Civil wars are particularly destructive and asymmetric in nature. As a result, humanitarian crises and episodes of one-sided violence against civilians are likely to emerge. In the post-Cold War era, human rights norms have been strengthened by a global commitment stating that nations have a responsibility to protect people against war crimes. Although the doctrine does not require military responses, as episodes of one-sided violence increase dramatically in the midst of civil conflict, we would expect those cases to experience relatively swift foreign response, including military intervention; a growing trend of at least purportedly humanitarian interventions should be observable. Expectations relating to the responsibility to protect are tested on all civil conflicts occurring between 1989 and 2006. Findings indicate that there is little evidence that one-sided violence leads to military intervention, suggesting that the internationally community does not use its most powerful tool to protect civilians in trouble. 相似文献

In the era of mass incarceration, millions of American citizens have been disenfranchised by the social stigma of a felony conviction. Mentorship of formerly incarcerated (FI) students by FI academics—many of whom identify with Convict Criminology (CC)—is slowly forging a pathway out of the social wasteland of past felony convictions. A common goal of CC is to help FI students and academics overcome the social and structural barriers that severely limit their life chances, as well as those of millions of FI citizens in the world’s largest prison system. In this article, three FI criminology faculty members focus on the vital importance of mentorship presented through individual autoethnographic writings. We emphasize four prominent narratives or themes: (1) common narratives of the role of mentorship: encouragement, inclusion, and social capital; (2) differing narratives of the role of mentorship; (3) common narratives of the role of mentorship: experiences of mentoring as activism and advocacy; and (4) common narratives of the role of mentorship in reducing professional fragility. We also consider other dynamics that might emerge in the mentor–mentee relationship involving FI individuals, including the complexities of “coming out” as FI and the fragility of FI identity in the academic world. We conclude with recommendations for future research on the role of mentorship for FI individuals and make suggestions for other areas of study for CC, more generally.
This study explored the sense of community among women (n = 21) and women with children (n = 30) living in Oxford Houses, with emphasis on how the presence of children might affect the household. Sense of community did not vary between participants with more or less than three months residence. Residents reported very high levels of satisfaction with the home, possibly because of a ceiling effect of little room for increases in their sense of community over time. Participants reported that they were getting along with the children in the home, that mothers could count on babysitting help, and that the children had a positive effect on the household and their own recovery process. This effect did not differ between mothers and non-mothers, suggesting that non-mothers might view the children in the home with a sense of responsibility and sensitivity comparable to that of the mothers. In this paper, we review the result of research conducted in the context of a 13-year collaborative partnership between DePaul University and a community-based, self-run, residential substance abuse recovery program called Oxford House. This collaborative effort highlights several examples of the research and action activities fostering a positive alliance that benefited both the research team and the Oxford House community. It also proposed practical guidelines for developing effective action research collaboratives that may be helpful to others who desire to cultivate and maintain similar mutually beneficial partnerships; including such processes as the development of trust, respecting the personal experiences of the community members and group, commitment to serving the community, validating findings with organization members, and accountability. 相似文献
Bernie Mayer's latest book is an excellent journey into seven key dilemmas in conflict. Mayer devotes a chapter to each of the following dilemmas: Competition and Cooperation, Optimism and Realism, Avoidance and Engagement, Principle and Compromise, Emotions and Logic, Impartiality and Advocacy, and Autonomy and Community. In this review, I suggest that the book is a thorough guide through seemingly diverse and opposing conflict theories. I go through each chapter and detail how Mayer sees these concepts as interwoven instead of oppositional. He walks his readers through what have been thought of as distinctive, even opposing, approaches, theories, and concepts of conflict. The review uses points and quotes from all seven dilemmas to show the depth of Mayer's analysis and the numerous benefits to theorists and practitioners of reading and rereading his book. 相似文献
The concept of “moral exclusion” has often been used to understand harm-doing. The present studies examined two, distinct
meanings that have been ascribed to this concept. First, exclusion has sometimes been conceptualized as the belief that moral
principles do not apply to a target person or group (e.g., exclusion from the application of justice principles). Second,
the term has been used to refer to exclusion from positive treatment that is accorded to others, which the actors believe
to be morally justified, though outside observers do not. Distinguishing between these two meanings can clarify the mechanisms
underlying the relation between proposed antecedents to exclusion and harm-doing. In two experiments, we obtained evidence
compatible with each of these conceptualizations of exclusion, as well as preliminary evidence that certain antecedents are
more likely to lead to processes indicative of one or the other conceptualization. Our findings have practical implications
for the reduction of harm-doing as well as for conflict that might arise in such attempts. 相似文献
Courts have increasingly looked to the concept of “transformative use” to determine whether the use of a copyrighted work is protected under the fair use doctrine. Judge Pierre Leval's definition of transformative use, adopted by the Supreme Court of the United States in its 1994 opinion in Campbell v. Acuff-Rose Music, Inc., requires that a transformative use must (1) be socially beneficial, (2) be used in a different way or purpose from the original, and (3) add value to the original by using it as raw material to create something new. This article examines the fair use analysis undertaken by the United States Court of Appeals for the Ninth Circuit in two recent cases involving visual search engines and concludes that the court's test of transformative use ignored the language and the meaning of the Campbell definition and instead equated a finding of a different purpose with a finding of a transformative use. This departure from traditional transformative use analysis, if generally adopted by the court, would represent a significant and potentially troubling doctrinal shift in fair use analysis. 相似文献
