Governing bodies have significant autonomy in the organisation of professional sport in the EU, a situation now supported by Article 165 TFEU. However the post‐Lisbon competence for sport does not grant any exemption for practices that infringe fundamental freedoms or competition law; such infringements can only be justified where they are a proportionate response to an inherent need in that sport. The football ‘transfer system’ has been the subject of a series of EU law challenges, but continues to place obstacles in the way of the free movement of players between Member States and may restrict the ability of most clubs to compete for the elite players. Court of Arbitration for Sport decisions in transfer dispute cases have entrenched this situation, and recent evidence casts doubt on both the ability of the authorities to justify the current system and the 2001 decision by the European Commission to sign it off as being an acceptable balance between the rights of the stakeholders.  相似文献

A program to apply Early Neutral Evaluation (ENE), a confidential, settlement‐oriented and accelerated alternative dispute resolution technique, to child custody and parenting time cases has been cooperatively developed by Hennepin county Family Court Services and the Minnesota Fourth Judicial District Family Court. Parties are referred by the court to a male/female team of experienced neutral evaluators for early feedback on the probable outcome of a full evaluation and an opportunity to negotiate a settlement. It has proven to be a highly successful program in its first 2 years, with the majority of cases reaching an early settlement. The ENE program reduces the stress and expense of custody disputes for clients, expedites judicial case management, maximizes Family Court Services staff efficiency, and focuses subsequent evaluations on critical issues.  相似文献

Is there a relationship between legislators’ religious affiliations and the consistency of their voting records? Building on the theory of “the personal roots of representation,” we argue that a legislator's likelihood of switching positions depends on whether the issue is central to their personal values. We evaluate this claim using a data set including senators’ religious affiliations and “culture war” votes from 1976 to 2004 and find that different religious groups vary in their voting consistency on issues such as abortion, public prayer, and gay and lesbian rights.  相似文献

Within the Australian democratic nation there are towns where the citizens are governed by administrations that have not been democratically elected by the residents. These unique residential centres are termed ‘special purpose towns’ that can be transformed to a permanent community governed by a democratic structure through a process termed normalisation. This paper examines the special purpose mining town of Nhulunbuy in the Northern Territory of Australia, which is on the cusp of the normalisation process. The paper outlines the similarities and differences of local government roles and responsibilities with Australian towns or shires that have publicly elected executive members. How Indigenous people are facilitating the normalisation of Nhulunbuy, through cultural perceptions of opportunity, is discussed. A concluding focus challenges well established conventional frameworks endorsing the roles of governments and miners in the normalisation phenomenon.  相似文献

The combination of knowledge and innovation has become a cornerstone among knowledge and labour intensive enterprises. A growing number of enterprises are defined as knowledge intensive entrepreneurship ventures that have been widely studied in relation to their eco-system. However only few research have addressed this phenomenon to enterprises digital eco-system by adopting mainly a qualitatively approach. We point out that the relevance of the digital eco-system focusing on the role of social networking sites in relationship to innovation and knowledge. The use of social networking sites can provide a wealth of information about individuals and their networks, which can be utilised for various business purposes. It enables enterprises to create online communities and share user-created content. Within this context, enterprises actively interact with external actors such as customers, public institutions, and other businesses to acquire and absorb external knowledge, and then generate innovation. To gain insights from the global economy, 215 small to medium enterprises from different sets of global enterprises, both knowledge-intensive (e.g. management consulting, marketing and advertising, ICT and related services, legal and technical services) and labour-intensive (such as high tech and electronics, food and beverage, and consumer durables), were analysed. Via the Partial Least Square-Path Modelling the relationships between social networking sites, absorptive capacity, and innovation performance were measured. Therefore, recommendations are proffered as to what small-medium enterprises should do in order to enhance their innovativeness. The research ends with conclusions and implications to both scholars and practitioners.  相似文献

A holistic learning approach to organisational capacity building with Cambodian NGOs produced impressive results in some organisations and important learning about blocks to change in others. The approach clearly demonstrates that moving beyond traditional training and organisational development interventions and into processes that promote learning and its integration into everyday work practices has positive and lasting impacts. Organisations willing to engage with the learning approach found that both individuals and the whole organisation were able to function more effectively, and that this contributed to sustainability and resilience. The approach also produced important lessons about organisational readiness to embrace learning and change.

