Computer Generated Exhibits (CGE) are frequently deployed in legal contexts under the rubric of demonstrative evidence, i.e. to facilitate juror comprehension. However, a number of legal and academic commentators have suggested that the nature of the computerised moving image could exert undue prejudice on decision makers, e.g. judge and/or jury. The current study aimed to assess the manipulation of vehicle characteristics (make and colour) when a road traffic accident was presented in the format of a computer generated animation (CGA). In experiment 1, two groups of subjects watched two different makes of car, a Range Rover Sport and a Volkswagen Touran in a black-and-white format; no significant differences emerged over vehicle model with regards to vehicle speed or overall responsibility for the accident. Experiment 2 presented the same vehicles to four groups of participants in full colour, with the cars in contrasting red or beige; significant differences emerged with regards to culpability for vehicle make only. The findings could have implications for the format and style of CGE used in legal settings. 相似文献

This paper examines the performance of state owned enterprises (SOEs) in Ireland over the period 1988-92. However, unlike previous studies the performance of Irish public enterprise is examined in terms of the performance of other firms operating in the same sectors albeit based in the UK. While Irish SOEs exhibit lower rates of return on capital employed, it is found that there were significant improvements in labour productivity, relative to UK counterparts. This is attributable to the substantial increase in capital utilisation by Irish public enterprises. Given that average employment was maintained the net effect is a substantial increase in the capital-labour ratio of the sector. 相似文献

AbstractThis article employs the concepts of structural power and structural violence to a undertake critical study of China’s use of economic statecraft toward Kyrgyzstan. The article argues that China’s reliance on economic exchange to secure its strategic ends in Kyrgyzstan has resulted in asymmetric economic exchange between the two states. Through this asymmetric exchange, China has gained influence over Kyrgyzstan’s domestic structures. Chinese structural power, in turn, contributes to violence across Kyrgyzstan’s structures of economy, environment, and society and within the country’s state-society relations. Structural violence within Kyrgyzstan also results in periphery instability and domestic insecurity for China. As such, the article argues that China’s use of economic statecraft to achieve its strategic aims in Kyrgyzstan is self-defeating. 相似文献

One hundred and seventy five undergraduates (105 females) read a fictional criminal trial summary of a parricide case in which the juvenile defendant alleged sexual abuse or physical abuse or did not allege abuse. An allegation of either type of abuse led to a greater likelihood of a manslaughter conviction than a murder conviction and greater pro-child ratings (e.g., sympathy toward the defendant) compared to no abuse allegations. Specific evaluations of the defendant mediated the verdict results. In addition, there was no support for the claim that perceptions are more heinous for sexual abuse than physical abuse allegations and only limited support that perceptions for this type of case result in women being more pro-child defendant than men. Are election outcomes driven by events beyond the control of politicians? Democratic accountability requires that voters make reasonable evaluations of incumbents. Although natural disasters are beyond human control, the response to these events is the responsibility of elected officials. In a county‐level analysis of gubernatorial and presidential elections from 1970 to 2006, we examine the effects of weather events and governmental responses. We find that electorates punish presidents and governors for severe weather damage. However, we find that these effects are dwarfed by the response of attentive electorates to the actions of their officials. When the president rejects a request by the governor for federal assistance, the president is punished and the governor is rewarded at the polls. The electorate is able to separate random events from governmental responses and attribute actions based on the defined roles of these two politicians. 相似文献

This paper examines the incidence and nature of secondary victimizations (attempted and completed physical assault, sexual assault, and robbery) in a population of missing children (nonfamily abducted, family abducted, runaway/thrownaway, general/benign missing). Using data from the NISMART-2 studies, the following questions are addressed: How much secondary criminal victimization of children occurs in the context of missing children events, and what is the nature of this victimization? Are some categories/ types of missing children event more likely to result in secondary victimization than others? Is the risk for secondary victimization greater for some missing children than others (e.g., are age or race factors)?
