美国的“政治大棒”与德国的法律程序——后“9·11”时代,美德反恐国际合作第一案之解读

"9·11"事件后,德美看似亲密的反恐合作关系却在德国法院审判"9·11"事件中的国际恐怖嫌疑分子穆特萨迪格和穆祚迪案中陷入了困境。两国政府在反恐策略上的差异为这两个案件的结局规定了方向。德国政府部门拒绝向德国法院提供关键证据,损害了德国检察官的指控能力。美国政府拒绝与德国法院合作,则直接冒犯了德国法院的自尊。由于审判是在德国民众反对美国入侵伊拉克以及阿尔布莱格监狱丑闻之爆发的背景下进行的,德国公共舆论同情被告人,积极影响并支持了法院的判决。这两个案件可以视为德国法院及民众对布什政府所实施的反恐策略的一次大审判,判决结果是布什政府败诉。     

欧盟对印关系初探

欧印关系近年来突飞猛进,从开启首脑对话大门到确立战略伙伴关系,相隔不过4年时间。如今,双方在政治、经济、社会领域互动频繁,经济关系发展迅猛,战略伙伴关系正在落实。作为双方关系主要塑造者的欧盟,选择印度为外交重点出于三方面原因:发展到特定阶段的自然要求、现实利益驱动和战略上的考虑。欧盟与印度建立战略伙伴关系,不仅使欧印双方得益,而且对当前世界格局产生越来越显著的影响。     

DNA commission of the International Society of Forensic Genetics: Recommendations on the interpretation of mixtures

The DNA commission of the International Society of Forensic Genetics (ISFG) was convened at the 21st congress of the International Society for Forensic Genetics held between 13 and 17 September in the Azores, Portugal. The purpose of the group was to agree on guidelines to encourage best practice that can be universally applied to assist with mixture interpretation. In addition the commission was tasked to provide guidance on low copy number (LCN) reporting. Our discussions have highlighted a significant need for continuing education and research into this area. We have attempted to present a consensus from experts but to be practical we do not claim to have conveyed a clear vision in every respect in this difficult subject. For this reason, we propose to allow a period of time for feedback and reflection by the scientific community. Then the DNA commission will meet again to consider further recommendations.     

Psychological obstacles to administrative responsibility: Lessons of the MOVE disaster

Investigative bodies and other observers have attributed much of the blame for the 1985 MOVE catastrophe in Philadelphia to ineffective management by the city's previously successful mayor, W. Wilson Goode. Goode's behavior toward the disruptive extremist group followed two patterns, both paradoxical: protracted delay followed by excessive haste, and arms-length action that contrasted sharply with his usual hands-on management style. Drawing on the theory of decisionmaking developed by Irving Janis and Leon Mann, this paper suggests that both paradoxes resulted from unresolved decisional conflicts that impeded responsible and rational handling of the problem. The case points to the value of devoting more attention to the psychology of decision-making in educating present and future public managers.     

The evolution of European legal integration

This article contributes to the development of theories on European integration by testing and exploring statistical models on the long-term development of legislative activity of the European Commission. Drawing on legal information gained from the European Union’s PreLex database and analyzing it with the help of statistical analyses, we map out growth patterns of EU law between 1976 and 2003. We construct time-series models and models based on non-linear regression. While the performance of models based on the traditional theoretical approaches, intergovernmentalism and neo-functionalism, is rather poor, the analysis suggests that nonlinear dynamic models might be an interesting avenue for future conceptualizations of the EU integration process. Quantitative analysis of chlorpromazine by electron spin resonance (ESR) spectroscopy

A simple and sensitive method is described for quantitative analysis of chlorpromazine in blood, serum, urine and tissue homogenate. The chlorpromazine cation radical produced by adding perchloric acid and 2,3-dichloro-5,6-dicyano-p-benzoquinone to the sample can be detected by the ESR method at room temperature. The sensitivity limit is 10 ng, that is, 20 μl of the solution containing 0.5 μg chlorpromazine/ml. The time needed for the measurement is within 10 min. The chlorpromazine radical thus produced is very stable; for example, 95% of the radical was observed after 24 h. The advantage of this method is discussed by comparing with the ordinary spectrophotometry which requires the purification of the sample.
