Cross-border crime and legal jurisdiction in post-colonial Hong Kong

Decolonization should be viewed as a process that both precedes and follows a change of sovereignty rather than as a discrete, historic event. Seen in this light, decolonization is now well advanced in Hong Kong. One of the major institutions engaged in this process is the Hong Kong legal system. In this paper I analyze the constitutional arrangements for Hong Kong's post-colonial legal system; describe Hong Kong's most sensational cross-border criminal case of the 1990s; and evaluate Hong Kong's prospects for retaining a separate legal system under Chinese sovereignty. Undergraduate Education in Legal Psychology

The purpose of this article is to describe ways that legal psychology can be introduced into the undergraduate curriculum. The extent to which undergraduate psychology and law courses are currently a part of the curriculum is described, and a model is proposed for coursework in a Psychology Department that might adequately reflect coverage of the legal area. The role of legal psychology in interdisciplinary programs and Criminal Justice departments is discussed. Sources for teaching aids and curricular materials are described.     

Fast spinning into oblivion? Recent developments in money-laundering policies and offshore finance centres

This article examines the growth of money-laundering in conjunction with the associated development of offshore finance centres (OFCs) located in small places such as islands or microstates in the Caribbean and elsewhere. The phenomenal growth of OFCs since the 1960s may be seen in terms of the 'four spaces'. Three of these 'spaces-the secrecy space (confidentiality); the regulatory space; and the political space-can be used to frame an analysis of the growth of offshore finance and the emergence of a suitable environment for international money-laundering. The article then examines recent policy developments concerning money-laundering and OFCs, such as the workings of the Financial Action Task Force (FATF), and the regional Task Forces such as the Caribbean Task Force. Finally, the article explores the changing way 'offshore' is being constructed as exemplified by rising onshore pressure from the OECD, G7, the EU and, most recently, the UK government, with its growing concern demonstrated by the 1998 unprecedented Home Office and FCO reviews of both British Isles and Caribbean OFCs.     

Performance measurement and financial incentives for community behavioral health services provision

This article analyzes the uses of performance measures in contracting for behavioral health services. A flexible performance measurement methodology, called Data Envelopment Analysis (DEA),is used to measure cost efficiency and cost effectiveness. The use of measures in controlling costs, allocating program funds and administrating performance-based contracting is demonstated.     

Violence from Below: Explaining Crimes against Civilians across Soviet Space, 1943–1947

The end of World War II brought little relief to the lands it ravaged most. Mass wartime violence continued in the Soviet space beyond the ‘false peace’ of 1945. Historians have sought to explain this violence in terms of the ‘wartime brutalisation’ of state and citizens alike, though this approach is limited in explaining how and why violence continued after 1945. This article shifts focus from psychology to social history to argue that the disintegration of Soviet state control is central to explaining the enduring violence after 1945 and understanding its emergence as much ‘from below’ as ‘from above’.
