物权变动过程的重构

本文从法律体系的逻辑严密性和现实的价值判断的双重目标出发,重新构造了物权变动的模式。认为物权变动过程是一个有机的过程,除承认区分原则外,还要承认物权合意的客观存在,物权合意以债权行为为基础,切充斥于整个物权变动过程。又从微观的角度以无权处分、所有权保留、不当得利为视角,分析了新型物权变动模式的价值判断。     

CRIME IN EMERGING ADULTHOOD*

The extent to which local life circumstances influence criminal activity has been the focus of much theoretical debate. Although empirical research has been initiated, it remains limited. Herein, we use data on 524 serious offenders from the California Youth Authority for a seven‐year post‐parole period to examine the relationship between changes in local life circumstances and criminal activity. We extend previous research by employing a statistical model that accounts for the joint distribution of violent and nonviolent crime during the late teens and twenties in order to present information on patterns of criminal activity during a newly recognized developmental period of the life course, “emerging adulthood.”     

Parents' Reactions to Child Day Care Organizations: The Influence of Perceptions of Procedures and the Role of Organizations' Trustworthiness

On the basis of the uncertainty management model, we argue here that when people are uncertain about an organization's trustworthiness, they may resolve the question how they should react toward the organization by relying on their perceptions of the organization's procedures. As a consequence, we predicted that the reactions of parents whose child was in a day care center would be strongly influenced by their perceptions of the procedures used by the organization that was responsible for their children's day care when the parents would be uncertain about the organization's trustworthiness. However, when parents would be certain that the organization could be trusted they would be less in need of procedural information, yielding less strong effects of perceived procedure on parents' reactions. The findings of a survey study corroborate this line of reasoning. In the discussion it is argued that these findings suggest that people especially rely on their perceptions of procedures when they are uncertain about important aspects of their lives, such as the trustworthiness of organizations that are responsible for their children's day care.     

Enzyme activity of PGM1 in erythrocytes

The enzyme activity of phosphoglucomutase (PGM) has been investigated in red cell haemolysates from 142 individuals and compared to the sub-type as determined by isoelectric focusing. The 10 phenotypes showed significant differences in PGM-activity which indicates that there is a correlation between the level of activity and the isolelectric point of homozygotes. No indication of silent alleles or alleles with reduced activity was found in this collective.     

Explanation of nonspecific serologic reactions in decomposed bone tissue

Bone fragments were stored in water for 2 years at room temperature and investigated serologically using the following methods: Absorption-elution, extraction of blood group substances and immunohistochemistry (PAP). All 3 methods gave essentially specific results for fresh bone tissue but with putrid bone tissue unspecific reactions were found predominantly with the absorption-elution and PAP techniques. In contrast, more specific reactions were obtained from the extracts although they were much weaker. From this it can be concluded that pure physical binding plays a substantial role in the unspecific reaction between antibodies and bone material. It is suggested that the relevant physical properties are altered by putrification.     

Gender comparisons in the relationship between parental and sibling violence and nonfamily violence

This paper addresses two neglected areas in the research on the relationship between family violence and violence outside the home: violence other than parent-child abuse and the effect of gender. Specifically, we consider both parental and sibling violence as independent variables, nonfamily violence as the dependent variable, and gender as the specification variable. The data were collected from a sample of 306 students in Introductory Sociology and Social Problems classes. The finding of particular importance is that the interaction between the gender of both the aggressor and the victim has a significant effect on the relationship between violence within the home and nonfamily violence.
