Stag Hunting with the State AG: Anti-Tobacco Litigation and the Emergence of Cooperation Among State Attorneys General

Employing a critical-mass theory of collective action, this article models the emergence of cooperation among state attorneys general in litigation against the tobacco industry. These suits were not independent events, nor was cooperation based on prior agreement among the attorneys general. Rather, cooperation emerged over time as a result of interdependent decision-making, with early lawsuits increasing the likelihood of later suits. The model emphasizes the "production function" of the collective good and the heterogeneity of the attorneys general and their political environments as keys to the development of cooperation. The model is tested against data using event history analysis.     

大鼠视神经夹伤后视网膜病变及其F-VEP检测

目的观测大鼠视神经夹伤后视网膜病变及其对视功能时序性变化的影响。方法建立大鼠视神经夹伤模型,分别于伤后1、3、5、7、9、14、28、56、84d光镜观察视网膜病变,闪光视觉诱发电位(F-VEP)检测视功能状况。结果大鼠视神经损伤诱导视网膜神经节细胞(RGCs)较正常眼明显减少。损伤后3～7d RGCs减少率快速上升,14d 后缓慢下降,28d后几乎无明显变化。视神经损伤1d F-VEP波形变得低而宽;1-14d峰潜时和波幅呈进行性下降, 28d后变化平稳,并显示恢复迹象。结论神经损伤后节细胞继发性病变是视功能进行性下降的重要基础;并与视功能的时间规律变化具有相关性。     

Human Rights and Modern Liberalism: a Critique

The idea of human rights has become one of the central moral notions of both the theory and practice of international politics. While its foundation and future in the practice of politics looks bright, it is an idea that still causes great trouble at the theoretical level. What are human rights? Why do we have them? To what should we attribute the authority of their moral claims? The theorist Michael Freeman has suggested one theory that by addressing such questions may serve as a foundation for human rights. His theory, however, ends by begging the questions it set out to answer.     

STATE SUPREME COURT APPLICATIONS OF TROXEL v. GRANVILLE AND THE COURTS' RELUCTANCE TO DECLARE GRANDPARENT VISITATION STATUTES UNCONSTITUTIONAL

In this article, the author reviews state supreme court applications of Troxel v. Granville , analyzing the impact of the decision on the courts' ongoing efforts to adjudicate visitation disputes between parents and grandparents. Set against a background of legislative recognition of grandparents' rights and judicial uncertainty regarding the appropriate role of nonparents in children's lives, Troxel reaffirmed the constitutional right of parents to direct their children's upbringing. The author argues that state supreme courts evaluating gradparent visitation statutes and seeking to enforce Troxel 's presumption in favor of parents should be more willing to strike down overly broad statutes. Such an approach would be a positive step toward addressing the excessive judicial discretion that the Troxel Court found so problematic, and would signal to state legislatures the need for statutes that both provide for the needs of children and protect parental rights.

THE EFFECT OF GENDER ON THE DECISION TO INCARCERATE BEFORE AND AFTER THE INTRODUCTION OF SENTENCING GUIDELINES*

The present study explores the relationships between gender and imprisonment decisions in Minnesota before and after the introduction of sentencing guidelines. Results from a series of logistic regression models indicate that gender alone did not have a significant impact on the likelihood of imprisonment, but women with dependent children were significantly less likely to be imprisoned before sentencing guidelines and in the years subsequent to their implementation. The findings suggest that despite the introduction of sentencing reforms, court officials tend to return to issues of substantive justice, and they appear unable to shed their individual or organizational ideas of fairness in sentencing.     

System Change through Collaboration…Eight Steps for Getting from There to Here

Family courts and child welfare agencies across the country are charged with protecting the safety of our children. That mission has become more challenging with increasing federal legislation and decreasing funding. In Buffalo, N.Y., the Family Court and the Department of Social Services have teamed up to respond to this challenge. With minimal additional staffing and resources, they have led a collaboration of agencies and service providers to change the way business is done in child welfare. By engaging each other in an interagency system change effort, the amount of time children spend in foster care has been reduced. The collaboration has been able to accomplish in a relatively short time what no agency had previously been able to accomplish on its own. The beneficiaries have been the children and families of Erie County.
