What There is Left and How It Works: Ancient Rhetoric and the Semiotics of Law

The present paper examines three parts of ancient school rhetoric: the issues, the topics, and the questions of style from the perspective of legal semiotics. It aims (1) to demonstrate the roles these have played and can play in the interpretation of legal discourses; and (2) to summarise what insights have been and can be gained from this classical tradition by contemporary legal research. It is argued that the promise of legal semiotics for rhetorical investigations is that it may help to make sense of the functioning of the system of ancient rhetoric, and contribute to our understanding of how rhetorical tradition works, while the research of ancient rhetoric can explore a range of semiotic devices essential for lawyerly thinking, resulting in the knowledge of a richer framework of interpretation.

Abstract

The interest of the English Spectator and its followers in women's education and in the formulation and propagation of the Western ideology of femininity is widely acknowledged. Nevertheless, the genre also engendered experiments with alternative views about women.La Spectatriceis an example of a periodical which resisted the very ideals codified by the genre it followed. This article attempts to fill a gap in the study of the spectatorial press, by analysing the tone and the content of this putative female spectator, and by stressing the innovative contributions of this French periodical to the spectator genre.

SUMMARY

In this article, Éric Anceau examines the coup d'État of 2 December 1851, which was carried out by the President of the French Republic at the time, Louis-Napoleon Bonaparte, against the Legislative Assembly. By viewing the coup from the parliamentary side and by using the method of prosopography, the author reevaluates an apparently well-known period, while refraining from partisan judgements and hasty generalizations. In the first part, the author analyses the immediate and contrasted reactions of the 741 parliamentarians to the coup. He then describes their negotiations and alignments. He finally shows the consequences for the parliamentarians of their different attitudes towards the coup: active support, acceptance, total abstention (a stance chosen by approximately a fifth of them) or outright resistance. In fact, Éric Anceau shows the great variety of their responses. Nevertheless he underlines the undecided, wait-and-see and pragmatic attitude chosen by most of the representatives. He concludes by mentioning the long-lasting consequences of the coup on the relationship between the new regime and the former Assembly representatives.
