It is well understood that the exchange of information between horizontal competitors can violate competition law provisions in both the European Union (EU) and the United States, namely, article 101 of the Treaty on the Functioning of the European Union and section 1 of the Sherman Act. However, despite ostensible similarities between EU and U.S. antitrust law concerning interfirm information exchange, substantial differences remain. In this article, we make a normative argument for the U.S. antitrust regime's approach, on the basis that the United States’ approach to information exchange is likely to be more efficient than the relevant approach under the EU competition regime. Using economic theories of harm concerning information exchange to understand the imposition of liability in relation to “stand-alone” instances of information exchange, we argue that such liability must be grounded on the conception of a prophylactic rule. We characterize this rule as a form of ex ante regulation and explain why it has no ex post counterpart in antitrust law. In contrast to the U.S. antitrust regime, we argue that the implementation of such a rule pursuant to EU competition law leads to higher error costs without a significant reduction in regulatory costs. As a majority of jurisdictions have competition law regimes that resemble EU competition law more closely than U.S. antitrust law, our thesis has important implications for competition regimes around the world.  相似文献

Although multiracial individuals are the fastest growing population in the United States, research on the identity development of multiracial adolescents remains scant. This study explores the relationship between ethnic identity, its components (affirmation, exploration), and mental health outcomes (anxiety, depressive symptoms) within the contexts of schools for multiracial adolescents. The participants were multiracial and monoracial minority and majority high school students (n = 4,766; 54.6 % female). Among the participants, 88.1 % were Caucasian, 7.4 % were African American, and 4.5 % were multiracial. The research questions examined the relationship between ethnic identity exploration and affirmation on mental health outcomes and explored the role school context plays in this relationship. The findings suggested that multiracial youth experience more exploration and less affirmation than African Americans, but more than Caucasians. In addition, multiracial youth were found to have higher levels of mental health issues than their monoracial minority and majority peers. Specifically, multiracial youth had higher levels of depressive symptoms than their African American and Caucasian counterparts. Multiracial and Caucasian youth had similar levels of anxiety but these levels were significantly higher than African Americans. School diversity did not influence mental health outcomes for multiracial youth. These findings provide insight into the experiences of multiracial youth and underscore the importance of further investigating factors that contribute to their mental health outcomes.  相似文献

The study explores the impact of a procedural innovation on justice judgments made by third party observers. The innovation involved the establishment of a review panel with civilian participants to monitor a police department's investigation of allegations of misconduct against its officers. The study distinguishes the impact on racial minority observers from that on racial majority observers. As is clear from the historiography of the US decision to use the atomic bomb on Hiroshima, the judgments of historians are relative to the time, place, and perspective from which they are writing. There are four major schools of historical interpretation of the decision. First is the orthodox view that was offered by the participants in the decision. Second is the revisionist view of historians writing during the era of the Vietnam war who adopted a much more critical interpretation. Third is an interpretive school that gives weight to the Japanese role and responsibility. Finally, the author's view is found in a more long-range perspective that finds the momentum created by President Roosevelt's unconditional surrender policy as the decisive factor. This policy provoked unconditional resistance in the Japanese military. By 1945 the legacy of Roosevelt's policy was firmly embedded in American public opinion.
