Das gesetzliche Pfandrecht des Vermieters an den eingebrachten Sachen des Mieters (§ 1101 ABGB) ist nicht nach § 331 Abs 1 EO pf?ndbar, weil dem die Unverwertbarkeit aus dem Grund des § 42 Abs 1 MRG entgegensteht. Ist die Unverwertbarkeit des in Exekution gezogenen Rechts schon nach der Aktenlage offenkundig, ist die Exekutionsbewilligung zu versagen.

Eine gesonderte Wohnungsnahme nach § 92 Abs 2 und 3 ABGB darf nur eine vorübergehende Ma?nahme sein. Ein Dauerzustand liegt in der Regel noch nicht vor, wenn eine ?nderung des Verhaltens des anderen Ehegatten, das zur h?uslichen Trennung geführt hat, und eine Meinungs?nderung beim Antragsteller zumindest mit geringer Wahrscheinlichkeit m?glich erscheint. Dies gilt aber dann nicht mehr, wenn die Wiederaufnahme der h?uslichen Gemeinschaft ausgeschlossen ist.     

Trade,Development, and Nonproliferation: Multilevel Counterterrorism in Central Asia

This article was presented in its original form in October 2005 at the Conference on Central Asian Security in Tashkent, Uzbekistan. This article seeks to add to the discourse on counterterrorism by looking at the challenges posed by sub-state radicalism to development and regionalization. Specifically, adequate counterterror campaigns require addressing socioeconomic feeders of radicalism while simultaneously dealing with the threat of political violence itself. In terms of development, this means advocating increased trade volumes and export oriented growth while concurrently controlling for illicit trade (which often finances terrorist movements) and trade in strategic goods (which could serve to undermine the security of the state). The authors use the case study of Uzbekistan and Central Asian insecurity to illustrate the utility of customs modernization, border security, and export control legislation as integral components in wider counterterror campaigns. The study addresses circumstances specific to present day Central Asia but has wider implications in stymieing the relationship between “grey areas” and terrorist movements worldwide.     

Strategic voting in open primaries: evidence from?Rush?Limbaugh��s ��operation chaos��

Open primaries create the possibility of strategic crossover voting. On his March 3, 2008 program and subsequent broadcasts, radio personality Rush Limbaugh called on his listeners to extend the Democratic presidential contest by crossing over to vote for Sen. Hillary Clinton. Using voter registration data from North Carolina and election return data from Indiana, North Carolina, and Pennsylvania (states with open, semi-closed, and closed primaries, respectively), I find no evidence of a Limbaugh-motivated switch in political party registration or of a large or statistically significant Limbaugh-motivated increase in voting for Sen. Clinton.

Presents data on the prevalence of various morphological shapes of lateral folds in the hard palate mucosa and the levels of their disposition in the ipsiloid, ellipsoid, and parabolic osseous base of the hard palate. Demonstrates the possibility of using the characteristics of the hard palatal mucosa relief as an extra test for personality identification by the oral status.
