In this article, we argue that feminist legal scholars should engage directly and explicitly with the question of evil. Part I summarises key facts surrounding the prosecution and life-long imprisonment of Myra Hindley, one of a tiny number of women involved in multiple killings of children in recent British history. Part II reviews a range of commentaries on Hindley, noting in particular the repeated use of two narratives: the first of these insists that Hindley is an icon of female evil; the second, less popular one, seeks to position her as a victim. In Part III, the article broadens out and we explain why we think feminist legal scholars should look at the question of evil. In large part, the emphasis is on anticipating the range of possible objections to this argument, and on trying to answer these objections by showing how a focus on evil might benefit feminist legal thinking – specifically in relation to the categories of perpetrator and victim and, more generally, in relation to laws motivated by a desire to secure women’s human rights.  相似文献

Current research literature contains very few international, cross-cultural comparison studies of persons adjudicated 'Not Criminally Responsible on Account of Mental Disorder' (NCRMD). This study explores and compares the demographic differences between persons found NCRMD in British Columbia, Canada and Hunan, China. Eight variables such as sex, age, education level, marital status, conviction history, psychiatric history, and index offence are compared between the Canadian and Chinese cohorts. The Canadian and Chinese cohorts were similar in sex and psychiatric history. The divorce rate, educational level, and conviction histories were significantly higher, and the age was significantly older in the Canadian cohort. The Chinese cohort had higher levels of murder and attempted murder index offences. Differences between the two cohorts can be explained in terms of legislative and cultural differences.  相似文献

Commercial aviation in the United States developed rapidly from a nucleus of pilots who returned from World War I, barnstormed and flew primitive airmail routes, and were hired by the new commerical airlines of the 1930s. The death of U.S. Senator Bronson Cutting in a 1935 crash was an important stimulus to improved governmental regulation of civil aviation. The air traffic control system, primitive until and throughout World War II, was soon proven to be inadequate for postwar demands. The midair collision of two large airliners over the Grand Canyon in June 1956 that killed the 128 persons on board was itself a strong stimulus for serious efforts, particularly in improving air traffic control systems. This and many other difficult problems in aviation safety have been addressed in the subsequent 33 years, some with success, although it has not always been immediate, and with major accidents still occurring. Commercial air travel is safe and widely accepted, however, and there is promise for additional important advances here.  相似文献

The state of Arizona recently established a temporary, blue-ribbon committee to evaluate the state's fiscal system and to recommend changes that would improve the system. The impetus for the committee was a series of budgetary difficulties in the 1980s that lawmakers hoped might be avoided in the future by implementing major structural changes suggested by a long-run analysis of the state's economy and taxes and expenditures. The findings and recommendations of the committee are relevant for states across the country. It is likely that many states will be faced with tough budgetary challenges in the decade of the 1990s because the states' revenue systems have not adapted to the changes in the level and nature of state spending responsibilities.  相似文献

The ACHIEVEability model of affordable housing aims to promote self-sufficiency by requiring enrollment in postsecondary education in exchange for subsidized housing. In this study, we exploit the quasi random assignment of ACHIEVEability participants (N = 84) to subsidized housing units to evaluate whether microneighborhood environments moderated participants’ progress in postsecondary education. Participants progressed in their educational pursuits in line with program requirements, earning about 12 college credits per year. Neighborhood block group characteristics moderated this progress. Participants who were assigned to housing located in poorer, more violent, and less educated block groups earned credits at a significantly slower rate than participants assigned housing in more advantaged block groups. Our results suggest that the micro environments immediately surrounding residents of subsidized housing matter, even if they are situated within broader contexts of spatial and personal disadvantage.  相似文献
