The Economic Constitution of the European Community: From 'Rome' to 'Maastricht'

Abstract: The present paper analyses, from an economic point of view, the changes in the economic constitution of the European Community since its foundation in 1958. In order to identify the various changes, we start by developing an economic frame of reference. Our proposition is that the constitution of the European Community (EC) came closest to this frame of reference: an economic constitution for a market system. In the subsequent parts, we try to show that the process of European integration was largely based on the introduction of non-market elements. Our final argument will be that as far as the economic constitution is concerned, the Treaty on European Union (TEU) is dominated by traits which are Characteristic of modern welfare states.     

Problems of assessing sibship probabilities by means of genetic analysis

Nowadays, kinship studies based only on STR analysis are a very common practice. Apart from regular paternity cases, there is a rising number of cases in which the type of sibship between two persons has to be determined. Very often the parents or further relatives are unavailable for testing, so that the probability e. g. for a half-sibship has to be calculated as a deficiency situation. 50 unrelated persons (Group 1), 50 full siblings (Group 2), and 50 half-siblings (Group 3) were genotyped using the 15 STRs comprised by the AmpFlSTR Identifiler multiplex PCR-kit to investigate the reliability of common statistics programs and the indicative value of the calculated probabilities. Using a commercially available statistics program, we calculated probabilities for the following hypotheses: 1. The persons investigated are full siblings; 2. the persons investigated are half-siblings; 3. the persons investigated are unrelated. After STR analysis, half-sibling probabilities between 0.03 %-97.56% for group 1, between 0.01%-78.46% for group 2, and between 24.28%-90.18% for group 3 were calculated. In addition, the authors present two complicated deficiency cases which could be resolved only by extensive DNA typing using X- and Y-chromosomal loci, respectively, as well as the investigation of further relatives. The results of this study suggest that typing of autosomal STRs alone is no sufficient tool for resolving cases of possible half-sibship, even if probabilities of more than 90.0% are obtained. Due to the results of our study we suggest the implementation of mandatory standards for the investigation and interpretation of complicated kinship cases.     

Evaluation of a novel tagging and tissue preservation system for potential use in forensic sample collection

The authors describe a new, easy-to-use barcode-based tissue collection, preservation and body tracking system, which might prove instrumental in the containment of mass fatalities such as aircraft accidents, war related accidents, environmental disasters (e.g. earthquakes, hurricanes, and floods) terrorist bombings or mass murders.     

Pathogenesis of conjunctival petechiae

Conjunctival petechiae from 15 cases (cause of death: different natural and unnatural) were analysed using confocal laser scanning microscopy (CLSM) in order to visualize the kind of the damage within the vessel wall (diapedesis versus rhexis). The pathomorphological findings with multiple ruptures of vessels appearing to be filled to bursting point define the conjunctival petechiae as a rhexis-haemorrhage.

Walking the walk vs. talking the talk： A comparative analysis of the ASA and ASPA ethics initiatives

The American Sociological Association and the American Society for Public Administration are widely recognized as being among the premier professional associations in their respective fields within academia and beyond. Although a commitment to the promotion of ethical competence among their members is clearly viewed by both organizations as being central to the accomplishment of their missions, their techniques for doing so have included both similar and unique initiatives. It is the purpose of this paper to provide a comprehensive, comparative inventory of their ethics-related programs with a view toward determining if the establishment of what would appear to be a mutually beneficial, collaborative relationship between the ASA and ASPA in the ethics arena should be pursued.     

Jury on stage: a common law play

Legal processes have a theatrical component to them. They offer an audience (the spectators) and actors (the legal parties, lawyers, as well as the jury and judge) who perform a play on the stage of the courtroom. In this paper we focus on the role of the jury, which appears to be simultaneously audience and actor. As audience, it assures that the power of the judge is limited. As actor, the jury is able to play its role in such a way as to incorporate social attitudes into the verdict. Exploring this theatrical component may shed new light on the debate whether juries are a “good” way of finding legal settlements. Further, it could indicate how legal processes are perceived by the public. As our line of argument builds on Adam Smith’s moral and legal philosophy, the analysis may also contribute to the understanding of one of the building blocks of Smith’s philosophy, namely the impartial spectator.
