Intergovernmental competition can enhance efficiency. Centralization of government expenditures inhibits intergovernmental competition because it makes governments more homogeneous, and so cartelizes local governments. Cartelization reduces Tiebout competition, and limits benchmark competition in which one government??s performance can be compared with neighboring governments. Measuring fiscal centralization as the ratio of local to state and local government expenditures within the state, the evidence shows that more fiscal decentralization is associated with higher levels of state per capita income. State legal needs studies quantify and classify the legal problems faced by low‐income families, which is crucial to obtaining and allocating resources. Providers and courts perceive a greater need for family law help than do low‐income households, an important disparity to examine. State legal needs of the poor studies are most valuable when they provide insights into how families' legal needs are or are not being met, allowing for more informed and effective recommendations and action. An emerging body of research suggests that prison visitation has implications for better understanding inmate institutional and post-release behavior, but not all inmates receive visits. The goal of the current study is to document barriers to visitation from the inmate perspective and describe the perspectives of those who receive very few or no visits. We also describe how inmate perceptions of visits impacts the way one does time and negotiates subsequent visitation. Using data from qualitative interviews, we find evidence that inmates make willful decisions when negotiating prison visits that are guided by one’s sense of self and further colored by the perceived social and economic strain on families. Our results challenge the perception of a universally positive visitation experience, and introduce the role of inmate choice in selecting into and out of prison visits. 相似文献

At the penalty phase of a capital trial, jurors endorse and weigh aggravators and mitigators. The purpose of the current studies was to examine how gender differences in attributional complexity relate to endorsements of aggravators and mitigators. In Study 1, undergraduate participants read definitions of aggravators and mitigators and rated the extent to which circumstances were aggravating or mitigating. In Study 2, a death qualified community sample read a trial summary, rated the extent to which aggravators and mitigators were present in the case, reported whether mitigators outweighed aggravators, and rendered a sentence. Results indicated that gender differences in mitigator endorsement were mediated by attributional complexity, and that gender differences in sentencing decisions were serially mediated by attributional complexity, mitigator endorsement, and aggravator and mitigator weighing. 相似文献

Research Summary
For several decades, critics have argued that civil forfeiture laws create incentives for law enforcement to increase departmental revenue by “policing for profit.” By using data on federal equitable sharing payments to nearly 600 local law enforcement agencies between 2000 and 2012, we examine the relationship between the characteristics of state forfeiture laws and equitable sharing payments to local agencies. Our results indicate that agencies in states with state laws that are more restrictive or less rewarding to police collect more in federal equitable sharing. This finding supports the critics’ argument that police behavior in regard to forfeiture activities is influenced by the financial rewards and burdens involved.Policy Implications
Our results reveal that the findings of investigative journalism and case study research, that is, that police forfeiture activities are influenced by financial rewards, may be more generalizable to law enforcement than previously thought. Despite recent state‐level reforms, federal equitable sharing and most state forfeiture laws provide limited due process protections and have minimal accountability or reporting requirements. Concerns about the impact of civil forfeiture practices on perceptions of procedural justice and police legitimacy are discussed, and possible policy reforms are reviewed. 相似文献167.

Both terrorism and governmental anti-terrorist actions affect spatial structures and their boundaries, such as the state and the distinction between public and private spaces. Those spatial structures also articulate the normative dimensions of human life, which include the ethical principles and constitutional rights that orient behaviour and thought. By affecting the spaces, places and scales of life, (anti-)terrorism potentially can generate a new normativity. A new normativity would be manifested in changes to spatial structures and thereby would indicate that the content of political rights like personal freedom had been changed in practice. This paper addresses the possible emergence of a new normativity via an examination of how spatial structures are affected—specifically, their permeability and plasticity—by terrorist and anti-terrorist activities within a US context. 相似文献
