This essay offers a brief account of the rise of cls thought in the United States and of its development within a largely hostile legal academy. As the essay suggests, cls thought has been variously deformed, arrested, normalized, and diffused – leaving the contemporary American legal academy in a state of suspended animation. This revised version was published online in July 2006 with corrections to the Cover Date.     

Positive Resolution of Childhood Sexual Abuse Experiences: The Role of Coping,Benefit-Finding and Meaning-Making

Resolution of the trauma of childhood sexual abuse (CSA), and the current adjustment of 60 adult female CSA survivors were explored through qualitative and quantitative analyses of their coping strategies, perceived benefits, and meaning-making attempts. While the majority of the women (87%) perceived at least some benefit resulting from coping with the CSA experience, many (29%) found it impossible to make any meaning of their trauma. Specific benefits that were associated with various aspects of positive adjustment (marital satisfaction, better physical health, less isolation) included improved relationships with others, religious or spiritual growth, and improved parenting skills. Some perceived benefits were actually associated with a negative outcome. Increased knowledge of sexual abuse was associated with more isolation and lower marital satisfaction. When positive meaning could be derived from the coping process, the women reported less isolation. Avoidant coping was strongly associated with more depressive symptoms and poorer resolution of abuse issues. Results highlight the importance of considering coping strategies and cognitive restructuring efforts in designing therapeutic interventions with this population. Bodenschutz außerhalb der Bodenschutzgesetze – der Beitrag des Naturschutzrechts

Den Gründer und langj?hrigen Hauptschriftleiter Claus Carlsen hat seit vielen Jahren das Naturschutzrecht in all seinen Facetten interessiert. Der Gegenstand des Naturschutzrechts, der nach der subjektiven Beobachtung des Verfassers dieser Zeilen als Hauptgegenstand des Naturschutzrechts betrachtet zu werden scheint, ist der Schutz, die Pflege, die Entwicklung und die Wiederherstellung der Tier- und Pflanzenwelt, § 1 Nr. 3 BNatSchG. Dieser Beitrag m?chte den Blick auf ein anderes Ziel des Naturschutzes und der Landschaftspflege lenken: auf den Naturhaushalt nach § 1 Nr. 1 BNatSchG und dessen Bestandteil: den Boden. Genauso, wie es Naturschutz au?erhalb der Naturschutzgesetze1 gibt, existiert Bodenschutz au?erhalb der Bodenschutzgesetze. The prison in economics: private and public incarceration in Ancient Greece

Recent histories of Ancient Greece describe a transition from customary law to public criminal justice between 800 and 400 B.C. This narrative contains three pieces of evidence against the presumption that prisons are a public good and government must provide incarcerations. First, before the rise of a formal government, Ancient Greece had a functioning system of criminal law enforcement. Second, the timeline surrounding the rise of government institutions in Ancient Greece originated with Solon’s penal reforms. Lastly, the rise of a government system was more the result of private rather than public interest.     

On restorative justice practiced in China

The victim-offender reconciliation (VOR), practiced by the basic public security, procuratorates and courts since the advent of 21^st century, is a new mode different from the mediation or conciliation in the procedure of civil litigation or of that accessory to the public prosecution in criminal proceeding. This mode connects the criminal justice with the mediation or private reconciliation by themselves. Thus, non-official settlement can influence the criminal justice and the decisions of authoritative agencies. It is beneficial to restore the victim’s interests, urge the offender to repent for his wrongdoings, compensate for the victim’s loss and restore the damaged social relationship. The VOR in China is the same in essence as the Western restorative justice, so it could be regarded as a Chinese mode of global restorative justice movement. Though the VOR mechanism works well, it still brings some matter in further consideration: (a) the legitimacy of VOR; (b) the conflict against the basic concept of crime; (c) the effect to the social reality.     

Problem Drinking, Jealousy, and Anger Control: Variables Predicting Physical Aggression Against a Partner

Alcohol use and intimate partner violence (IPV) are significantly related, but only a subset of individuals who drink are aggressive and relatively little is known about what moderates this relationship in community samples. Two risk factors, anger control and jealousy, were hypothesized to moderate the relationship between IPV and problem drinking in a sample of 453 community couples. A significant three-way interaction indicated that men with jealousy problems, but not anger control problems, were most likely to show the strongest association between problem drinking and IPV. In accord with the multiple threshold model of IPV, specific combinations of risk factors appeared to represent different thresholds in which problem drinking influenced the likelihood of IPV.     

Developmental Validation of the Quantifiler® Duo DNA Quantification Kit for Simultaneous Quantification of Total Human and Human Male DNA and Detection of PCR Inhibitors in Biological Samples*

Abstract: The Quantifiler^® Duo DNA Quantification kit enables simultaneous quantification of human DNA and human male DNA as well as detection of inhibitors of PCR in a single real-time PCR well. Pooled human male genomic DNA is used to generate standard curves for both human (ribonuclease P RNA component H1) and human male (sex determining region Y) specific targets. A shift in the cycle threshold (C_T) values for the internal positive control monitors the presence of PCR inhibitors in a sample. The assay is human specific and exhibits a high dynamic range from 0.023 to 50 ng/μL. In addition, the multiplex assay can detect as little as 25 pg/μL of human male DNA in the presence of a 1000-fold excess of human female DNA. The multiplex assay provides assessment of the DNA extract and guidance for the selection of the appropriate AmpFℓSTR^® Amplification Kit to obtain interpretable short tandem repeat profiles.
