Misuse of private information as a tort: The implications of Google v Judith Vidal-Hall

The Court of Appeal in the recent decision of Google Inc v Judith Vidal Hall¹ has made a number of remarkable rulings in the area of privacy. An important aspect of this decision is that it clarified the legal foundation in which an action for unauthorised disclosure of private information is found. However, the decision itself is not without flaws. This paper seeks to analyse potential problems with the action being classified as a tort as well as the scope of misuse of private information being a form of privacy protection.     

Culture and Formal Social Control: The Effect of the Code of the Street on Police and Court Decision-making

Objectives. Drawing on several interrelated lines of scholarship, we argue that cultural beliefs at individual and neighborhood levels may affect police and court decisions. We hypothesize that individuals who more strongly adhere to the code of the street or reside in areas where the street code culture is more strongly embraced will be more likely to be arrested and convicted, and that neighborhood-level effects will amplify the effect of street code adherence. Methods. To test these hypotheses, data from the Family and Community Health Study are examined using multilevel modeling. Results. Blacks who more strongly adhered to street code beliefs were more likely to be arrested and convicted; this effect was greater among those who resided in areas where the code of the street belief system was more entrenched. Conclusions. The findings highlight the potential usefulness of a focus on culture for understanding the exercise of formal social control.

Turkey’s Public Administration Today: An Overview and Appraisal

ABSTRACT

This study overviews and appraises Turkey’s contemporary public administration system. Its prominent characterizing features are discussed, with an emphasis on both the achievements and problem areas. Turkey has a long history of strong traditional bureaucratic practices and culture, from which its contemporary public administration system has emerged since the Republic was established almost a century ago. Despite its many achievements, public administration has its problems, generally the product of conflicts between tradition and modernity. Due emphasis should, however, be given to addressing the challenges of its over-politicization, strengthening governance practices, enhancing the human factor, and instituting further modern administrative reforms.     

论警察的公众信任--以中国为例

本研究评估了中国公民对警察的信任程度,并探讨了影响公众对警察信任程度的因素。就目前来看,针对中国公民对待警察的态度进行的实证研究寥寥无几。本研究以冲突理论为理论框架,通过收集中国8个城市的访谈数据,检验了性别、年龄、教育程度、收入、就业、感知政治影响力等冲突变量以及相关控制变量对中国警察公信力的影响。结果表明,这些变量对于中国公民对待警察的态度的解释力有限。青年以及政治权力较低的中国公民往往对警察的信任度较低。此外,中国公民对警察的态度还受到公共安全满意度、政府处理犯罪的能力、生活质量和政府官员腐败度的影响。同时本文也对未来研究的意义进行了讨论。
