Trade mark use in transit: EU-phony or cacophony?

Legal context The present article discusses the opinion of Advocate-GeneralJacobs in Case C-405/05 Class International BV v Unilever NVand others, according to which trade mark owners cannot opposethe entry into the European Union of grey market non-Communitygoods placed in external transit, on the grounds of Article5(1) of the Trade Mark Directive, or any equivalent provision,as such entry does not constitute trade mark use. Key points We examine the consistency of this approach withprior case law of the European Court of Justice, namely in theCommission v France, Rioglass, The Polo/Lauren and Rolex casesand draw a parallelism with Council Regulation (EC) 1383/2003. Practical significance We conclude that trade mark owners shouldbe allowed to prohibit the placing in transit of goods whichwould infringe an intellectual property right under the lawof the transit country, unless the owner or consignor of thelitigious goods can undeniably prove that the goods are notdestined for the internal market. Stop press. At the end of the article the authors provide abrief analysis of the European Court of Justice's decision of18th October 2005 in this case.

Electoral rules and minority representation in Romania

This paper explores the effects that different institutional mechanisms for legislative representation have on ethnic diversity in the lower chamber of the Romanian parliament. It uses an original data set to examine representational outcomes generated by a combination of proportional representation and reserved seats provisions. The findings highlight the benefits that Romania's choice of electoral rules generated for smaller minority communities and limitations that these rules impose on the nature and extent of legislative representation of large minority groups. The paper provides evidence for qualifying the scholarly support in favour of proportional representation. It also draws attention to potential trade-offs between communal representation and ethnic inclusiveness of main political parties that the use of special mechanisms for minority representation might encourage.     

Bildung und die „neue“ Sozialdemokratie: eine Analyse aus der Sicht der vergleichenden Staatsausgabenforschung

The rhetoric of “reformed” social democracy has emphasized education and investment in human capital formation since the 1990s. Nevertheless, scholarly accounts of social democratic government policies have neglected the study of education politics. This article addresses the question of whether the move from traditional to reformist social democracy can be traced in the analysis of public social and education spending in the 1980s and 1990s. I show that government participation of social democrats went along with increases in social transfer spending in the 1980s, whereas in the 1990s, social democrats have instead increased spending on education, and higher education in particular, and curtailed spending on social transfers. The final section of the article discusses the implications of these findings for the future development of partisan theory.     

Migrants and their families in the home country: a bi-directional influence on voting behaviour

ABSTRACT

The voting behaviour of migrants has been studied extensively but limited attention has been paid to how the discussion with families in the home country can be important. This article analyzes under what circumstances migrants influence or are influenced by their families in voting decisions. The analysis uses individual-level data from a survey conducted in 2018 on a sample of 1,839 Romanian migrants. The results indicate that most migrants are not engaged in acts of persuasion about voting. Those who influence their families have a direct interest in the election results, are informed about what happens in the country and are politically active. The migrants who are influenced by their families have limited experience in the countries of residence and strong ties to their home country.     

Selective or Generic Activism? Types of Participants,Political Action Repertoires and Mobilisation Capacity in a Post-Communist Society

This study develops and tests two arguments for how repertoires of political action are reconfigured in post-communist Romania. Using multivariate statistical analysis, it examines whether citizens' engagement in post-communist politics is linked with generic socioeconomic and attitudinal traits or, alternatively, if it is connected with selective mobilisation opportunities provided by social networks and organisations. The findings reveal that while most Romanians are politically inactive two decades after the fall of communism, those who engage in politics do so selectively and their political action repertoires are largely influenced by four mobilising agents: trade unions; political parties; social networks; and civil society organisations.     

Der Kampf um knappe Mittel: Die Bestimmungsfaktoren der öffentlichen, privaten und sektoralen Bildungsausgaben im OECD-Länder-Vergleich

This article identifies the statistical determinants of public, private, and sectoral education spending in 21 OECD countries in the time period from 1980 to 2002. It is shown that socio-economic variables like the economic well-being of a country and the size of the youth population are important factors driving spending. In addition, political and institutional factors like the partisan composition of the government or the number of veto points play a major role as well. Private spending can in part substitute for a lack of public spending. The analysis of public spending on higher education shows that countries with left governments and a high openness of trade exhibit higher levels of spending, probably to compensate for negative externalities of internationalization.
