硅藻在活体脏器内能否长期存积的实验研究

作者们为正确评价内脏器官中硅藻在诊断溺死的实际意义,我们用12头山羊进行实验。该实验历时6年零4个月。结果表明,进入体循环的硅藻不能通过肾小球毛细血管,并随尿液排泄。但可在肝、肾等脏器中存积甚久,约经6年左右而消失。

刑事证明责任分配的利益基础

利益是诉讼各方承担证明责任的最基本动机。不同的诉讼主体在诉讼中的利益取向不同,导致证明责任分配的差异。由于诉讼利益的多样性和冲突,在刑事诉讼中承担证明责任的主要是控诉机关。从诉讼利益层次性的角度来看,控辩双方基于裁判上的利益具有承担证明责任的必要,而法院因为不具有裁判上的利益,因此不能使其承担证明责任。在刑事证明责任的分配中,必须尊重利益的要求。利益的确认也是一个程序的过程。作为证明责任基础的利益必须通过主张和抗辩,由实体法规范和程序法规范确认为案件的争议,才能成为证明的对象,成为法院裁判的范围。

大比例的审前羁押无法满足以人为本的科学发展观和构建和谐社会的基本要求,轻刑案件适宜作为逐步降低羁押率的突破点.执法理念的偏差以及在执法理念指导下的自身工作机制的不健全和不完善,是造成轻刑逮捕率高的最主要原因.检察机关应当通过树立正确的执法理念、完善审查逮捕工作机制和建立相关配套制度,把轻刑逮捕率控制在合理水平.
