The European Group on Ethics: Law,Politics and the Limits of Moral Integration in Europe

Abstract: The article offers a critical review of the institutional role of the European Group on Ethics in the EU, focusing on the appointment and composition of the group, the nature of its ‘opinions’, the way these are used by the Commission and other EU institutional actors, looking in particular at its controversial Opinion 22 on the ethical review and funding of stem cell research under the FP7 programme. The analysis highlights the methodological difficulties faced by the group in the grounding of its Opinions, the blurring of normative moral and legal orders, the risk of politicisation of ethics and the potential overreach by the EU of its competences in reliance on a group of this kind to reach unity on deeply contested moral questions in a culturally and morally diverse Europe.     

Personality Disorder Symptoms in Women as a Result of Chronic Intimate Male Partner Violence

This study explores the personality disorder symptoms of women victims of intimate male partner violence (IPV), after controlling for the contribution of experiences of childhood abuse. Victims of both physical and psychological violence (n = 73) or psychological violence alone (n = 53) were compared with non-abused control women (n = 52). Information about sociodemographic characteristics, childhood abuse, and personality characteristics (MCMI-II) was obtained through face-to-face structured interviews. Women victims of IPV had higher scores than controls in schizoid, avoidant, self-defeating personality scales, as well as in the three pathological personality scales (schizotypal, borderline and paranoid). Both physical and psychological IPV were strongly associated with personality disorder symptomatology, regardless of the effects of childhood abuse. These findings underscore the need to screen for personality disorder symptoms in women victims of IPV when dealing with therapeutic interventions.     

Liability for the Escape of GM Seeds: Pursuing the ‘Victim’?

The widespread commercial cultivation of GM crops in the EU and the UK is getting closer. Intense concerns about the uncertain health and environmental effects of GM farming have been the subject of high profile debate. The effects of GM farming on existing forms of agriculture, raised by the prospect of cross–pollination by GM seed, provoke similarly polarised views. However, whilst regulatory developments have been strongly influenced by environmental and health concerns, the socio–economic impact of GM agriculture is relatively neglected in current regulatory approaches. The authors examine various possible legal responses to unwanted cross–pollination by GM seed, and contend that the law is likely to struggle to cope with the conflicts that may arise.     

The Ethic of Care, Female Subjectivity and Feminist Legal Scholarship

The object of this essay is to explore the central role played by the ‘ethic of care’ in debates within and beyond feminist legal theory. The author claims that the ethic of care has attracted feminist legal scholars in particular, as a means of resolving the theoretical, political and strategic difficulties to which the perceived ‘crisis of subjectivity’ in feminist theory has given rise. She argues that feminist legal scholars are peculiarly placed in relation to this crisis because of their reliance on the social ‘woman’ whose interests are the predominant concern of feminist legal engagement. With the problematisation of subjectivity, the object of feminist legal attention disappears and it is in attempts to deflect the negative political consequences of this that the ethic of care has been invoked, the author argues, unsuccessfully. The essay concludes with suggestions as to how the feminist project in law might proceed in the wake of the crisis of subjectivity and the failure of the ethic of care to resolve it.
