新需求,提供更优质的法治产品、检察产品成为新课题。文章从检察办案风险存在的客观性以及进行风险控制的必要性出发,对检察办案风险控制现状进行分析,从而进一步明确检察办案风险点并进行重点监控,并就在案管部门的协调监督下如何建立长效的检察办案风险处理机制提出意见建议。     

金融危机下大学生就业观的转变及其引导

大学生就业工作是一个系统工程,从外部来看,它需要社会、学校以及个人形成的合力;从内部来看,它需要就业指导部门对学生的职业生涯教育、心理发展部门对学生的求职心理教育以及思想政治教育工作部门对学生就业价值观的引导,借鉴成就需要理论融入思想政治教育,倡导通过切实有效的思想政治教育工作,加强对学生挫折意识的培养,帮助学生在今天这样的一个竞争性、挑战性、多变性程度都很高的社会里,提高应对能力和生存能力,推动金融危机形势下大学生就业工作的健康发展。     

Ethnic Cultural Features in Organized Activities: Relations to Latino Adolescents’ Activity Experiences and Parental Involvement

Cultural responsiveness is a key aspect of the quality of organized activities, yet has rarely been examined. Based on developmental theories and a theoretical framework for culturally responsive activities, the current study investigated the prevalence and correlates of two ethnic cultural features (i.e., ethnic cultural content & ethnic cultural respect) in organized activities. Using data from 154 Latino adolescents (M_age?=?12.36, SD?=?.53; 59% Female) and parents, we examined associations between adolescent perceptions of both ethnic cultural features and their activity experiences; and associations between parent perceptions of both ethnic cultural features and parental involvement in the activity. Latino adolescents and parents in general perceived lower than average ethnic cultural content and moderate to high ethnic cultural respect in the reported activity. Both adolescents and parents were more likely to perceive ethnic cultural content and respect in activities where Latino youth were the numerical ethnic majority than in activities where Latino youth were the numerical ethnic minority. Latino adolescents’ perceptions of ethnic cultural respect were associated with more positive activity experiences, whereas their perceptions of ethnic cultural content were associated with more negative feelings. Latino parents’ perceptions of ethnic cultural content predicted higher involvement. To design culturally responsive activities, ethnic cultural features should be incorporated in a thoughtful, meaningful way that reflects both adolescents’ and parents’ perspectives.     

从未成年人法律体系看日本的儿童权利保护

考察一个国家的未成年人法律体系可以推定这个国家保护儿童的力度。本文从涵盖了未成年人自出生到成年相关的各个领域与阶段的日本法律出发,探讨了日本的少年犯罪(非行)率低下的原因。在我国构建未成年人法律体系时,日本的这种基于儿童的权利保护理念形成的一整套系统的未成年人法律体系,应该可以给予我们一些启示。     

西风东渐与民初福州城市的近代化

福州地处闽江下游 ,扼闽江入海口。鸦片战争后 ,被辟为“五口通商”口岸之一。清末 ,随着以茶叶为主的对外贸易兴盛 ,福州成为东南商贾云集的重要商埠。福州及其附近地区出现了以马尾福建船政局为代表的近代工业 ,以对外茶叶贸易为主的新型公司 ,以培养西学人才为目标的新式学校。另一方面 ,西方思想文化、风俗观念也通过各种渠道渗入福州传统社会。作为中外文化的交汇点和中国对外交流的窗口之一 ,福州在与西方文化发生激烈碰撞和冲突的同时 ,自身也发生了深刻的变革。福州的建筑风格、公用事业 ,乃至市民大众生活方式、价值观念和风俗习性…
