Thesen zur Reform des Föderalismus der Bundesrepublik Deutschland

Der vorliegende Beitrag skizziert die besonderen Strukturen des deutschen F?deralismus, hebt seine Leistungen hervor, benennt seine Schw?chen, er?rtert seinen Reformbedarf und diskutiert die Chancen seiner Reform. Es wird gezeigt, dass eine Strukturreform des F?deralismus in Deutschland aufgrund von politisch-institutionellen Bedingungen besonders schwierig ist. Deshalb kann nur ein Teil des Reformbedarfs mit Aussicht auf Erfolg zum politischen Thema gemacht und in Reformvorhaben umgesetzt werden. Das bel?sst erhebliche Lücken zwischen Reformbedarf und Reformf?higkeit. Allerdings sind die Reformgrenzen mit den Leistungen des deutschen F?deralismus zu verrechnen. Diese Leistungen sind beachtlich, wie der internationale Vergleich und das Erreichen f?deralismusspezifischer Ziele, insbesondere Machtaufteilung und Integration, aber auch Einbindung der Opposition zeigen. überhaupt nicht gerüstet ist der F?deralismus (und mit ihm die Politik insgesamt) dafür, ein hochwahrscheinliches — aber derzeit kaum beachtetes — Folgeproblem des „sozialen Bundesstaates“ der Bundesrepublik zu bew?ltigen: Die Finanzierungslasten ihres leistungsstarken Sozialstaats erzeugen bedrohliche Engp?sse in der Finanzierung ?ffentlicher Ausgaben jenseits der Sozialpolitik.     

Diversion bei fahrlässiger Körperverletzung

"Schweres Verschulden" iSd § 88 Abs 2 StGB begründet in aller Regel nicht das Diversionshindernis der "schweren Schuld". Der zuletzt genannte hohe Schuldgrad wird bei fahrl?ssigen K?rperverletzungen nach § 88 Abs 1 StGB nur in besonderen Ausnahmef?llen erreicht. Dies wird dann anzunehmen sein, wenn ein au?ergew?hnlich gravierender Sorgfaltsversto? vorliegt, der einen Schadenseintritt mehr als wahrscheinlich erscheinen l?sst, wobei die Tat mit einem erheblichen sozialen St?rwert einhergehen muss.

Nachteilen, die dem Angeklagten durch einen "offenkundigen Mangel" der Verteidigung (also durch falsches oder fehlerhaftes Verhalten des Verteidigers, das eine konkrete und wirksame Verteidigung, wie sie mit Blick auf Art 6 Abs 3 lit c MRK erforderlich w?re, nicht mehr gew?hrleistet) entstehen, kann von der Generalprokuratur im Rahmen einer Nichtigkeitsbeschwerde zur Wahrung des Gesetzes begegnet werden.     

Trade and investment: Introduction to the special issue

This special issue focuses on a variety of political-economy questions on trade and investment and is guided by a shared understanding that trade and investment processes can no longer be studied in isolation from each other. Three articles provide new insights into the study of the design of preferential trade agreements and effects thereof, two of which focus on the politically salient issues of non-trade concerns. A third one investigates which export sectors win from improved market access opportunities, in order words, how gains from trade are distributed. Two articles study the World Trade Organization’s dispute settlement system. One contribution is unpacking the role of the most important and influential firms and investors in affecting US behavior in WTO disputes, a second contribution studies how leadership changes in democracies and autocracies have different effects on dispute behavior. Finally, the special issue includes a new study on how the shadow economies in developing states are affected by the integration into the world economy (trade and investment) and by policy programs of the International Monetary Fund.     

Zum politischen Leistungsprofil der Schweiz: Thesen zur Erklärung einer Erfolgsgeschichte aus dem Blickwinkel des internationalen Vergleichs

Im OECD‐Länder‐Vergleich erreicht die Schweiz bei zentralen Indikatoren des politischen Leistungsprofils Spitzenwerte, beispielsweise bei der Arbeitslosenquote, der Inflationsrate und dem Schuldendienst für die Staatsschulden. Wie diese Erfolgsgeschichte zu erklären ist, wird in diesem Essay anhand der Jahre von 1990 bis 2012 erörtert, und zwar unter Heranziehung von Hypothesen und Daten zu schweizspezifischen Erklärungen und von Erklärungsansätzen, die die Schweiz mit anderen wohlhabenden Demokratien vergleichen. Als Schlüsselgrößen erweisen sich – neben institutionellen, prozessualen und akteursbezogenen Eigenheiten der Schweiz – insbesondere die Variablen politikfeldspezifischer Erklärungen (wie Zentralbankautonomie, Verteilungskonflikt und fiskalpolitische Fragmentierung) sowie sozialpartnerschaftliche Arbeitsbeziehungen und Parteieneffekte.     

Immunocytochemical examination of biological traces on knife blades

In cases of penetrating stab wounds by different knives it is highly relevant to prove which knife caused which injury, especially if one of the injuries was lethal. This is possible by immunocytochemical examination of cellular material remaining on the injuring blade because some organs have organ-specific antigen determinants such as alpha-l-fetoprotein in the liver cells or cardiac troponin I in the heart muscle cells, to which antibodies can bind. Even when penetrations occur through several layers of clothing, enough cells from the injured organ remain on the blade of a knife to allow immunohistochemical examination. These cells can be collected by means of adhesive film or wiping the blade and can be stained immunocytochemically. The organ specificity of the examined proteins allows proof of their origin. The present study shows that immunocytochemical alpha-l-fetoprotein and cardiac troponin I staining of the cells remaining on a knife blade enables proof of whether the knife blade injured the heart or the liver, or both.     

Immunohistochemical proof of amelogenin in teeth--a contribution to the evaluation of the age in the identification of unknown corpses

When a corpse is found that cannot be identified, one of the forensic tasks is to determine how old the person was when she or he died. To solve this frequently asked question in forensic practice, the enamel protein amelogenin was marked immunohistochemically in 249 extracted teeth. Amelogenin is already produced during prenatal development and is gradually used up throughout life into old age. Hence, the demonstrability decreases with age. The extent of the labelling can be quantified by measuring the mean optical density (MOD). While it is not possible to determine the age on the basis of the mean optical density measurements alone, logistic regression of the MOD together with dichotomisation of the teeth according to age allows statements as to whether the person was younger or older than 30 years.     

Adult-onset antisocial behavior trajectories: associations with adolescent family processes and emerging adulthood functioning

Guided by conceptual and empirical work on emerging adulthood, this study investigated the role of closeness to mother and father and behavioral autonomy during adolescence on the development of adult-onset antisocial behavior. Using data from the National Longitudinal Study of Adolescent Health (Add Health), we identified four aggressive (abstainer, adolescent-limited, adult-onset, chronic) and three nonaggressive (adolescent-limited, adult-onset, chronic) trajectories. Members of the aggressive adult-onset trajectory reported higher levels of paternal closeness during adolescence compared to the members of the aggressive chronic trajectory. Maternal closeness and behavioral autonomy did not differentially predict trajectory membership. In addition, members of the adult-onset trajectories were less likely to be employed or in a romantic relationship and reported decreased physical health during emerging adulthood compared to members of all other trajectories.
