保障性住房政策过程的中央与地方政府关系——政策网络理论的分析与应用

为分析保障性住房政策过程中的中央与地方政府关系,找出问题解决的有效框架,采用案例分析方法,分析了保障性住房政策制定过程中中央部门间的讨价还价、政策执行过程中地方政府及其职能部门以及开发商等营利组织间的利益结盟与变通策略、其他参与主体被排斥等现象。在此基础上,引入政策网络理论,分析网络利益主体与网络利益关系。研究发现:保障性住房与民生密切相关,却积累了太多的"历史赊账";中央与地方政府间的非合作博弈是影响保障性住房政策过程以及政策结果的重要因素;非合作博弈问题需置于政策网络结构环境下去思考,政策网络理论能够提供"解释性"和"建构性"框架。论文研究对未来的保障性住房政策过程以及政策结果有重大实践意义。本文将网络利益分析与网络治理结合在一起,实现了政策网络两个理论流派的应用整合,对该领域的理论研究有重要价值。依据研究结论,保障性住房的政策制定与政策执行必须实现从封闭到开放的转变,为未来"十二五计划"做好铺垫。     

A Sequence Analysis of Nonverbal Behaviour and Deception

The ability to correctly interpret nonverbal communication (NVC) is an important ability in everyday interactions, which may use NVC techniques to identify the concealment of information. In the present study, a novel approach was used to understand NVC. Behaviour sequence analysis identified specific sequences of behaviours that indicate psychological distress caused by deception. The study involved the analysis of 55 videos of real criminals and high-power individuals that were filmed fabricating statements, which were later exposed as being untruthful at the time of being filmed. In addition, 53 clips of criminals making truthful statements were also analysed as a contrast group. Results indicated clear differences between honest and deceptive responses, such as furrowing of eyebrows in the deceptive sequences occurring more often than honest statements. In addition, sequences of behaviours were shown in the present data set, which could indicate a new method for analysing NVC and detecting psychological distress caused by deception. The possible implications and applications for police and forensic investigation are also outlined.

Predicting Conduct Problems from Community and Family Violence: The Moderating Effects of Hurricane Katrina

Although the devastation was immediately apparent, the effects of Hurricane Katrina on the behavior of youth are just now being revealed. Much post-disaster research targets adjustment of adults, but ample evidence indicates that youth experience a variety of psychological symptoms following a disaster, including depressive symptoms, aggression, and symptoms of posttraumatic stress. The aim of the current study was to determine whether hurricane exposure serves as a risk factor for developing conduct problems among violence-exposed youth. Results indicate that hurricane exposure had differential effects on the relations between conduct problems and community violence versus corporal punishment in the home. Though not statistically significant, there was an unexpected trend for youth with high hurricane exposure to show decreased conduct problems and those with low hurricane exposure to show increased conduct problems as violence exposure increased. Hurricane exposure played the predicted role in the relation between corporal punishment and conduct problems, such that high levels of hurricane exposure predicted increased conduct problems among youth experiencing high levels of corporal punishment, but not among those experiencing low levels of corporal punishment. Implications for future research and practice are discussed.

论公司在股东派生诉讼中的法律地位

股东派生诉讼,是中小股东对抗侵犯公司合法权益的一项救济措施。我国《公司法》于2005年修订时也引进了该项制度。但是,综观法条,却发现法律对该项制度规定得过于原则和粗化,其中对于公司在股东派生诉讼中应当处于什么法律地位的问题也没有明确,这导致了审判机关在实务中无法可依。本文试图从构建公司在股东派生诉讼中的法律地位需考虑的几个参数对该问题进行分析来认定其法律地位。

本文运用因子分析、聚类分析等统计方法,对我国31个省、直辖市、自治区的经济、环境、人力资源的区域差异进行了分析,并给出了协调发展政策建议.
