A significant body of literature has examined racial and ethnic inequalities in sentencing, focusing on how individual court actors make decisions, but fewer scholars have examined whether disparities are institutionalized through legal case factors. After finding racial and ethnic inequalities in pretrial detention, conviction, and incarceration based on 4 years of felony court data (N = 83,924) from Miami-Dade County, we estimate nonlinear decomposition models to examine how much of the inequalities are explained by differences in criminal history, charging, and for conviction and incarceration, pretrial detention. Results suggest that inequality is greatest between White non-Latinos and Black Latinos, followed by White non-Latinos and Black non-Latinos, ranging from 4 to more than 8 percentage points difference in the probability of pretrial detention, 7–13 points difference in conviction, 5–6 points in prison, and 4–10 points difference in jail. We find few differences between White non-Latinos and White Latinos. Between half and three-quarters of the inequality in pretrial detention, conviction, and prison sentences between White non-Latino and Black people is explained through legal case factors. Our findings indicate that inequality is, in part, institutionalized through legal case factors, suggesting these factors are not “race neutral” but instead racialized and contribute to inequalities in court outcomes.  相似文献

The emergence of a more elusive and uncertain threat environment has transformed the nature of intelligence, increasing its reliance on civil society partners. Once the work of an insular and carefully select few, intelligence production is now a networked, partially open and extensively public–private enterprise. Most poignantly, new practices of public–private ‘collection’ face Western intelligence services with novel questions about control and accountability – questions to which the services have responded with hopes that by standardizing ‘methodologies’, central command may be retained. Suggesting a more complex picture, this article argues that ‘managing uncertainty’ imply forms of interpretation and choices which cannot be pre-empted by rule-regulation: more than Weber’s ideal of the procedural and rule-bound, it may be his (once central, yet largely marginalized) emphasis on institutional and individual capacities for critical ‘judgment’ that is of relevance today.  相似文献

Am 22.9.2006 legte die Kommission der Europ?ischen Gemeinschaften einen Vorschlag für eine Richtlinie zur Schaffung eines Ordnungsrahmens für den Bodenschutz und zur ?nderung der Richtlinie 2004/35/EG vor. Bereits der Titel zeigt einerseits, dass dieser Entwurf einer Bodenrahmenrichtlinie (BRRL-E) zwar den lange erwarteten Einbezug des Mediums Boden in das europ?ische Umweltschutzrecht endgültig ansto?en würde, andererseits, dass der Boden kein europarechtlich v?llig ungeregeltes Umweltmedium darstellt. Bei der durch den Vorschlag zu ?ndernden Richtlinie 2004/35/EG handelt es sich um die Umwelthaftungsrichtline (UH-RL). Mit dieser ist durch den Einbezug einer Sch?digung des Bodens in den Begriff des Umweltschadens bereits ein gro?er Schritt in Richtung eines zielgerichteten europ?ischen Bodenschutzes getan worden. Der nachfolgende Beitrag stellt ausgehend von einem Kurzüberblick zu den bislang bestehenden Regeln zum Schutz des Bodens im europ?ischen Umweltrecht (I.) zun?chst den Bodenschutz nach der Umwelthaftungsrichtlinie dar (II.), um im Anschluss den Vorschlag der Bodenrahmenrichtlinie vorzustellen (III.). Im Teil IV. wird das Bodenschutzrecht nach der UH-RL und dem BRRL-E betrachtet, dabei zeigen sich sowohl unterschiedliche Ans?tze der Regelwerke als auch ein Fortschritt des zielgerichteten Bodenschutzes auf europ?ischer Ebene.  相似文献

Decentralized regulation has become increasingly important in many areas; examples range from school vouchers to workplace safety committees to alternative dispute resolution procedures replacing courts. Consistent with this trend, in 1993 California permitted construction unions and employers to “carve out” their own workers' compensation system. This study examines California's early experience with carve‐outs by analyzing two case studies, a survey of all carve‐outs in existence during the study period, and preliminary data on costs and dispute frequency at one carve‐out. Overall, carve‐outs do not appear to harm employees, and sometimes they help. At the same time, data analysis of one carve‐out showed it had no effect on costs and dispute rates. Moreover, the low involvement of union officials and the many issues that overlap other parts of workplace regulation raise concerns about decentralizing workers' compensation. The Clean Development Mechanism (CDM) allows industrialised countries to use credits from greenhouse gas abatement projects in developing countries in order to fulfil their own emission reduction commitments. There has been mounting evidence that the CDM’s ability to fulfil its goals as stipulated by the Kyoto Protocol—contributing to the sustainable development of the host countries and delivering real, measurable and additional emission reductions—is less than satisfactory. In this article, an evaluation is made of CDM projects’ likelihood of being additional by assessing the impact Certified Emission Reductions have on the Internal Rate of Return of the individual projects. In addition, the projects’ sustainable development benefits are assessed by using a multi-criteria analysis. In a final step, the relationship between the projects’ additionality and sustainability contribution is assessed and a trade-off between these two CDM goals is established, revealing a potential inherent conflict in how the current mechanism works. The analysis is based on a systematic evaluation of 40 registered CDM projects in India.  相似文献

In an effort to prevent some of the well-documented problems that occur in children and families undergoing divorce, a parent education program, Helping children Succeed After Divorce, was developed and mandated by a domestic relations court in a major metropolitan area. The purpose of the parent seminar is to educate divorcing parents about the effects of divorce and continued conflict on their children and to specify concrete actions that divorcing parents can take to help their children. The seminar's intent is to prevent long-term emotional, social, and academic problems among children of divorce. This article addresses the development, operation, and preliminary evaluation results of this psychoeducational program for divorcing parents.  相似文献

A 68-year-old man with known coronary heart disease experienced rapidly progressive cardiac dysfunction and was found to have occult cardiac amyloidosis at autopsy. The amyloidosis was undiagnosed during life and initially at autopsy. Marked diffuse involvement of the intramural coronary arteries by amyloid deposits resulted in severe luminal compromise of numerous medium and small vessels. The myocardium proper was virtually spared from amyloid deposits. Amyloid-related coronary narrowing contributed to cardiac ischemia and sudden death. The significance of amyloid coronary disease in this patient relates primarily to the difficulty in considering the diagnosis when other reasons for cardiac signs and symptoms preexist. Also, the adverse effects of amyloid coronary disease may be profound without direct myocardial involvement.  相似文献
