Representations of the family in postwar British amateur film: family histories in the Lane and Scrutton collection at the East Anglian Film Archive

This article examines the construction of the postwar British family in amateur film with reference to the Sidney Lane and Cecil Scrutton collection held at the East Anglian Film Archive (EAFA), particularly the films covering 1948 – 1961. Heather Norris Nicholson argues that home movies contribute to ‘an understanding of leisure and visual-related practices of consumption as well as the social processes by which people came to give themselves, and others, identities’ in the mid-twentieth century (Nicholson, H. N. [2004]. At Home and Abroad with Cine Enthusiasts: Regional Amateur Filmmaking and Visualizing the Mediterranean, ca. 1928 – 1962’. Geojournal, 49, 323–333). By considering the social and historical contexts in which these home movies were produced, and using accompanying notes by one of the filmmaker’s sons, the leisure time films of Lane and Scrutton can be analysed in order to understand how the amateur cine hobby ideologically constructed family, community and national identity in postwar Britain. The images of Christmas parties, daytrips and holidays in these films reveal much about this particular family, and are therefore very illuminating to the social historian and film scholar of today.     

The Closeness Problem and the Doctrine of Double Effect: A Way Forward

A major challenge to the Doctrine of Double Effect (DDE) is the concern that an agent’s intention can be identified in such a fine-grained way as to eliminate an intention to harm from a putative example of an intended harm, and yet, the resulting case appears to be a case of impermissibility. This is the so-called “closeness problem.” Many people believe that one can address the closeness problem by adopting Warren Quinn’s version of the DDE, call it DDE*, which distinguishes between harmful direct agency and harmful indirect agency. In this paper, I first argue that Quinn’s DDE* is just as vulnerable to the closeness problem as the DDE is. Second, some might think that what we should therefore do is give up on intentions altogether and move towards some kind of non-state-of-mind, victim-based deontology. I shall argue against this move and explain why intentions are indispensable to an adequate nonconsequentialist theory. Finally, I shall propose a new way of answering the closeness problem.     

Bringing the Falklands/Malvinas Home: Young People's Everyday Engagements with Geopolitics in Domestic Space

This paper draws on recent research examining feminist and everyday geopolitics to focus on the relatively neglected domestic sphere as a space where geopolitical events like the Falklands/Malvinas war are learnt, (re)produced, remembered and contested by young people. It presents qualitative data drawn from interviews with young people from Argentina (Río Gallegos) and the Falkland Islands (Stanley), locations with intimate connections to the 1982 war. It argues that research in domestic environments that engages the familial relations, objects and practices that embody geopolitical pasts can help make sense of how young people (are able to) express geopolitical agency.     

Containing Conflict or Instigating Unrest? A Test of the Effects of State Infrastructural Power on Civil Violence

Several scholars argue that state infrastructural power affects the likelihood of civil violence yet make competing claims. Some propose that states with high levels of infrastructural power instigate violence by reducing local autonomy, while others suggest infrastructural power endows states with the capacity to contain civil violence. We test these claims using both qualitative and quantitative methods. Through a pooled time-series analysis of 32 former British colonies, we find that infrastructural power is not significantly related to civil violence, suggesting either that infrastructural power has no effect or no net effect. Then, through case studies of Burma and Botswana, we investigate the impact of infrastructural power on civil violence, focusing on mechanisms and causal conditions. The case studies provide evidence that infrastructural power produces competing mechanisms that negate any net effect and that different conditions and policies affect whether a state’s level of infrastructural power contains conflict or instigates unrest.     

Achieving behaviour change: Three generations of HIV/AIDS programming and jargon in Thailand

NGOs have played an important role worldwide in the fight to prevent the spread of HIV/AIDS through achieving behaviour change. NGOs have often been at the forefront of innovative changes, influencing government and international programming activities. This paper identifies and analyses the evolution of the HIV/AIDS programmes of one NGO in Thailand over a period of ten years. Three generations of programming are identified both through distinct approaches to this area of work and through the changing jargon used to describe the people the programmes are aimed at.     

Work-Product Protection and Experts' Documents: The Ninth Circuit Strengthens the “Because of” Standard and Extends Protection to Dual Purpose Documents

Since the Supreme Court applied the work-product privilege to documents created by an attorney's representatives, so long as the documents were created in anticipation of litigation, the lower courts have attempted to interpret this application. The various circuit courts have addressed this issue as it relates to documents serving both litigation and nonlitigation purposes. Most recently, in November 2003 the Ninth Circuit joined the First, Second, Third, Seventh, Eighth, Eleventh, and D.C. Circuits when it adopted the rule that an expert's documents may be protected when they are prepared “because of the prospect of litigation.” In contrast, the Fourth, Fifth and Sixth Circuits, Tenth and D.C. District Courts have constructed a stricter interpretation. Further, the Ninth Circuit's recent holding in United States v. Torf (In re: Grand Jury Subpoena) 350 F. 3d 1010 (9th Cir. 2003) sheds some more light on the scope of the work-product protection as it applies to environmental consultant's documents created in anticipation.

The garrison state revisited: civil–military implications of terrorism and security

Lasswell’s original vision of the garrison state was spurred by the increasing militarization of states in the industrial age. The advent of the Cold War seemed to confirm Lasswell’s predictions. In the post-industrial age, conventional warfare and the attendant mobilization of societies seem less probable, but the changing threat of terrorism may lead to a variation of Lasswell’s construct. While states no longer appear likely to evolve into a system of armed camps directed at one another, this article argues that the threat of terrorism may necessitate the garrisoning of society and enhance the role of military and police organizations, as Lasswell warned.     

A tragedy of the anticommons: local option taxation and cell phone tax bills

When multiple taxing jurisdictions overlap and fail to account for one another’s actions, they over-tax the common base. This is a prediction of the anticommons model, in which numerous parties have authority to exclude others from using a resource. This model further predicts that when governments over-tax the base, private parties will underutilize the resource, and underutilization will be greater as the number of parties with exclusion rights rises. We test these predictions by studying cell phone taxation and local option tax authority, which allows some cities, counties, and special-purpose districts to levy taxes on cell phone use. Consistent with theory, we find that the tax rate on cell phone service is higher when local governments have the option to tax. Further, the percentage of households owning cell phones is lower when there is the local option to tax, and ownership rates fall with the number of taxes levied.
