Of Garbage Cans and Rulings: Judgments of the European Court of Justice in the EU Legislative Process

This article addresses the problem of how to explain the influence that rulings of the European Court of Justice (ECJ) have on the political decision-making of the EU. It will be argued that a framework developed by Kingdon which follows the garbage can model of Cohen, March and Olson is a good approach to conceptualising this influence. This framework explains political processes in terms of problems, solutions, participants and choice opportunities. In order to illustrate the argument, two famous rulings, Dassonville and Cassis de Dijon, are examined in detail. Both rulings dealt with the same subject but had different impacts on political decision-making. The difference in influence depended on the conditions of the political arena at the time the rulings were given and not on their legal contents.     

Estimating the degree of ethanol intoxication from analysis of cerebro-cranial hematomas

314 cases of combined cerebro-cranial trauma and posttraumatic intracranial hematomas were identified of which ethanol was detected in 114 hematomas. The other investigative group was 103 hospitalized patients who had hematomas evacuated during neurosurgical procedures. In 62 of these cases ethanol was detected. Blood and urine samples were also collected and the alcohol concentration was determined in all specimens by GC and ADH. The ethanol elimination rate for autopsy and operative intracranial hematomas was approximately 0.07–0.08‰/h(±0.034‰/h). The elimination rate of ethanol from blood (β₆₀) was about two or three times greater as that from hematomas. Because of the different water content of intracranial hematomas from blood, it was necessary to adjust the ethanol concentration for water content. On the basis of the corrected ethanol concentrations and the elimination rates for both tissues it was possible to estimate the ethanol concentration at the time of injury. Intracranial hematomas are tissues of possible value in the determination of alcohol intoxication especially in alcoholism. Ethanol can be found in hematomas even after 72 h from head injury.     

Vorschläge zur Errichtung einer nationalen Menschenrechtsinstitution in Österreich

Österreich hat im Hinblick auf seinen nationalen Grund- und Menschenrechtsschutz durch die 1920 geschaffene Zentralinstanz des Verfassungsgerichtshofs lange Zeit eine Vorreiterposition in Europa belegt. Inzwischen wird jedoch immer deutlicher, dass zur Erfüllung völkerrechtlicher Menschenrechtsverpflichtungen sowie eines umfassenden Grundrechtsschutzes auf nationaler Ebene – im Sinne der Trias "respect, protect, fulfill" – die nachprüfende gerichtliche Kontrolle allein unzureichend ist. Die Schaffung einer unabhängigen und pluralistischen nationalen Institution würde dem Prozess einer kontinuierlichen Verbesserung der normativen und faktischen Menschenrechtssituation am Besten zum Ziel gereichen. Das umfangreiche Mandat einer solchen Menschenrechtsinstitution soll neben der Beratungs- und Berichtsfunktion gegenüber Regierung, Gesetzgebung und anderen staatlichen Organen insbesondere eine breite Kontrollbefugnis betreffend die Maßnahmen von Sicherheitsexekutive, Justizwache und Militär umfassen. Mediatives Einschreiten sowie die Kooperation mit internationalen und Nichtregierungsorganisationen komplettieren gemeinsam mit menschenrechtlicher Bildungs- und Öffentlichkeitsarbeit, Forschung und Dokumentation die Hauptaufgaben der Institution. Seit der Weltmenschenrechtskonferenz 1993 in Wien besteht an der besonderen Bedeutung derartiger Einrichtungen kein Zweifel mehr; durch stetige Vorstöße internationaler Gremien, wie des Europarates und letztlich der Europäischen Union, erfährt die diesbezügliche Diskussion jetzt zusätzlichen Antrieb. Neben dem generellen, weltweiten Trend zur Errichtung nationaler Menschenrechtsinstitutionen stellen besonders die Entscheidung der EU, die in Wien ansässige Beobachtungsstelle für Rassismus und Fremdenfeindlichkeit (EUMC) ab März 2007 in eine Europäische Grundrechteagentur umzuwandeln, sowie Österreichs kurz bevorstehende Ratifizierung des Fakultativprotokolls zur UNO-Folterkonvention (OPCAT) unser Land vor die bedeutsame Aufgabe, endlich mit den zahlreichen europäischen Staaten gleichzuziehen, deren nicht-gerichtlicher Menschenrechtsschutz schon längst einer an den "Pariser Prinzipien 1993" orientierten, finanziell sowie organisatorisch unabhängigen Institution obliegt.     

The Evolution of Development Assistance

The form and objectives of development assistance have been evolving over the last decades. The objectives were determined by the changes of the development doctrines. In the late 1940s, the aid for recovery and reconstruction dominated in the world aid architecture. Then, donor countries supported state led initiatives and activities in recipient economies. Besides, foreign aid was directed to social sectors like education and health. In the 1980s and 1990s, donors provided aid for market reforms has arose in developing countries.     

Seeking Sustainable Solutions: Using an Attractor Simulation Platform for Teaching Multistakeholder Negotiation in Complex Cases

We live and work in an increasingly complex and dynamic world. The demands of working in such environments require that negotiators understand situations of conflict and work with these situations in correspondingly complex and dynamic ways. Dynamical systems theory offers important insights and tools to enhance the understanding of difficult social conflicts, including the conceptualization of ongoing destructive conflicts as strong attractors: a particular form of self-organization of multiple elements comprising the mental and social systems associated with conflict. This article describes the pedagogical use of a computer simulation of conflict attractors (the attractor software) that allows participants to visualize and work interactively with the dynamics of conflict as they unfold over time. It further describes a negotiation workshop that employs the simulation to enhance participants' understanding of complex long-term dynamics in conflict and presents the findings of two outcome studiescomparing the effectiveness of a workshop that employed the simulation with one that employed a traditional integrative problem-solving method. While not definitive, these studies suggest that an understanding of the dynamical approach to conflict, supported by use of the attractor software, can promote the generation of more sustainable solutions for long-term conflicts.     

Drunk drivers—Chances for and difficulties in giving medico-legal opinions on drivers’ alcohol intoxication levels, on the basis of the material analyzed in the Forensic Medicine Department, Medical University of Silesia, Katowice in the years 2003–2007

The authors have conducted a statistical analysis of 340 court files investigated in the Forensic Medicine Department Medical University of Silesia, Katowice in the years 2003–2007 with regard to chances for as well as difficulties in giving medico-legal opinions on drivers’ alcohol intoxication levels, which would be valid for court purposes.     

First amendment values and government participation in the marketplace,fifty years after the Hutchins report

The Hutchins Commission took a favorable view of government speech; Its report recommended that government act as a supplementary news source for the public. This article asserts that the commission was “fighting the last war” by focusing on government restraints on the press, while failing to propose limitations on the government's ability to circumvent the press. With the advent of new forms of telecommunications technology, the government might one day replace the private sector press as the public's primary source for news. This article asserts that the Supreme Court should recognize that the Press Clause of the First Amendment guarantees the existence of the private sector press as an independent, nongovernmental branch of our governance system. Based on a “separation of powers” view of Press Clause values, the article argues that the Court should create a First Amendment “right of reply” to any government dissemination of information to the American public in a manner that circumvents the traditional role of the private sector press.
