Serum C-reactive protein levels in postmortem blood--an analysis with special reference to the cause of death and survival time

We have investigated postmortem serum CRP levels in 408 forensic autopsy cases consisting of 216 acute and 192 non-acute death cases having postmortem interval of less than 48 h. CRP ranged from 0.03 to 66.13 mg/dl with the median of 0.28 mg/dl. In 362 traumatic death, survival time and the presence of severe infection were the major factors contributing to CRP elevation, while postmortem interval, age, gender, hepatic injury and liver cirrhosis was not. In almost all the immediate deaths (15/16) CRP remained at a low level (<0.5 mg/dl). Acute deaths and subacute deaths within 6 h showed lower CRP levels compared to longer survivors, consistent with the clinical and experimental studies. As for natural diseases, the CRP level reflected the pathological findings. The results suggest a possibility of CRP as a forensic diagnostic marker.

Automated determination of carboxyhemoglobin contents in autopsy materials using head-space gas chromatography/mass spectrometry

To establish a method for the routine analysis of carboxyhemoglobin (COHb) in autopsy materials including those which have undergone postmortem changes, e.g. thermo-coagulation, putrifaction and contamination, an automated head-space gas chromatography/mass spectrometry (GC/MS) analysis was utilized. The procedure consisted of preparation of the sample in a vial and a carbon monoxide (CO) saturated sample, for estimation of hemoglobin content, in another vial, the addition of n-octanol, potassium ferricyanide and an internal standard (t-butanol), GC separation and determination of CO using a GC/MS system equipped with an automated head-space gas sampler. The method was practical not only with the blood and bone marrow aspirates to confirm the findings on the CO-oximeter system, but also with the thermo-coagulated and putrified blood.

非法储存爆炸物罪的司法认定问题研究

解决司法实践中认定非法储存爆炸物罪存在的分歧,应从四个方面入手：一是围绕立法本意,科学界定刑法上“爆炸物”的范围;二是针对目前关于“非法储存”的规定在司法认定中引起的争议,深入分析,提出认定“非法储存”中应遵循的原则;三是通过对非法储存爆炸物罪的未完成形态的分析,形成对未完成形态认定的正确方法;四是结合实践中易混淆的情况,对本罪与他罪进行比较研究,指出本罪与他罪的认定界限。     

Tissue-specific differences in mRNA quantification of glucose transporter 1 and vascular endothelial growth factor with special regard to death investigations of fatal injuries

Glucose transporter 1 (GLUT1) and vascular endothelial growth factor (VEGF) have been established as being responsible for cellular adaptation to oxygen deficiency in tissue ischemia and hypoxia mediated by hypoxia-inducible factor 1. We hypothesized that mRNA quantification of these factors in autopsy tissue specimens could have diagnostic significance for investigating the pathology of death, especially after injury. Various cases (total, n=119; less than 48h postmortem) were examined, including fatal blunt injury (n=71) and sharp instrument injury (n=18), as well as asphyxia (strangulation/hanging, n=12) and acute myocardial infarction/ischemia (n=18) as controls. Quantification of mRNA by TaqMan real-time RT-PCR and immunostaining were performed for GLUT1 and VEGF in lung, kidney, and skeletal muscle specimens. The postmortem interval showed no significant influence on the relative quantification of mRNA during the early postmortem period. Characteristic results were found in blunt injury cases: both GLUT1 and VEGF mRNAs decreased in the lung but increased in the skeletal muscle depending on survival time. In the kidney, subacute deaths showed higher GLUT1 mRNA levels compared with acute deaths from blunt injury, but no significant change was found for VEGF mRNA. Immunohistochemistry showed visually predominant GLUT1 immunoreactivity in the renal cortex for cases with a longer survival time, coincident with the results at the mRNA level. Tissue-specific differences in mRNA quantification of GLUT1 and VEGF shed light on tissue ischemia/hypoxia and subsequent tissue-dependent pathophysiological changes leading to death after injury.

行政行为的效力包括形式效力与实质效力,两者构成了行政行为的效力体系。严重且明显瑕疵行政行为不具有形式效力的理论与制度混淆了形式效力与实质效力发生的基础。形式效力是基于行政行为的形式而具有的效力,与行政行为内容中的瑕疵无关,瑕疵行政行为都应具有形式效力。实质效力是基于行政行为内容的实质正当而具有的效力,不同的瑕疵将不同程度地影响着行政行为的实质效力并导致该行为被撤销、确认无效与治愈的法律后果。     

确认有限责任公司股东资格之依据问题再探讨

现有理论对有限责任公司股东资格的确认依据之研究呈现出绝对论与相对论两种倾向。应基于尊重法律合意的效力,认定股东资格确认行为就其性质而言为确权行为而非设权行为,并从证据分类的角度将来源于股东的证据称为有利公司的证据,将来源于公司的证据称为有利股东的证据,同时加上工商登记作为有利于善意第三人的证据,从而构成完整的确认有限责任公司股东资格之证据体系。