Intégrer l'apprentissage dans le développement des capacités organisationnelles des ONG cambodgiennes

Une approche holistique (globale) de l'apprentissage en matière de développement des capacités organisationnelles avec des ONG cambodgiennes a produit des résultats impressionnants dans certaines organisations et donné lieu à d'importantes leçons sur les entraves aux changements dans d'autres. Cette approche démontre clairement que le fait d'aller au-delà des interventions traditionnelles de formation et de développement organisationnel pour entreprendre des processus qui promeuvent l'apprentissage et son intégration dans les pratiques de travail quotidiennes a des impacts positifs et durables. Les organisations disposées à adopter l'approche d'apprentissage ont constaté que tant les individus que l'organisation dans son ensemble étaient en mesure de fonctionner plus efficacement et que cela contribuait à la durabilité et à la résilience. Cette approche a aussi produit des enseignements importants sur la bonne disposition des organisations à embrasser l'apprentissage et les changements.

Integrando aprendizado no desenvolvimento da capacidade organizacional de ONGs cambojanas

Uma abordagem de aprendizado holística para a capacitação organizacional com ONGs cambojanas produziu resultados surpreendentes em algumas organizações e um importante aprendizado sobre obstáculos a serem superados em outras. A abordagem demonstra claramente que ir além dos tradicionais treinamentos e intervenções para o desenvolvimento organizacional e incorporar processos que promovam o aprendizado e sua integração em práticas de trabalho diárias promovem impactos positivos e duradouros. Organizações que desejavam engajar-se com a abordagem de aprendizado constataram que tanto os indivíduos quanto a organização como um todo eram capazes de atuar mais efetivamente e que isto contribuía para a sustentabilidade e resiliência. A abordagem também extraiu lições importantes sobre a preparação organizacional para incorporar aprendizado e mudança.

Incorporar nuevos aprendizajes al desarrollo de capacidades organizacionales en ONG de Camboya

En Camboya se aplicó un método de aprendizaje integral para la construcción de capacidades institucionales en ONG que produjo importantes resultados en algunas organizaciones y proporcionó datos relevantes sobre los obstáculos que impiden los avances en otras. Este método muestra con claridad que si se va más allá de las acciones habituales de capacitación y de desarrollo institucional y se abordan procesos que promuevan el aprendizaje integrándolos en el trabajo cotidiano, se pueden obtener resultados positivos y duraderos. Las organizaciones que se mostraron dispuestas a incorporar este método de aprendizaje consiguieron mejores resultados en el trabajo tanto de los individuos como de la organización y aumentó su sustentabilidad y flexibilidad. El método también generó importantes datos sobre la predisposición de las organizaciones a incorporar el aprendizaje y el cambio.  相似文献

After uprooting Saddam Hussein from power, establishing democracy in Iraq has been declared among the most important objectives of the U.S.-led Coalition. However, the Coalition has encountered complex ethnic and religious relations and resentment of foreign intervention in Iraq. These reactions reflect decades, even centuries, of divisive and antagonistic policies whose impacts continue to complicate and threaten coexistence and civil peace. The immediate challenge of achieving stability and peace in Iraq, therefore, rests in the ability to foster a genuinely indigenous institutional political structure that can accommodate the different ethnic and sectarian aspirations. This article highlights the major potential shortcomings of the federal model established by the "Law of Administration for the State of Iraq for The Transitional Period." It also examines the shortcomings of the List Proportional Representation system as presented by the United Nations for Iraq's transition, and alternatively proposes national electoral reform strategies, with the implementation of an Alternative Vote system with Minority Provision in the election to the National Assembly, as a means to strengthen Iraq's national unity.  相似文献

Forensic value of 14 novel STRs on the human Y chromosome   总被引:29,自引:0,他引:29  
We identified and characterized 14 novel short-tandem-repeats (STRs) on the Y chromosome and typed them in two samples, a globally diverse panel of 73 cell lines, and 148 individuals from a European-American population. These Y-STRs include eight tetranucleotide repeats (DYS449, DYS453, DYS454, DYS455, DYS456, DYS458, DYS459, and DYS464), five pentanucleotide repeats (DYS446, DYS447, DYS450, DYS452, and DYS463), and one hexanucleotide repeat (DYS448). Sequence data were obtained to designate a repeat number nomenclature. The gene diversities of an additional 22 Y-STRs, including the most commonly used in forensic databases, were directly compared in the cell line DNAs. Six of the 10 most polymorphic markers include the newly identified Y-STRs. Furthermore, these novel Y-STRs greatly improved the resolution of paternal lineages, above the level obtained with commonly used Y-STRs, in the European-American population.  相似文献
