增强政治责任创新老干部工作

进入新世纪以来,面对新形势下老干部工作面临的新情况、新问题,我们本溪市委、市政府着力把做好老干部工作作为一项政治责任来履行,及时有效地解决了一些老干部关心的热点、难点问题,得到了老干部的充分肯定和高度评价。但在实际工作中,一些不容忽视的问题也客观存在,一些单位和部门对党的老干部工作还缺乏足够的认识。要做好新时期新阶段的老干部工作,我认为还必须深化三个方面的认识。第一,做好老干部工作,是贯彻党的干部路线的重要组成部分。无论在革命战争年代,还是在社会主义建设时期,老干部都为新中国的建立和祖国的建设发展创造了不…     

洗钱罪及其防范

近年来,国内外犯罪分子在我国领域内的洗钱活动越来越猖獗,犯罪形式越来越多样化,犯罪后果也越来越严重。由于洗钱犯罪通常具有跨国性、隐蔽性等特点,往往涉及多个国家的不同司法体系,存在司法管辖上的“涉外因素”和“灰色区域”,致使司法机关的调查取证工作更加艰难;又由于该罪立法上存在缺陷、防控机关间缺乏协调、国际间协作有待加强等因素,造成了对洗钱犯罪打击不力。因此,必须根据当前新形势的发展完善洗钱立法,密切国内外防控机关间的合作,以加强洗钱罪的预防和控制。     

检察机关实质性化解行政争议研究

检察机关实质性化解行政争议,是指检察机关办理行政诉讼监督案件,在坚守法治底线的前提下,以当事人各方认可的方式,实现法律程序终结或者将行政争议导入新的处理程序,达到自然消解案涉行政争议,实现案结事了政和的履职目标。检察机关在调查核实、公开听证、智慧借助、案例检索精细化审查案件的基础上,综合运用监督纠正、以抗促和、促成和解、服判息诉实现行政争议的实质性化解。同时,检察机关要积极履职主动担当,在化解超过起诉期限、遗落之诉、民行交叉等案件行政争议中发挥监督能动性,促进案结事了政和。     

历史感的嬗变——从黑格尔的“自意识”到马克思的“克服意识”

历史感,是理解黑格尔和马克思二者历史观差异的重要环节。此般差异性具体体现在“自意识”与“克服意识”的隐性关系层面。黑格尔从“自意识”的视野出发,释放出其历史感所蕴含的理性规定,并且通过对自意识的形式规定,最终使其历史感进入思辨哲学的境地。马克思批判吸收了黑格尔的历史感所呈现的理性阐释和总体论证,并在深入历史现实的基础上,既详细分析了“自意识”的抽象普遍性所带来的历史局限,又通过对“克服意识”具体内涵的分析,深刻批判了黑格尔对绝对理念的思辨关切,并为自身的历史感找到其现实主体,最终呈现出历史感演变的现实路径,即从自意识到克服意识,从理性追问到现实考察的飞跃,并在历史感嬗变的历史过程中,守护了唯物史观的现实地基。
