Legal duties of psychiatric patients

Psychiatric practice involves an implied contract in which each party fulfills a specialized role and incurs corresponding duties and obligations to be discharged as best able. Patients incur duties at three levels. First are specific duties that arise from patients' specialized role in their own health care: (1) to provide accurate and complete information, and (2) to cooperate with treatment within the bounds of informed consent. Second are general duties that apply to all citizens, but are especially relevant within the mental health context: (1) to respect the physical integrity of self, others, and property, and (2) to obey the law. The controversial "duty to protect" is at a third level, a transcendent duty that is specific to the context at hand, but in principle can apply to more than one party. Advantages of enforcing patients' duties include better care by treating professionals, optimum level of functioning of patients, and improved systems-wide morale and safety. Breach of patients' duty has many potential consequences in the forensic sphere: termination of care, malpractice defense, criminal prosecution, and tort liability. Complicating factors include the degree and effect of patients' psychiatric impairment, patients' legal status, and the role played by psychotherapeutic transference.     

Coalition formation on major policy dimensions: The Council of the European Union 1998 to 2004

Using data of contested decisions in the Council of the European Union, combined with data on the position of member states on the left-right and support for European integration dimensions, this paper provides an overview of winning coalitions formed in the council in the 1998 to 2004 time span. It shows distance between the combined policy positions of winning coalitions to individual EU states within these coalitions and demonstrates that most winning coalitions in the Council have a large combined voting weight, minimal winning coalitions are rare, and ideological connectedness plays a much smaller role than expected.     

The “Nanny”, the “Fighter,” and the “Puppet”: a Brief Political Biographical History of Carrie Lam Cheng Yuet-ngor Including the Earliest Days of Her Chief Executive Appointment

Carrie Lam Cheng Yuet-ngor has broken many ceilings as Hong Kong’s first female Chief Executive and the first post-Occupy Central leader. The mission of the political biographer is to contextualize Lam’s policies in the circumstances that she was put into and/or inherited from previous administrations without any value judgments (or highly minimized ones). The purpose is to recognize Lam as a complex entity characterized by a triad of images that include caring a senior civil servant, a tough-talking iron lady (nicknamed “The Fighter”) and a compliant Beijing loyalist (nicknamed “The Puppet” or “CY Leung 2.0”). The readers are the ultimate arbiters and evaluators of these narratives and perceptions to craft their own impression of Lam. The writing is organized into sections analyzing Lam’s family background, her rise in the civil service, her appointment as Chief Secretary, and her current tenure as the Chief Executive. The significance of this writing is an early assessment of Lam’s achievements and policy direction and a recount of her initiatives when she was Chief Secretary that can later be compared to post-administration retirement biographical writings for a full understanding of her political achievements and failures. Taken together, these accounts can then be a combined diachronic and synchronic historical biographical accounts of Lam.     

College Students’ Online Pornography Use: Contrasting General and Specific Structural Variables with Social Learning Variables

This research partially tests Akers’ social structure-social learning theory (SSSL). The data was collected online through a self-report questionnaire and nearly half (48.8%) of the sample of 812 college students reported visiting a porn site. To better understand this self-report behavior, bivariate correlations and three binary logistic regression analyses were conducted. In Model A, participants who were male, Hispanic, had more years in college, and more inclined toward homosexuality had an increased likelihood of visiting a porn site. In Model B, again, gender, ethnicity, year in school, and the sexuality scale were significant predictors. However, race appeared as significant for the first time along with number of sex partners, and frequency of masturbation, indicating that participants who were Black, had a greater number of sexual partners, and masturbated more frequently had an increased likelihood of visiting porn site. As with the first and second models, gender, race, sexuality scale, and frequency of masturbation were significant predictors in Model C. Additionally, differential peer association, differential reinforcement, and definitions favorable were significant, indicating that participants who had greater association with peers who viewed porn, who had observed someone watching porn and decided to mimic their behaviors, and who had defined visiting porn sites favorably had an increased likelihood of visiting a porn site. Overall, Akers’ SLT variables fully mediated ethnicity, year in school, and number of sex partners, but it only partially mediated gender, race, and sexuality scale.     

Reflections on law and impact in the light of Brexit

ABSTRACT

The impact agenda in academic research affords rich opportunities – to inform the media, policymakers and the general public; to co-produce research with third sector organisations. In the context of Brexit, the prevailing ignorance of politicians and other stakeholders has been so profound, and the falsehoods that have had popular purchase so baseless, as to make the need for impact and public engagement all the more acute. This is not simply about fact-checking, but about making the case for the very worth of expertise, and reasserting the basic, core scientific values that drive academic work – values that have been trashed by the precepts of a postmodern nihilism, in which all positions are equally (in)valid and only your own gut can be trusted. But challenging these precepts in public arenas has personal and professional costs: significant workload implications, the acquisition of new skills and often a torrent of abuse. As such, this work needs institutional support. Departments need to value it appropriately, to promote equal access to impact opportunities and to confront the discriminatory barriers to (and consequences of) taking up the impact gauntlet. Throughout the Brexit process, expertise and experts have been dismissed and denigrated. The task now is to restore public faith in the value of the pursuit of truth.     

FIFA/IOC‐Sanctioned Development and the Imminence of Erotic Space

Based on ethnographic research conducted since April 2014, this paper will examine the intersection between mega‐event security apparatuses, event‐led urbanism, and local geographies of desire. We argue that urban sanitisation strategies (particularly those derived from a constellation of foreign interests) threaten local geographies of desire but remain dependent upon erotic space and subjectivities in (trans)national exchange and everyday economic salvation. The erasure of sexual diversity is a case with which to examine the impact of FIFA/IOC‐sanctioned urban renewal, and the manner in which local bodies (particularly those deemed sexually ‘deviant’) are repeatedly forced to circumvent these globally determined processes of development.
