Research Summary: Mandatory and pro‐arrest policies in domestic violence incidents have increased strains on prosecutorial and court resources. They have also brought to prosecutors many cases in which victims never wanted batterers charged and prosecuted. Prosecutors are faced with the dilemma of (a) screening out difficult cases up front and expending resources on fewer but more winnable case or (b) prosecuting a larger number of cases as adequately as resources will allow. We studied a natural experiment that resulted when the Milwaukee prosecutor liberalized his screening policy to double the number of domestic violence case filings. After the new screening policy was implemented, time to disposition doubled, convictions decreased, the prevalence of pretrial crime increased, and victim satisfaction declined. Policy Implications: The results do not support the idea that domestic violence cases can be readily prosecuted without regard for victim desires. To commit to such a policy would require a substantial commitment of additional staff, resources to collect additional types of evidence, and a willingness to try a substantially larger number of cases.  相似文献

Throughout the land there has been a growing dissatisfaction with the programs and treatment carried on within institutions, especially those dealing with juveniles. This article attempts to pinpoint some of the reasons why institutions are unable to meet the challenge of delinquency in our society. On the one hand, impediments are inherent to the institutional system; on the other, due to outside forces and factors. they are beyond the control of the institution. Patchwork attempts to shore up a sagging, outmoded system are futile. The facets that perpetuate the present system are identified. and some of the decisions required to build a new system of child care are noted.  相似文献

Recent analyses of the relationship between crime and an aggressive patrol strategy have led to no single conclusion concerning the deterrent power of aggressive policing. This research adds to that debate by exploring the effects of a variety of aggressive patrol tactics on several different crimes. The empirical analysis, based on cross-sectional data from sixty urban neighborhoods, indicates that there appears to be no stable complex of police actions that constitute an aggressive patrol strategy. However, one form of police action usually included under the rubric of aggressive patrol—suspicion stops—may indeed deter certain types of criminal activity.  相似文献

This article documents the experience of a communityNew Philadelphia, Ohioin which a concerned judge attempted to apply severe penalties in order to deter drunk driving. Surveys of drivers on weekend nights were performed in this community and the nearby comparison city of Cambridge in order to determine the extent to which the legal threats were perceived and the extent to which people drank and drove. It was found that the judicial policies were well known in New Philadelphia, but no differences could be discerned in the extent of drinking and driving between the two cities. No significant differences were found in the subsequent records of samples of sentenced drivers in the two cities, the New Philadelphia sample being sentenced to heavy punishments and the Cambridge drivers being sentenced traditionally. The accomplishments and limitations of the experience reported in this study are relevant both to formulating effective countermeasures to drunk driving in specific American communities, and to understanding the role of lawits capabilities and limitationsin addressing social problems more generally.  相似文献
