Courting the President: How Circuit Court Judges Alter Their Behavior for Promotion to the Supreme Court

We examine whether circuit court judges sacrifice policy purity for career goals. We compare the behavior of contender judges–those most likely to be elevated to the Supreme Court–during vacancy periods with their behavior outside vacancy periods. We also examine the behavior of noncontender judges during those same times. The data show that during vacancy periods, contender judges are more likely to vote consistently with the president's preferences, to rule in favor of the United States, and to write dissenting opinions. Noncontender judges fail to evidence such behavior. These findings provide empirical support for the argument that federal judges adapt their behavior to specific audiences, and provide new avenues for research into judges' goals and the role of audiences in judicial decision making.     

The intersubjective space–time of a Zulu choir/HIV support group in global perspective

This article draws from anthropology, conversation analysis, ethnomusicology, semiotics, and phenomenology, using the concept of intersubjectivity to model how the micro-organization of musical communication can be integral in social processes of support, identity maintenance, and activism amid structural inequality. This is based on ethnographic fieldwork in Durban, South Africa, with a Zulu gospel choir that functioned as a support group, activist organization, and performance troupe. Three distinct aspects (or levels) of intersubjectivity are discussed. The organization of these levels in music making is outlined through fine-grained discussion of how people with HIV coordinate bodies and voices in space as they make music together for each other and for international audiences. This article contributes to the further development of a musical semiotics, discussing how overlapping conceptualizations of intersubjectivity in multiple disciplines may be synthesized to analyze the performance of coordinated sonic action.     

Are Independent Councillors Really Conservatives in Disguise?

Abstract?A feature of English local political folklore is the belief among national political parties, that Independent councillors are Conservatives in disguise. Yet, little evidence is given to support this idea because little is known about these councillors’ beliefs and assumptions or how they distinguish themselves from the party politics they eschew. In this article we address the question: Are all Independent councillors really Conservatives? The article answers the question by reporting the findings of research conducted among Independent and Conservative councillors in England to explore the complex, multidimensional and fluid world that is Independent politics.     

Taking loan sharking into account: a case study of Chinese vest-pocket lenders in Holland

Chinese organized crime has long been accused of playing an active role in the illicit usury world, except that there are no known empirical studies depicting how it is actually done. A rare opportunity arose when a Dutch police agency seized one set of financial records documenting detailed transactions of a loan shark working incognito inside a Dutch casino. A detailed analysis of these accounting records suggests that the Chinese loan sharks work with a wide range of clients, primarily Chinese but also non-Chinese. Exorbitant interests were levied on the loans and large volumes of cash were loaned out, with the vast majority accounts in good standing. The bookkeeping records revealed a rather smooth business transaction environment, where some customers were acquaintances from connected social networks, while others were not. Although the seized records left some questions unanswered, the case provided a rarepeek into a secretive financial world that has remained largely unknown to the research community.     

The Olympic Games,human rights and democratisation: Lessons from Seoul and implications for Beijing

The experience of the Seoul Olympics in 1988 has led major games boosters to boldly assert their liberalising potential, especially in the context of the Beijing Games of 2008. This paper examines whether in the post-Cold War and post-9/11 eras, there is a sound basis for such arguments. It begins by re-examining the lessons of the Seoul Olympics to clarify the Games' contribution to the democratisation of Korea, as catalyst though not cause. It then assesses the applicability of the lessons of Seoul to Beijing given the different contexts of their 'Olympic journeys'. Finally, based on this comparison it considers the ways in which the 2008 Games may affect prospects for human rights improvements and political liberalisation in the People's Republic of China. While the outcomes of this process are likely to be quite different from the western-style liberal democratisation that occurred in South Korea, the process of engagement between 21st Century China and 21st Century Olympism holds the possibility of stimulating a fruitful, dialogic, and progressive exchange on rights issues.     

Age Estimation from Radiographic Images of the Knee

This study examines the reliability of age estimation utilizing the Pyle and Hoerr atlas in relation to a modern Scottish population. The knee radiographs of 442 individuals (168 females, 274 males) were age assessed using the Pyle and Hoerr atlas. Analysis showed that there was a strong correlation between chronological age and estimated age (females R² = 0.968, males R² = 0.952). For females, the atlas method was most accurate between the ages of 9 and 15 years of age with an underage of 2.27 months and an overage of 2.38 months. For males, the atlas consistently overestimated age from the age of 9 years to the age of 16 years from between 0.14 and 8.81 months. The standard deviation for females was 9.86 months and for males was 10.75 months. This study showed that the Pyle and Hoerr atlas can be applied to a modern population with small modifications.     

Online Public Response to Dutch News About Money Laundering

In this paper we analyze how Dutch Public Prosecution’s press releases about money laundering and underground banking are received by producers and consumers of online news reports. First we take a closer look at how journalists (re)framed six official press releases in 75 news reports. It turns out that journalists do not regularly adopt the success frame that the Public Prosecution uses in its press releases. Furthermore, the role of the Public Prosecution Service or the police is downplayed. The moral message that “crime should not pay” receives no coverage in news reports. Second, we analyze how the news reports generated 276 online comments. We distinguish three ways in which online commenters respond to news reports; they (1) appreciate, (2) downplay or (3) condemn the authorities’ success. Commenters are particularly likely to downplay or condemn the police’s success. When a news report focuses on ‘underground bankers’, commenters often express a negative opinion about the effort to curb money laundering. It also appears that readers did not always understand the use of a term like underground banking.
