论著作权的法律特征

著作权是基于文学、艺术和科学作品依法所产生的权利，它所反映和调整的社会关系是平等主体之间的财产关系和人身关系，与同属于民事权利的物权、债权相比，具有无形性、专有性、地域性、时间性等特征。完善著作权法律制度对于促进优秀作品的创作和传播、繁荣祖国的科学文化事业、建设社会主义精神文明都具有十分重大的意义。     

平等权宪法规范内涵

我国宪法规定中华人民共和国公民在法律面前一律平等,同时时民族平等、男女平等、选举和被选举的平等、受教育平等以及劳动就业平等进行了规定,从而构成了较完整的平等权规范体系.在该规范体系中,平等既是宪法的基本价值之一, 又是法律适用的原则, 同时还是一项具有具体内容的宪法权利.它强调平等不仅是形式平等与实质平等的统一,还是法律适用平等与立法平等的结合.     

China-U.S. Relations： A Sober-Minded Assessment With High Expectations

Whenever a new U.S. President swears in, China-U.S. relations will go through a period of mutual adaptation. But this time, after Barack Obama came into the White House there was a good beginning in China-U.S. relations which have remained rather stable over the short span of the change of administration. We have good reason for high hopes that the two countries will join hands in moving toward a viable, all-round partnership in the 21st Century. However, from a historical perspective and in view of the actual distinctions between the two countries, we should remain sober-minded.

In April this year, US President Barack Obama delivered a speech in the Czech capital, Prague, stating America＇s commitment to build a world without nuclear weapons. He said that as a nuclear power and the only country that had used nuclear weapons in actual combat, the United States should bear ＂moral responsibility＂. He alsopledged that the United States would take concrete steps towards a world without nuclear weapons, including negotiating a new nuclear weapon reduction treaty with Russia by the end of this year,

The weight of history: child protection and parenting with a disability in 20th Century Iceland

ABSTRACT

This contribution focuses on four periods in Iceland, from the early twentieth century until the time of writing, in order to document and analyse the struggles of people with intellectual disabilities to marry, have a family and maintain custody of their children. Each period is linked to specific pieces of legislation that governed the bodies and lives of disabled people and reflected larger social norms concerning issues of family life and parenthood. An emphasis is placed upon the perspective of contemporary critical disability studies in analysing the historical development of this struggle, and the voices of those who experienced this struggle first-hand, drawn from a number of research projects conducted in Iceland. Our main contention is that the weight of history still comes to bear upon matters of parenting and family life, even in the most recent shift toward a human rights approach to disability. There remains a strong socio-cultural resistance toward parenting with an intellectual disability, rooted in the ideology of early twentieth-century eugenics. Our goal is to document the development of these phases throughout the twentieth century in Iceland in order to illustrate how older ideas and prejudices still inform contemporary child protection practices concerning parents with disabilities.

面向城市公共安全的视频监控实效评估与改进策略——基于南京市公共空间的实证分析

在公共安全成为表征当今城市生活品质重要指标的背景下,视频监控无疑是保障城市公共安全的一项关键而普遍的技术手段。以南京市公共空间为实证案例,考察三类典型样本(高校、商业区、居住区)中监控摄像头的空间布点,通过评估城市公共空间的视频监控实效,管窥城市公共安全的保障状况,包括采集和甄别视频监控的基本数据、通过三维建模图解和测算视频监控范围、反向确定现状视频监控的盲区,并面向城市公共安全,从公共空间的视频监控和规划设计两个方向提供监控实效的改进策略。
