Die systematische Verankerung des Artenschutzrechts im Ordnungsrecht

Zusammenfassung  Die europarechtlichen Normen des sog. individuenbezogenen Artenschutzes (insbesondere Art. 5 lit. a Vogelschutz- und Art. 12 Abs. 1 lit. a FFH-Richtlinie) sowie die innerstaatlichen Umsetzungsnormen in § 42 Abs. 1 BNatSchG sind entgegen einer weit verbreiteten Tendenz als Verbote bestimmter gezielt auf individuelle Exemplare der geschützten Arten gerichtete Zugriffshandlungen ernst zu nehmen. Der Beitrag zeigt auf, wie auf dieser Basis der ausufernden Anwendung der genannten Normen vorgebaut werden kann. Die abgestufte Handlungsverantwortlichkeit von Verkehrsteilnehmern, Beh?rden zur ordnungsbeh?rdlichen Regelung des Verkehrsgeschehens sowie zur Zulassung von Verkehrsanlagen und -wegen wird verdeutlicht, zugleich ein praktikabler Weg zum ma?vollen und differenzierten Umgang mit dem besonderen Artenschutzrecht aufgezeigt.     

The natural history of extended co-offending

Most criminal acts are committed in very small groups or alone, and are repeated sporadically. But that is not always the case. Co-offending can include larger groups, cooperating sequentially or simultaneously, knowing each other or at least knowing about one another. We may use the term “extended co-offending” to subsume varieties of crime organization, crime networks, gangs, and criminal clusters. Extended co-offending also includes vaguely organized crime repetitions, and is a matter of degree. Criminal cooperation can be extended in time, space, numbers of persons involved, and types of criminal action. The extension process has a very wide span of possibilities. Drawing ideas from Max Weber and others, this paper suggests that the natural history of criminal cooperation progresses in four stages, with steeply decreasing prevalence: (1) primordial clusters of offenders, (2) small-scale charismatic leadership of offenders, (3) a medium-scale patrimonial system of offenders, and (4) and an extended patrimonial system of criminal cooperation. Primordial co-offending occurs on a very local level, with little or no hierarchy or systematic repetition. Extended criminal cooperation usually requires personal trust among offenders, favoring patrimony over formal organization.     

Evaluation of serum cortisol in the postmortem diagnosis of acute adrenal insufficiency

Normal adrenocortical activity is necessary for electrolyte regulation and the maintenance of cardiovascular function. Although chronic adrenal insufficiency generally presents with the gradual onset of a set of characteristic symptoms and signs, the more sudden loss of adrenal activity can present with acute, rapidly progressive cardiovascular dysfunction that can be fatal if not recognized and treated promptly. We herein describe a patient who had most of his adrenal tissue removed during resection of metastatic renal carcinoma, conventional clear cell type, with much of the remaining adrenal tissue undergoing necrosis during or shortly after surgery. Although the patient appeared to be stable and progressing adequately well, he died suddenly 2 days postoperatively. When the gross autopsy findings suggested the possibility of adrenal insufficiency, clinical laboratory assessment of adrenocortical activity was sought. Analysis of stored antemortem serum samples and of blood obtained at autopsy demonstrated a progressive decrease in cortisol levels which, in this stressed postsurgical patient, proved fatal. The use of both antemortem and postmortem blood in the demonstration of acute adrenal insufficiency at autopsy is discussed.

State Developmentalism Without a Developmental State: The Public Foundations of the "Free Market Miracle" in Chile

If export orientation is a goal in a sustainable development strategy, this study argues that public interventions at the sectoral level in a variety of markets can produce economic reorientation that pursues international comparative advantage faster and at lower cost than free market forces can. Pervasive failures in information, credit, input, distribution, and insurance markets can render strictly market-based adjustment both slow and costly. Although Chile's export boom and high growth rates have been associated with its free market economic policies, this article, based on a comparison of the fruit, fish, and forestry sectors, contends that new forms of public intervention were crucial catalysts in shaping a sustained export response.
