Trade mark invalidated on ground of copyright infringement

The Registrar of Trade Marks ordered invalidation of a registeredtrade mark that was a copy of the whole of the applicant's mark‘MAX BRENNER & Device’, where use of the disputedmark was liable to be prevented by the applicant's earlier copyrightunder the provisions of the Copyright Ordinance.     

Detecting Domestic Violence: Spanish External Validation of the Index of Spouse Abuse

The aims of the study were to assess the psychometric properties of the Spanish version of the Index of Spouse Abuse (ISA), and to validate it against external criteria of intimate partner violence. The Spanish version of the ISA was administered to 223 non-abused women and 182 victims of intimate partner violence. Internal consistency coefficients oscillated between 0.88 and 0.98. The Confirmatory Factor Analysis failed to replicate the original two-factor structure. Using Exploratory Factor Analysis, a two-factor solution was found: physical (ISA-P) and non-physical (ISA-NP), but the items included in each factor were slightly different from the original two subscales. Receiver operating characteristic curve analysis revealed an AUC value for the ISA global score of 0.99 (95% CI: 0.98–0.99), with the optimal cut-off of 12 for detecting intimate partner violence. The Spanish version of the ISA is a valid instrument for detecting intimate partner violence in a female population.     

Patenting and spin-off creation by Canadian researchers in engineering and life sciences

This paper examines the determinants of patenting and spin-off creation using survey data of 479 researchers in engineering and 449 researchers in life sciences funded by the Natural Sciences and Engineering Research Council of Canada (NSERC). The results show that research novelty and laboratory size are the only two variables significantly explaining patenting and spin-off formation in both engineering and life sciences. Network capital explains spin-off formation in engineering and in life sciences as well as patenting in life sciences, but not in engineering. Furthermore, the results suggest that many categories of resources explain patenting and spin-off formation in engineering and in life sciences, but that the combinations of resources required differ for patenting and spin-off formation and between engineering and life sciences. The results of this paper suggest that customized policies would be required to accommodate differences between spin-off formation and patenting as well as between engineering and life sciences.      

Does Globalisation Threaten the State? Thesis on the Fractal State

There has been much recent debate concerning the role of the state. What should we make of this unease? There are two possibilities: the first involves taking a clear position on the debate by stating that globalisation leads to the downgrading of states in global regulation, to the benefit of the market. This suggests that the era of the state will be followed by the era of the market. While this thesis has many elements of truth, it underestimates the capacity of the state to transform itself, at the risk of opposing the state too systematically to the market. The second takes the opposite point of view by saying that the globalisation leaves the state neither defenceless nor weakened. The tenants of this analysis use the historical plasticity of the state and the falling numbers of states in the world as evidence. At the same time, they hide the size of the crisis of legitimacy of public policies. The problem comes from the fact that these two theses, reputed to be mutually antagonistic, are in fact perfectly complementary. Accordingly, instead of choosing between them, it seems useful to address them simultaneously before moving beyond them to propose the following thesis: globalisation develops at once against and with the state. This inherent contradiction transforms the state into a fractal actor, that is to say a state that no longer poises itself over society, but who at the same time remains the guarantor of a public rationality.
