区域知识产权自主创新能力与潜力研究——以河北省为例

区域知识产权自主创新是国家知识产权战略的重要组成部分,但目前我国区域知识产权创新还存在着数量少、质量低、创新效率不高等问题。本文以河北省为例,分析了问题的主要原因在于知识产权创新体系不完善,创新意识淡薄,创新激励机制不完善,高层次创新人才不足,创新经费投入强度较低,创新平台的规模、结构不合理等六个方面。提高我国区域知识产权自主创新能力需要营造良好的知识产权创新社会文化环境,建立健全知识产权工作体系,培养和吸引高层次人才,拓宽融资渠道,建设并优化创新平台。     

经济发达镇行政管理体制改革的思考

随着我国城镇化进程的快速推进,部分乡镇迅速发展成为经济发达镇,但传统的乡镇行政管理体制使经济发达镇长期处于责任大、权力小、功能弱、效率低的艰难境地,严重制约了经济发达镇自身的建设、发展和管理。本文在总结经济发达镇的基本特征的基础上,分析了经济发达镇的行政管理体制中目前存在的主要问题,并根据广东、浙江、山东等地在推进经济发达镇行政管理体制改革中的实践经验,对我国经济发达镇的行政管理体制改革提出相关对策建议。     

成本转嫁与养老保险的脆弱性

与养老保险相关的成本转嫁可以分为三个方面:(1)社会保险领域之外向养老保险领域的成本转嫁;(2)社会保险内部转嫁;(3)养老保险内部成本转嫁。不断指向养老保险的成本转嫁增加了养老保险的支付风险和脆弱性,严重威胁到我国养老保险的可持续性。本文从地方政府、企业和员工等利益主体的理性行为入手,基于养老保险的俱乐部产品性质,分析地区、代际间以及部门间的养老成本转嫁,进而提出恢复养老保险制度的独立性以及建立养老保险基金收支平衡的评估体系等建议。     

地方政府行政审批制度改革的困境与对策——基于F市外经贸系统的实证考察

基于流程再造的研究视角,本文对F市外经贸系统中的行政审批事项、内部运营、跨部门与跨层级审批等状况进行了实证考察,指出当前地方政府行政审批制度改革中存在越减越肥与审批拖沓、简政放权中的统筹不足、重审批中的轻监管等问题。文章提出应从提升行政服务中心的窗口办理效能、搭建行政审批网络一体化平台、建立审改公众参与制度、建立审改绩效考评制度等四个方面来推进行政审批制度改革。

从信息非对称性角度和现代企业融资结构理论的基本观点看,决定企业融资结构的因素以及其对企业治理的作用,往往会受到当事人信息非对称性因素的影响.因此,在理论上全面比较分析融资结构理论,并提出可供借鉴的理论模式,对企业来说,就具有决定性的意义.     

Ned Cobb's children: A new look at white supremacy in the rural southern US

Many scholars regard segregation in the US South as part of urbanization and modernization. Yet few have examined race relations in the countryside. The Rural Face of White Supremacy shows that absolute separation based on race proved poorly adapted to rural life. Inspired by the sociological studies of the rural South done in the 1930s and the 1940s, this book uses oral history to show that interracial social life in mid-twentieth century rural Georgia was ‘marked by intimacy as well as white supremacy.’ Race relations reflected the paternalism and dependence of an agrarian labour system that reduced black workers to the status of a peasantry.     

侵权法一般条款的保护范围

侵权法一般条款的立法模式及其保护范围是侵权立法中的重要问题。从比较法上看,德国法之规定与法国法之规定各有其优劣,但德国法更具借鉴意义。我国侵权立法,应认真总结以往立法及司法的成功经验,坚持已有的成熟做法,确立符合我国国情的立法模式。我国侵权责任法应通过一般条款列举具体的权利及利益保护范围,同时规定兜底条款,而不应从规定损害概念的角度界定侵权法的保护范围。     

Public budgeting and financial management curriculum reform: A conceptual framework

Public budgeting and financial management (PBFM) education has been undergoing intense scrutiny which can be seen through many professional conferences, journal symposia, and recently, the creation in 1984 of a Task Force on Budgeting and Financial Management Curriculum Reform by the Section on Budgeting and Financial Management of the American Society for Public Administration. This study analyzes pedagogic deficits in PBFM, suggests a comprehensive scope of PBFM, points to some dilemmas in PBFM curriculum design or reform, proposes some models for a curriculum reform, and raises some implementation constraints in each model.

Zusammenfassung  Mit dem Umweltschadensgesetz wird im deutschen Umweltrecht eine neuartige Haftung für Sch?den an der Biodiversit?t eingeführt. Die n?here juristische und naturwissenschaftliche Bestimmung dieser Umweltsch?den sieht sich jedoch mit mehreren Problemfeldern konfrontiert. Ausgehend von der gesetzlichen Schadensdefinition als erhebliche nachteilige Auswirkungen auf den günstigen Erhaltungszustand bestimmter Lebensr?ume oder Arten behandelt der Beitrag die Frage, wann solche Auswirkungen erheblich nachteilig sein k?nnen. Um den Begriff der “Erheblichkeit” einzugrenzen, wird die Rechtsprechung und Literatur zu ?hnlich unbestimmten Rechtsbegriffen aus anderen Bereichen des Umweltrechts auf ihre Verwertbarkeit und Anwendbarkeit überprüft. Im Ergebnis kann allein auf die im Rahmen der FFH-Vertr?glichkeitsprüfung anerkannten Kriterien zurückgegriffen werden.
