This article examines the confluence of forces at work to shape U.S. policy toward Cuba since the late 1990s. Our approach examines four key factors involved in policymaking toward Cuba in this period: (1) the entry of new interest groups into the Cuba policy process and an "entrepreneurial" Congress; (2) the executive's constitutionally based interests; (3) bureaucratic interests; and (4) pressure from outside the United States. We examine U.S.–Cuba policy by describing each determinant in isolation and then by looking at the dynamic interaction among them, showing how they are linked together. In doing so, we argue that an analysis including multiple factors better explains U.S. policy toward Cuba than one that focuses on a single factor such as the power of the Cuban-American community.  相似文献

Although 'Law in Context' is a well-known motto for law-and-society scholarship, the idea could benefit from closer examination. This paper introduces a principle of `fidelity to context' and suggests that contexts may be transcended by invoking general purposes and principles. These issues have special relevance for contextual analysis of free speech, academic freedom, and other rights and responsibilities. I also consider the relevance of legal pluralism, and the contextual analysis of human rights.  相似文献

Under the policy of direct certification for free school meals, school districts use information shared by state agencies about household eligibility for means‐tested programs in the state in order to determine the potential eligibility for free meals of students enrolled in the district. This information allows districts to automatically approve students in these eligible households for free meals without requiring the household to complete the application process. This paper examines the impacts of direct certification on students' likelihood of becoming certified for free meals, using data from a national survey of school food service directors as well as statelevel administrative data on program participation. A state‐level fixed effects model is estimated to account for the possibility of selection bias. The key finding is that direct certification leads to a statistically significant increase in the number of children getting free school meals. More generally, this finding highlights a promising approach for improving access to means‐tested programs without compromising program integrity. © 2008 by the Association for Public Policy Analysis and Management.  相似文献

The bulk and surface refractive indices have been measured for 20 float window glasses, 20 non-float window glasses, 20 patterned window glasses and 20 toughened float windscreen glasses.The refractive index of the tin-contact surface of the float glasses was always greater than that of the bulk, typically by 0.002 (range 0.00053–0.00307). In contrast the refractive indices of the two surfaces and the bulk of the sheet window glasses were in agreement within accepted experimental error in each case. A number of patterned window glasses showed significantly different refractive indices between the plain and patterned surfaces, the largest difference obtained (0.00021) being an order of magnitude smaller than that found for a typical float glass.Nine of the 40 float glasses examined yielded abnormal fragments from the upper surface in the sense that they did not disappear at the match temperature of the bulk glass. The refractive index measured from these abnormal fragments for two of these glasses was lower than the refractive index from the bulk glass.The variation in the bulk refractive index for the sheet and float window glasses produced an estimated standard deviation (E.S.D.) of 1.2 × 10?5. However, the patterned glasses were nearly three times as variable (E.S.D. = 3.3 × 10?5) and the toughened float glasses were, on average, almost seven times as variable (E.S.D. = 8.0 × 10?5).The value of making surface as well as bulk refractive index measurements in routine casework is discussed in the light of the above results.  相似文献
