Congressional Arts Caucus Legislative Summary 99th Congress

Abstract

The following legislative summary is an unusual choice for the journal to print, but we feel it summarizes a number of disparate and important facts that our readers might value in a single source. Like a previous report of the Institute of Museum Services some issues ago, this summary is more an internal document than an article in the traditional sense. We feel it could use a broader dissemination.

Of particular interest are the changes in legislation for the Arts and Humanities Reauthorization FY 1986–1990 since they reflect policy-related decisions that are perhaps a microcosm of some of the major issues emerging during the twenty-year history of our National Endowments for the Arts and Humanities. These changes also reflect problems that practitioners—in particular, arts managers—will be dealing with on a daily basis and in very specific terms over the next half decade. These include access to the arts and humanities for those people in rural areas and in underrepresented groups, greater restrictions for those who sit in judgment on their peers, either on the National Council or as panelists, and a mandate for stronger reporting procedures both before and after grant awards.

The summary of the 1986 Tax Reform Act Provides a quick review of a Subject that is already emotionally chrged, especially since, in the name of “tax simplification,” confusion seems to have increased in the minds of all but a few seers and interpreters. The public laws section and the list of pending legislation will give the reader a broad view of the kinds of advocacy concerns the arts community can rally around. From the National Anthem to copyright to issue of violence on television, the Congressional Arts Caucus has provided us with an important overview of legislation in the field.     

One perspective on “democracy vs. efficiency”: Testing mutuality via the laboratory approach

Much social commentary has fixated on the theme of “democracy vs. efficiency,” but observers have directed attention at modes of decision-making alternative to the usual bipolar foci. Gaenslen takes the latter tack in suggesting a third mode, and this note at once shares in his intent while seeing problems with his approach. Specifically, this note outlines a fourth mode for decision-making, based on the “laboratory approach to organization development”; it sketches some of its underlying theory and practice; and the narrative details a number of ways in which the demands of economic efficiency and political democracy can be met with substantial mutuality by learning designs consistent with the laboratory approach.     

Prostitute homicides: a descriptive study

It has been estimated that women involved in street prostitution are 60 to 100 times more likely to be murdered than are nonprostitute females. In addition, homicides of prostitutes are notoriously difficult to investigate and, as such, many cases remain unsolved. Despite this large risk factor, little literature exists on homicides of prostitutes, and there is a lack of basic statistics and knowledge regarding this very specific victim group that could possibly help investigators. The aim of the current study is to conduct an exploratory study to explore the key characteristics of this group and how they differ from other subgroups of homicide. Forty-six cases of U.K. prostitute homicides are analyzed and compared to 59 male offender-female victim nonsexual homicide cases and 17 male offender-female victim sexual homicide cases.     

When every relationship is above average

Marriage license applicants and law students were surveyed about their knowledge of divorce statutes, knowledge of the demographics of divorce, and expectations for their own marriage. Both groups had largely incorrect perceptions of the legal terms of the marriage contract as embodied in divorce statutes, but they had relatively accurate, if sometimes optimistic, perceptions of both the likelihood and the effects of divorce in the population at large. These same individuals expressed thoroughly idealistic expectations about both the longevity of their own marriages and the consequences should they personally be divorced. Increasing individuals' knowledge of divorce statutes through a course on family law did not diminish this unrealistic optimism. Both groups largely approved of the existing divorce statutes, although there was substantial agreement about a few important respects in which the laws should be changed. These findings suggest that the sense of unfairness and surprise that frequently attend divorce may be a result of systematic cognitive biases rather than of a lack of information about divorce.     

All Het up! Rescuing Heterosexuality on the <Emphasis Type="Italic">Oprah Winfrey Show</Emphasis>

The Oprah Winfrey Show provides an interesting set of contradictions. On the one hand, it appears to challenge common-sense assumptions about relationships, specifically heterosexual relationships (for example, by consistently raising issues of sexual violence within a heterosexual context). Yet, at the same time, Oprah's presentation often works to reinforce precisely the norms she seeks to challenge. Through a close analysis of a selection of programme clips from one particular programme among many about relationships, sexuality and families, this article will consider the ways in which the Oprah Winfrey Show both problematizes and yet normalizes the boundaries of heterosexuality. Here we shall discuss both the resolute exposure and exploration of what could be termed the casualities of normative (and compulsory) heterosexuality and, paradoxically, its recuperation as a ‘rational’ ideal. In exploring the ways in which this recuperation takes place, we shall begin with a brief consideration of two of the key discourses which shape the show: the discourse of therapy and that of kinship. Our analysis of the sexual politics of the Oprah Winfrey Show in these terms will focus on the programme, ‘How to Make Love Last’ (18 January 1993). Like so many other programmes, ‘How to Make Love Last’ intends to highlight and deal with problems within heterosexual relationships as distressing but solvable (through the medium of therapeutic self-help). At another level, however, the programme also (unwittingly) reveals a different order of problems which, ironically, can only be reinforced by the mode of rescue proposed and staged.     

Voices on Paper: Multimodal Texts and Indigenous Literacy in Brazil

This paper focuses on the recent production of multimodal writing in an indigenous community in Brazil, resulting from the equally recent introduction of literacy. Seeing this form of writing as part of the process of intercultural semiosis and cultural translation, the paper discusses how concepts of local indigenous oral culture and received wisdom interact with the Western concept of writing as the ‘record’ or ‘representation’ of speech, bringing to writing the indigenous notion of cultural ‘enactment’ or ‘performativity’. In an effort to overcome a view of alphabetic writing as semantically only propositional, mimetic and decontextualized, the Kashinawa´ community, by adding visual components to alphabetic texts, appear to transform writing into contextualized performative ‘poiesis’, which simul taneously inaugurates a complex process of semiosis inseparable and only comprehensible from their local cultural perspective.
