This paper explores Islamic Criminal Law and Procedure. There are some differences among Islamic states but these differences are relatively minor. Muslims are tried in Sharia Courts for offenses found in the Quran. Non‐Muslims can not be held to the same standard (Apostasy). All people are subject to the jurisdiction of Mazalim Courts which handle taxation, traffic, and other administrative functions.

Islamic Law has three major divisions of crime: 1. Hadith Crimes (most serious); 2. Quesa Crimes and Diya (restitution); and 3. Tazir Crimes (least serious).

Islamic Law has many similar “defenses to crime” as the Common Law nations. They use puberty of a juvenile as the age of accountability. Police must obtain a search warrant for property. The punishment philosophies are similar to western views in theory, but they do apply these ideas in much different ways. Many punishments are public and done as a deterrent for others. Islamic judges have more freedom for sentencing options than western judges. They have mandatory sentences for only a few of the most serious Hadith Crimes. Some in the popular media point to the harshness of Islamic Law, and conclude that it must be wrong. They have very low crime rates and few social problems. We conclude that Islamic Law is not wrong, only different.  相似文献

This article deals with resettlement management in Indonesia, which involves a number of policy and implementation issues concerning land acquisition, compensation, and resettlement practices in development projects.1 The principal objective of this article is to identify a set of policy measures gleaned from past experiences in Indonesia and to present a comparative review of how other countries have addressed land acquisition and resettlement issues, including the latest donor policies concerning resettlement of people affected by the development processes. Several resettlement case studies in Indonesia are briefly presented to identify past mistakes and successes. The Indonesian experience is then assessed in the light of international “best practices” for retooling policy, including adoption of an appropriate resettlement policy in Indonesia. The role of local government bodies, non-government and community-based organizations in resettlement management and their beneficial involvements in resettlement planning and implementation is briefly discussed.  相似文献

Institutions are defined as the set of rules that govern human interactions. When these rules are discriminatory, they may disempower segments of a population in the economic spheres of activity. In this study, we explore whether laws that discriminate against women influence their engagement in the economy. We adopt a holistic approach where we explore an overall measure of unequal laws also known as legal gender disparities and relate it to several labour market outcomes for women. Using data for over 59,000 firms across 94 economies, we find that unequal laws not only discourage women’s participation in the private sector workforce, but also their likelihood to become top managers and owners of firms. Suggestive evidence indicates that access to finance, property ownership, business registration, and labour market constraints are pathways by which legal gender disparities disempower women in the private sector.  相似文献

The term “national security” evolved from a nation possessing military might to predominantly having a secure national economy. Beteen those two aspects lie other factors that contribute to a nation's security. Minerals have been part of national se, curity strategy since the need for security was felt by nations. Especially military, economic, and environmental security has been factors that have driven mineral demand. On the other hand, mining and minerals have often been the cause of national security alerts. This paper would represent economic security as being reliant on minerals and will highlight economic security as the key driver that activates other security issues today. It will go on to discuss how minerals have also been affected by national security problems, such as the recent financial crisis. Abstract:  The AmpFℓSTR® MiniFiler™ polymerase chain reaction amplification kit, developed and supplied by Applied Biosystems, complements the AmpFℓSTR® Identifiler® polymerase chain reaction amplification kit (Applied Biosystems, Warrington, U.K.) by improving the success rate when profiling DNA that is degraded or contains inhibitors. Before applying the MiniFiler™ kit to casework, the profiles from 200 unrelated Kuwaitis were compared to Identifiler® profiles. Concordance was observed for 99.875% (1598 of 1600) of the compared STR loci. The two discordant profiles displayed allelic dropout: one at the D13S317 locus due to nonamplification of allele 10 in the MiniFiler™ profile, and one at the D18S51 locus due to nonamplification of allele 18 in the Identifiler® profile.  相似文献

In the current context of globalization and technological spread, the role of knowledge as an organizational resource is phenomenal. Knowledge management can be seen as an add-on to reform paradigms such as new public management, good governance, and smart government, which has generated significant interest for public sector reformists in recent years. The amount of literature on knowledge management in public the sector of the United Arab Emirates is relatively scanty. In the Government of Dubai (1 of 7 Emirates in the UAE), the journey towards knowledge management has started 2 decades or so ago and now has begun to take structural roots in many organizations. This study examines the relationship between organizational culture elements (i.e., trust, communication between employees, reward, leadership, and learning and development), organizational socialization, and knowledge transfer in the government organizations in Dubai. Based on a theoretical framework to measure the influence, this study conducted a questionnaire survey in the Government of Dubai entities. From 811 respondents representing these organizations, the survey results unfold positive relationship between knowledge transfer and the 4 selected organizational cultural elements (i.e., trust, communication between employees, reward, and leadership). Socialization is found to play a moderating role in all the hypothesized relationships except between reward and knowledge transfer. It also examines further research implications to support knowledge transfer processes and practices in the public sector of Dubai and the UAE.  相似文献
