The Process of Leaving an Abusive Relationship: The Role of Risk Assessments and Decision-Certainty

Seventy female residents of an urban domestic violence shelter were interviewed to examine a series of hypotheses concerning two factors relevant to the process of leaving an abusive relationship: risk assessments and decision-certainty. Participants' subjective estimates of their own risk of returning to the batterer were examined relative to their perceptions of the likelihood that most battered women will return to the batterer, their certainty regarding the decision to leave the batterer, and their status on known risk factors for returning to an abusive relationship. As hypothesized, battered women's perceptions of personal risk for returning to the batterer were biased by unrealistic optimism; specifically, personal risk was estimated as significantly lower than the risk of most battered women and was not correlated with actual risk factors. Further, the magnitude of the optimistic bias was significantly greater among women expressing high certainty about their decision to leave than among women who expressed less certainty. The clinical implications of these findings are discussed.     

Examining international responses to illicit arms trafficking

Concerns about illicit trafficking in small arms andlight weapons have moved rapidly up the internationalagenda since 1996. Within about three years a rangeof international responses to this problem, and to theclosely related issue of small arms proliferation,have developed at sub-regional, regional andinternational level – in Africa, Europe and theAmericas as well as globally. This article examinesthe development and design of each of the maininitiatives in this issue area. It analyses thedifferent ways in which the problems have been framedin each agreement or programme, and the significanceof linkages between them. These recent developmentsare judged to be substantial. Despite the regional andinstitutional variations, the shared normative andprogrammatic elements appear to be sufficient tosupport the development of winning global coalitions– able to establish a co-ordinated internationalaction programme even if not actually to preventillicit trafficking in the foreseeable future.     

Foreign fame is not enough to confer US trade mark rights

On appeal from the Southern District of New York, the SecondCircuit affirmed the award of summary judgment against ITC'strade mark infringement, unfair competition, and false advertisingclaims under state and federal law, holding that the famousmarks doctrine was not incorporated by Congress into the LanhamAct and thus not a federally protected right.     

When the Line is Crossed... Paths to Control and Sanction Behaviour Necessitating a State Reaction

This article provides an overview of the various forms of proceedings available within 11 European criminal justice systems and reflects upon their core features. It also provides a picture of how far alternative, non-criminal proceedings are used by some of the systems as a different path to imposing a state reaction upon wrong-doers.     

Court improvement of foster care and adoption projects:Ncjfcj Survey Report

Officials from 48 states and the District of Columbia in 1994 accepted federal funding from the U.S. Department of Health and Human Services to help improve courts' handling of cases involving child abuse, neglect, foster care and adoption. Through a survey of participating states, members of the National Council of Juvenile and Family Court Judges have been analyzing common themes found in state Court Improvement of Foster Care and Adoption Projects. This article examines key survey results.
