Some technological implications for ascertaining the contents of contracts in web-based transactions

This paper points out some unexpected relationships between specific aspects of contract law and specific Internet-related technologies. The discussion is not about the interplay between “Law” and “Technology,” or the “Law” and the “Internet.” The aim is modest: to identify some theoretical chokepoints created by the technologies involved in web-based commerce and to point out the legal uncertainties persisting in this area. The analysis is confined to the process of contract formation, not to matters of substantive law. It is during this process that parties assume their contractual obligations and the contents of a contract crystallize.     

Trust in Politicians and Satisfaction with Government – A Reciprocal Causation Approach for European Countries

Trust and satisfaction with the government are the most important indicators of a functioning democratic system. Scholars diverge in their opinions of whether satisfaction causes trust or vice versa or whether both variables reinforce each other simultaneously. This study applies an instrumental variable approach to shed light on this discussion. We employ a sample of 7166 individuals in 3 European countries (i.e., Germany, France, and Great Britain) obtained from the European Social Survey to test this reciprocal relationship. By comparing these three countries with fundamentally different political systems, we investigate the contingency of the reciprocal effect with regard to the political context. The results confirm the reciprocal relationship but reveal differences between the three investigated countries.     

The Rise of Policy Institutes in the United States, 1943-1971

In the period after World War II, an eclectic assortment of scholars, policymakers, and managers presided over the creation of academic centers for the study of war. This article examines the intellectual and administrative assumptions of many of these actors. Made up of academic scholars from the fields of political science, sociology, and economics, they advanced a vision based on what might be called “instrumentalist-positivist social science,” but in appeals to donors they employed basic scientific language.¹     

The consequences of midnight regulations and other surges in regulatory activity

Is the midnight regulations phenomenon real and what are its consequences? This paper finds that when an administration??s time is almost up, submissions of economically significant regulations nearly double. Such surges in regulatory activity decrease the duration of regulatory review at the Office of Information and Regulatory Affairs (OIRA), likely because of political pressure to quickly approve new rules. Specifically, one additional economically significant regulation submitted to OIRA decreases the mean review time for all regulations by about two thirds of a day. If OIRA review improves regulation quality, then regulatory surges that decrease review time could hinder such improvement.
