Protecting the planet: a proposal for a law of ecocide

A wide range of actions imperil the planet and threaten the future of humanity and other species. This essay notes some examples of crimes and harms damaging to the environment and human and non-human species as well as various forms of response that have called for more effective and appropriate models of justice and law than currently prevail. This leads to a discussion of several suggestions regarding the development and expression of an earth jurisprudence and to the history of a proposal that “ecocide” be recognised internationally as a crime. Analysis of documentary sources traces this idea from debates about the concept of genocide to consideration by United Nations officials as to how crimes against the environment might be defined, and shows how near such a proposal has previously come to acceptance and enactment. The article concludes with an argument for supporting a law of ecocide as the 5th Crime against Peace.

Movement-space: The changing domain of thinking resulting from the development of new kinds of spatial awareness

This paper is an attempt to describe the nature of a new calculative background that is currently coming into existence, a background that will both guide and constitute what counts as ‘thinking’. It begins by providing a capsule history of how this background has become a more and more pervasive quality of Euro-American cultures as a result of the rise of ‘qualculation’. It then moves on to consider how this qualculative background is producing new apprehensions of space and time before ending by considering how new kinds of sensorium may now be becoming possible. In this final section, I illustrate my argument by considering the changing presence of the hand, co-ordinate systems and language, thereby attempting to conjure up the lineaments of a new kind of movement-space.     

Community Participation in Spatial Planning: Exploring Relationships between Professional and Lay Stakeholders

The literature that explores relationships between lay and professional stakeholders in community participation generally suggests that professionals perceive five main difficulties in working with lay people: it is unnecessary within democracies; lay people lack expertise; they are not representative; there is commonly a lack of trust, and decision-making is made more complex. In respect of spatial planning in South West England, from survey evidence these difficulties are not so apparent except in respect of complex decision-making. It is likely that the variation between the literature and the survey is influenced by the longer heritage of community participation in the spatial planning process in England, than in most other local authority services.

A symptom level examination of the relationship between Cluster B personality disorders and patterns of criminality and violence in women

The psychometric properties and structure of the Cluster B Personality Disorder criteria (Antisocial, Borderline, Histrionic, and Narcissistic) are examined in a sample of 261 female inmates using a self-report screen followed by a full diagnostic interview. The results of the structural analyses in this sample demonstrated good internal consistency and convergence, but poor discriminant validity between disorders. An exploratory factor analysis found that the structure of these disorders was best accounted for by a four-factor solution that paralleled the Diagnostic and Statistical Manual (DSM-IV-TR; APA, 2000) classification scheme with some significant and notable exceptions. Using the factor scores generated from the factor analysis, the personality profiles of the women were compared with several behavioral indices, including instant offense, institutional infractions, and self-report violence and victimization within the prison. Of particular importance was the consistent relationship observed between narcissistic personality traits and threatening and violent behavior within the prison combined with the impulsive but less malignant presentation of antisocial personality traits among this sample of women. Results are discussed as they inform our understanding of the structural integrity of the four Cluster B diagnostic categories and the relationship of these personality disorders to different types of criminality and violence.     

Time-lapse geophysical investigations over a simulated urban clandestine grave

A simulated clandestine shallow grave was created within a heterogeneous, made-ground, urban environment where a clothed, plastic resin, human skeleton, animal products, and physiological saline were placed in anatomically correct positions and re-covered to ground level. A series of repeat (time-lapse), near-surface geophysical surveys were undertaken: (1) prior to burial (to act as control), (2) 1 month, and (3) 3 months post-burial. A range of different geophysical techniques was employed including: bulk ground resistivity and conductivity, fluxgate gradiometry and high-frequency ground penetrating radar (GPR), soil magnetic susceptibility, electrical resistivity tomography (ERT), and self potential (SP). Bulk ground resistivity and SP proved optimal for initial grave location whilst ERT profiles and GPR horizontal "time-slices" showed the best spatial resolutions. Research suggests that in complex urban made-ground environments, initial resistivity surveys be collected before GPR and ERT follow-up surveys are collected over the identified geophysical anomalies.     

Soilwater Conductivity Analysis to Date and Locate Clandestine Graves of Homicide Victims

In homicide investigations, it is critically important that postmortem interval and postburial interval (PBI) of buried victims are determined accurately. However, clandestine graves can be difficult to locate; and the detection rates for a variety of search methods (ranging from simple ground probing through to remote imaging and near‐surface geophysics) can be very low. In this study, simulated graves of homicide victims were emplaced in three sites with contrasting soil types, bedrock, and depositional environments. The long‐term monthly in situ monitoring of grave soil water revealed rapid increases in conductivity up to 2 years after burial, with the longest study evidencing declining values to background levels after 4.25 years. Results were corrected for site temperatures and rainfall to produce generic models of fluid conductivity as a function of time. The research suggests soilwater conductivity can give reliable PBI estimates for clandestine burials and therefore be used as a grave detection method.     

“Hybrid Governance” and the Politics of Legitimacy in the Myanmar Peace Process

This article examines competing claims to political legitimacy and sovereignty in Myanmar’s conflict-affected areas of “limited statehood.” In the context of ceasefires and an emerging peace process since 2012, non-state-controlled “liberated zones” and areas of mixed insurgent and government authority constitute new political spaces, where multiple state and para-state actors demonstrate governance authority, extract resources and provide services to local communities. This article explores the dynamics and implications of these developments with reference to the emerging literatures on “rebel rulers” and “hybrid governance,” and examines the practices of donors and aid agencies operating in these areas. I argue that external actors seeking to “think and work politically” should move beyond standard peace-building and development packages based on strengthening the state, and adopt more conflict and context-sensitive approaches. Effective state building should take account of governance structures and service delivery functions established by ethnic armed organisations, which although under-resourced enjoy significant political legitimacy.
