Hanging the Kaiser: Anglo‐Dutch relations and the fate of Wilhelm II, 1918–20

The flight of the German Kaiser to the Netherlands at the end of the First World War led to a crisis in Anglo‐Dutch relations. Prime Minister David Lloyd George made the trial of the Kaiser a key issue in the British general election campaign of December 1918. Article 227 of the Treaty of Versailles called for the Kaiser's surrender by the Netherlands government for trial before an international tribunal, a request the Dutch repeatedly refused during the period January to March 1920. Using both British and Dutch sources, this article highlights the internal Dutch debate over the fate of the Kaiser, and the confusion and hypocrisy with which the problem was handled by the British government.

Paying to Be Punished: A Statutory Analysis of Sex Offender Registration Fees

Over the last 20 years, sex offender policies, specifically in terms of community corrections, have increased in scope. One of the most controversial and pervasive sex offender policies is that of registration. In response to the consumption of already limited resources, jurisdictions have imposed increasingly higher community supervision fees onto the offenders, requiring them to pay for their own re-entry. However, to date no research study has examined the statutory language associated with registration fees collected post release from formal community sanctions. Using a statutory analysis within the United States, this research finds and quantifies the imposition of a registration fee on offenders who are legally compelled to pay these registration costs, regardless of whether they are still currently under community supervision. Results show that more than half of U.S. states (n?=?28) incorporate statutory language authorizing registration fees, ranging anywhere from $5 per registration to up to $250 per year. These findings, as well as suggestions for future research and policy recommendations, are discussed.     

Judges who drive under the influence of alcohol: ethical implications and the role of restorative justice measures to balance judicial duty and societal expectations

Judges across the US have been charged or convicted of driving while intoxicated, yet many judges are allowed to continue to practice despite their criminal act(s). The issue becomes not only a societal issue, but also an ethical and professional one which impacts the individual criminal justice practitioner and criminal justice agencies. Duty to judicial and social expectations informs an argument regarding ethical theories: deontology and utilitarianism. Solutions include an examination of restorative justice measures such as: a balance of service to the community such as participating in victim-offender mediation and victim-offender panels as the offender, and completing community service where the victim chooses the judges number of hours and location of the service. While some may believe these jurists should suffer punitive punishments such as loss of judgeships, long-term treatment, and extensive probation coupled with individual psychiatric therapy, consideration of all factors with restoration in mind, might be more appropriate for these judicial offenders.     

Adoption and Victorian culture

In 1888, evangelical, educator and feminist Constance Maynard adopted Effie Anthon, a six year old girl from a Salvation Army orphanage. Her mother, Rosabianca Fasulo was an unmarried, Italian woman recently “rescued” by the Salvation Army. Maynard anticipated that Effie would one day join her at her college but she met none of the expectations for her. She entered domestic service but fell ill with tuberculosis and died in a workhouse in 1915. This is one particular case history of an adoption when the practice was not yet formalized but small numbers began to adopt children unknown to them. It tentatively opens up the history of adoption in Victorian Britain. It also illuminates some broader questions about family ties, the meanings associated with motherhood, and how the body and character formation were understood.     

The identification of individuals by observational gait analysis using closed circuit television footage

This study investigated the ability of individuals with experience in gait analysis to identify people by observing features of gait recorded by closed circuit television cameras (CCTV). Seven experienced analysts each viewed five samples of footage. Each sample showed a “target walker” and five “suspect walkers.” The task of the experienced analysts was to determine which, if any, of the “suspect walkers” was the “target walker.” All of the participant “walkers” wore identical loose fitting clothing to mask anatomical and body contour features, and balaclavas to obscure facial features. The overall results showed that the experienced analysts made a correct decision in 124 of 175 cases (71%), significantly better than would have been expected to have occurred by chance (p < 0.05). A significant variation in correct decisions (p < 0.05) was shown to occur between the various angles from which the footage was recorded, footage recorded in the saggital plane showing the highest number of correct decisions. Significantly more correct decisions (p < 0.05) were also shown to occur when the footage of the “target walker” and that of the “suspect walker” were taken from the same angle. The results suggest that individuals with experience in gait analysis perform well in the comparative identification of suspects from CCTV footage, and therefore do have a role to play as expert witnesses in this field.     

Developing Countries and the Implementation of CITES: The Mexican Experience

A key issue for the success of international conventions regulating biodiversity conservation is to understand the different philosophical positions of each party for initially acceding to that convention, and for the measures each party takes to implement that convention. This paper documents policies for wildlife trade regulation in Mexico from the early 1980s to the early 2000s, with emphasis on the process of CITES implementation. Mexico was slow to adopt environmental policies, but when Mexico did recognize wider environmental concerns, the prospect of acceding to CITES was not considered because of existing bans on all wildlife trade in native species. However, Mexico could not control the illegal trade of wild species during the 1980s. Mexico acceded to CITES in 1991 mainly in response to international pressure and to bilateral pressure while seeking to join a free trade agreement. The step of joining CITES was taken without clear analysis about the consequences of being a party to the Convention. Between 1992 and 1996, Mexico had no clear policy about its role within CITES. The period from 1997 to 2001 witnessed an improved legal and administrative structure and a greater internal coordination between the institutions involved with CITES. Mexico has now improved its policy toward international wildlife trade.

Les relations de pouvoir façonnent le cours de l'existence du secteur pétrolier depuis la découverte et la commercialisation de l'or noir remontant au 19e siècle. Progressivement, quoique bien rapidement, cette substance devint le moteur de l'évolution économique mondiale toujours en vigueur. Étrangement, plusieurs études actuelles, que l'on rassemble sous la thèse de la malédiction des ressources (resource curse [RC]), semblent pourtant esquiver leur centralité à la compréhension de la paupérisation et des violences vécues chez les populations de certaines régions riches en ressources pétrolières. À travers la problématisation de la littérature analytique portant sur la RC appliquée à la situation chaotique de la région du delta du Niger au Nigéria et sa mise en relation avec les débats appréciatifs des pratiques de RSE (responsabilité sociale des entreprises), cet article démontre l'importance de prendre en compte l'ensemble des dimensions politiques du vécu de la RSE dans une réalité locale, nationale et internationale aux diverses ramifications "s'inter-constituant."
